IMPORTANT - READ CAREFULLY
This agreement affects your legal rights. By signing, you are releasing RBC, LLC d/b/a Red Barn Campground from liability, including liability for its own negligence, to the maximum extent permitted under Wisconsin Law.
Acknowledgement of High-Risk Water Activity
I understand that participation in swim pond activities and use of water inflatables involves INHERENT AND SIGNIFICANT RISKS, including but not limited to:
- Drowning or Near-drowning
- Slipping or falling on wet surfaces
- Collisions with other participants or equipment
- Head, neck, or spinal injuries
- Equipment failure
- Panic or distress in water
- Hidden underwater hazards
- Changing water depth
- Natural bodies of water conditions
- Weather-related hazards
I acknowledge that serious injury or death can occur.
No Lifeguard - Supervision Required
I understand and agree:
- No lifeguard is on duty unless explicitly posted.
- All participants MUST wear a properly fitted life vest at all times.
- A parent or legal guardian must actively supervise minors (17 and under) at all times.
- Wristbands are required for entry.
- All posted pond rules must be followed.
I accept full responsibility for supervising all minors and participants under my care.
Assumption of Risk
I voluntarily and knowingly assume ALL RISKS associated with participation in swim pond and inflatable activities, whether known or unknown, inherent or otherwise.
I acknowledge that water recreation is inherently dangerous and that I choose to participate despite these risks.
Release of Liability (Including Negligence)
TO THE FULLEST EXTENT PERMITTED BY WISCONSIN LAW, I HEREBY RELEASE, WAIVE, AND DISCHARGE RED BARN CAMPGROUND, ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND AGENTS FROM ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO:
- PERSONAL INJURY
- DEATH
- PROPERTY DAMAGE
- LOSS OR THEFT
- PARTICIPATION IN SWIM POND ACTIVITIES
INCLUDING CLAIMS ARISING FROM THE NEGLIGENCE OF RBC, LLC d/b/a RED BARN CAMPGROUND.
This release does not apply to gross negligence or willful misconduct where prohibited by Wisconsin Law.
Recreational Activity Acknowledgement (WIS. STAT. § 895.52)
I acknowledge that my participation constitutes a recreational activity under Wisconsin law. Nothing in this agreement limits statutory immunities available to Red Barn Campground under Wisconsin recreational immunity statutes.
Minor Child Waiver & Indemnification
As parent or legal guardian of any minor listed in this reservation, I:
- Consent to their participation
- Assume all risks on their behalf
- Agree to release and indemnify RBC, LLC d/b/a Red Barn Campground for any claims brought by or on behalf of said minor.
I understand Wisconsin courts scrutinize minor waivers, and this provision is intended to be as broad and enforceable as permitted by law.
Indemnification
I agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS RBC, LLC d/b/a Red Barn Campground from any claims, damages, liabilities, attorney fees, or expenses arising from:
- My participation
- Participation of minors under my supervision
- Violation of pond rules
- Unsafe conduct
Rule Violations
Failure to follow pond rules, including life vest requirements and supervision requirements, may result in immediate removal from the swim area or campground without refund.
Medical Authorization
In the event of an emergency, I authorize RBC, LLC d/b/a Red Barn Campground staff to seek medical assistance for myself or minors under my supervision. I understand I am financially responsible for any medical services rendered.
Venue & Jursidiction
The laws of the State of Wisconsin govern this agreement. Any dispute shall be litigated exclusively in the State Courts of Wisconsin in the county in which RBC, LLC d/b/a Red Barn Campground is located.
I consent to Wisconsin jurisdiction.
Severability
If any provision is deemed unenforceable, the remaining provisions shall remain in full force and effect.
