This Membership Agreement and Waiver of Liability ("Agreement") is entered into between Atavista Fitness LC ("Facility") and the undersigned member ("Member"). By signing this Agreement, Member agrees to all terms and conditions below.

Member agrees to enroll in the membership plan selected at the time of signup. Membership details, including rate, billing schedule, term length, and privileges, are determined by the selected plan and confirmed at the time of registration.

Membership dues will be billed automatically on a recurring basis through the Facility's billing provider. Member agrees to maintain a valid payment method on file at all times and authorizes the Facility to charge the payment method for all membership fees, late fees, and applicable charges.

Founding Member rates are available only to members who agree to the required commitment term at signup. Founding rates remain locked in for as long as the membership remains active and in good standing. If the membership is cancelled for any reason, the Founding rate is forfeited and may not be available again.

Certain membership plans may allow the Member to bring one guest per visit, including partnered or dual memberships. Guest privileges apply only when the primary member is present and do not grant independent access to the Facility unless otherwise approved by the Facility.

Members enrolled in a partnered or plus-one membership understand that any guest enters the Facility at their own risk. The Member accepts full responsibility for the conduct of their guest while in the Facility and agrees that the Member assumes all risk and liability related to the presence, actions, or injuries of their guest while on the premises.

By enrolling in a partnered or plus-one membership, Member acknowledges that the Facility may not require a guest to sign a waiver each visit, and Member agrees that this

does not create liability for the Facility. The Facility reserves the right to require a waiver from any guest at any time and may deny access to any guest at its discretion.

Members enrolled in a plan that requires a commitment agree to maintain active membership for the full term selected at signup, including but not limited to 12-month agreements.

If Member cancels a commitment-based membership before the end of the agreed term, Member agrees to pay a termination fee equal to three (3) months of membership dues or the remaining balance of the agreement, whichever amount is less. The termination fee may be charged to the payment method on file.

Month-to-month memberships renew automatically each billing cycle and may be cancelled with written notice prior to the next billing date.

If a payment fails or the account becomes past due, Facility reserves the right to suspend membership access until the balance is paid. Continued failure to pay may result in cancellation of membership and loss of any special rates.

Facility reserves the right to suspend or revoke facility access at any time for non-payment, violation of rules, incomplete paperwork, or any reason deemed necessary for safety, security, or business operation.

Member understands that completion of this Agreement and liability waiver is required before access to the Facility will be granted. Facility reserves the right to deny or suspend access until all required documents are completed.

Members are granted access through the Facility access control system. Access is for the registered Member only and may not be shared or transferred.

Members may not allow non-members to enter the Facility unless enrolled in an approved partnered or plus-one membership plan.

The Facility may operate without staff present at certain times. Member understands and accepts that use of the Facility during unstaffed hours is at their own risk.

Member understands that the Facility uses video surveillance for safety and security purposes and consents to being recorded while on the premises.

Member agrees to follow all posted rules and policies of the Facility. The Facility reserves the right to revoke membership without refund for behavior that is unsafe, disruptive, illegal, or violates Facility rules.

Facility reserves the right to change membership rates for future memberships. Founding rates remain valid only while the membership remains active and in good standing.

To cancel membership, Member must provide written notice prior to the next billing date. Cancellation requests received after billing has processed will take effect the following billing cycle.

Member must be at least eighteen (18) years of age unless a parent or legal guardian has completed the required consent forms approved by the Facility.

Member understands that use of a fitness facility involves inherent risks including but not limited to serious bodily injury, permanent disability, illness, or death. Member voluntarily assumes all risks associated with use of the Facility.

Member understands that Atavista Fitness LC operates as a 24-hour facility and staff may not be present at all times. Member agrees to use the Facility at their own risk.

To the fullest extent permitted by law, Member releases, waives, and discharges Atavista Fitness LC, its owners, employees, contractors, agents, and affiliates from any and all liability, claims, or causes of action arising from use of the Facility, including claims caused by negligence.

Member agrees to use all equipment properly and to stop exercising immediately if pain, dizziness, or discomfort occurs.

Facility is not responsible for lost, stolen, or damaged personal property.

Member represents that they are physically able to participate in exercise activities and will consult a physician if needed.

Member agrees to follow all Facility rules and understands that violation may result in termination of membership without refund.

Member agrees that an electronic signature has the same legal effect as a handwritten signature.

This Agreement shall be governed by the laws of the State of Arkansas.

Member has read, understood, and voluntarily agrees to all terms of this Agreement.
