Surf Sisters Byron Bay

By hiring and using equipment from Surf Sisters Byron Bay, you agree to the following terms and conditions:

1. Acknowledgement and Assumption of Risk
I acknowledge that surfing is a dangerous recreational activity that involves inherent and unpredictable risks, including but not limited to:

Injury or death to myself or others
Drowning or near drowning
Collision with other surfers, swimmers, boards, or objects
Changing ocean and weather conditions
Marine life
I voluntarily accept and fully assume all risks associated with the use of the hired surfboard, whether caused by my actions or the actions of others.

2. Responsibility for Equipment
I agree to take full responsibility for the surfboard and any accessories during the hire period. I will use the equipment safely, appropriately, and within my ability level.

I will not allow any other person to use the equipment unless expressly approved by Surf Sisters Byron Bay.

3. Damage, Loss, or Theft
I accept full financial responsibility for any damage to, loss of, or theft of the surfboard and accessories during the hire period.

This includes (but is not limited to):

Dings, cracks, or structural damage
Fin or leash damage
Damage caused to other boards, people, or property
Full replacement cost if the board is lost or stolen

Repair or replacement costs will be determined by Surf Sisters Byron Bay and may be deducted from the security deposit. If costs exceed the deposit amount, I agree to pay the remaining balance.

4. Condition of Equipment
I acknowledge that I have inspected the surfboard and confirm it is in good condition prior to use (unless otherwise noted). I agree to return the board in the same condition. I agree to immediately report any damage or issues that occur during the hire period.

5. Personal Liability for Injury or Damage to Others
I acknowledge that I am solely responsible for my actions while using the surfboard.

I accept full liability for:

Any injury caused to other people
Any damage caused to other surfboards or property
I agree that Surf Sisters Byron Bay is not responsible for any such injury or damage.

6. Release of Liability
To the fullest extent permitted by law, I release, waive, and discharge Surf Sisters Byron Bay, its owner(s), employees, and affiliates from any and all liability, claims, or demands arising from:

Personal injury or death to myself or others
Loss or damage to property
Any incident occurring during the hire or use of the equipment

7. Indemnity
I agree to indemnify and hold harmless Surf Sisters Byron Bay against any and all claims, damages, costs, or legal actions brought by myself or any third party as a result of my use of the surfboard.

8. Fitness to Participate
I declare that I am physically and mentally fit to participate in surfing and will not use the equipment under the influence of drugs or alcohol.

9. Hire Period Agreement
I agree to return the surfboard at the agreed time. Late returns may incur additional fees.

10. Personal Belongings
Surf Sisters Byron Bay is not responsible for any personal belongings lost, stolen, or damaged during the hire period.

11. Right to Refuse Hire
Surf Sisters Byron Bay reserves the right to refuse hire if it is deemed unsafe based on the information provided or observed ability level.

12. Security Deposit
A refundable security deposit is required prior to hire. Surf Sisters Byron Bay reserves the right to retain part or all of the deposit to cover damage, loss, theft, or late return of equipment.

13. Agreement
By signing below, I confirm that I have read, understood, and agree to all terms outlined in this agreement and waiver.

A refundable security deposit of $100 is required prior to hire. Surf Sisters Byron Bay reserves the right to retain part or all of the deposit to cover damage, loss, theft, or late return of equipment.
