Lakota Creek Kennels is dedicated to the improvement of the Labrador Retriever. The intent of this contract is to assure Puppy Buyers that the puppies produced from this kennel are not from indiscriminate breeding, but from careful planning intended to preserve the breed's sound temperament, health, trainability, and working or companion qualities.

The following agreement is between Lakota Creek Kennels, and:

Lakota Creek Kennels will notify Puppy Buyer within three days of birth of the litter. Please note deposits will not be returned in the event that a puppy is not available for the sex Puppy Buyer has requested. However, the deposit may be transferred to another litter in the event a puppy is not available for the sex Puppy Buyer has requested. Puppy Buyer will be given the opportunity to move to the end of the deposit list on available puppies of the opposite sex.

Puppy Pick Out and Send Home Day will be the Saturday after the puppies turn 8 weeks old (unless notified otherwise). Puppies are picked in order of deposit on the day they get sent home.

Puppy Buyer agrees to pick up their puppy on the above send home date. If the puppy cannot be picked up on that date, a boarding fee of $50 a day will be due upon pick up of the puppy.

Lakota Creek Kennels does not ship puppies. Puppy Buyer must pick up their puppy from Lakota Creek Kennels. If Puppy Buyer decides to ship the puppy, Lakota Creek Kennels does not accept responsibility for any health issues aside from genetic issues that may arise.

Lakota Creek Kennels certifies that, upon Puppy Buyer's receipt, the puppy is in good health and has been given its first set of vaccinations, has been wormed, and has had a health check by a licensed veterinarian.

Lakota Creek Kennels will provide health and vaccination records to Puppy Buyer.

Puppy Buyer may return the puppy at Puppy Buyer's expense for a full refund if it develops an illness within three days of being picked up. Puppy Buyer must notify Lakota Creek Kennels immediately following diagnosis. Documentation must be provided by Puppy Buyer's veterinarian and will be reviewed by Lakota Creek Kennels' veterinarian for concurrence.

Puppy Buyer must return the puppy within 24 hours of notifying Lakota Creek Kennels of the puppy's illness with all registration paperwork and health records at Puppy Buyer's expense. Lakota Creek Kennels does not accept responsibility for contagious diseases diagnosed after three days from date of pick up.

If during examination by Puppy Buyer's veterinarian a genetic issue is found and documented in writing by the examining veterinarian, the puppy may also be returned at Puppy Buyer's expense for a full refund. If the genetic issue can be repaired and Puppy Buyer wishes to do so, Lakota Creek Kennels will reimburse Puppy Buyer up to the cost of the puppy. Any additional expenses will be the sole responsibility of Puppy Buyer.

Lakota Creek Kennels will guarantee the puppy against hip dysplasia, elbow dysplasia, genetic eye issues, and any other proven genetic health issues for the life of the puppy.

Should any circumstances arise that affect the quality of life of the puppy, Lakota Creek Kennels is to be informed so they may participate in determining the future of the puppy.

This guarantee does NOT cover conditions that are a result of negligence and/or abuse of the puppy.

• Register the puppy with limited AKC registration, if applicable
• Administer the first set of vaccinations and worming for the puppy
• Microchip the puppy and register the microchip for the new owner, if applicable
• Provide Puppy Buyer with a veterinary health check for the puppy
• Guarantee the puppy against proven genetic conditions for the life of the puppy

• Expose the puppy to appropriate socialization, training, and enrichment opportunities
• Provide the puppy with a home, work, or activity environment suitable for the breed's energy level and temperament

• Provide the puppy with a suitable home environment and breed-appropriate exercise, training, and stimulation
• Keep the puppy in the house as part of the family
• Maintain the puppy in good health as recommended by a veterinarian, including proper immunizations, regular vaccine boosters, fecal exams, heartworm tests, and recommended routine therapy
• Will not spay or neuter the puppy until it is a minimum of 12 months old, if so desired

Not all dogs should be bred. Lakota Creek Kennels has chosen to limit registration of its puppies in an effort to educate Puppy Buyers as well as protect and maintain the integrity of the breed. If Puppy Buyer wishes to breed their puppy, Puppy Buyer agrees to complete health testing, temperament evaluation, and any other breed-appropriate testing or titling before Lakota Creek Kennels will consider lifting limited registration. The decision will be made together whether the dog in question should be bred. Lakota Creek Kennels holds Puppy Buyers to the same standards it holds itself when determining whether a dog should be bred and whether it would be an improvement to the breed.

If, for any reason, Puppy Buyer can no longer care for the puppy, Lakota Creek Kennels shall be given the first opportunity to resume ownership; however, Lakota Creek Kennels is not required to accept the puppy. If Lakota Creek Kennels resumes ownership, the puppy will be returned with all registration paperwork and health records. Under no circumstances will the puppy be sold, leased, traded, or given away to any breeder, kennel, pet shop, research laboratory, animal shelter, or similar facility. In doing so, Puppy Buyer will be responsible for a fee of $5,000 plus any legal or recovery costs associated with the return of the puppy to Lakota Creek Kennels.

Lakota Creek Kennels is hereby released from any and all future liability to Puppy Buyer with regard to the puppy. Puppy Buyer agrees that from the date they take possession of the puppy, Puppy Buyer accepts all liability for the actions of the puppy and holds Lakota Creek Kennels harmless with regard to any and all third parties. No other warranties or guarantees, expressed or implied, are made under this contract except as stated herein.
