HOLD HARMLESS AGREEMENT AND RELEASE OF LIABILITY
THIS DOCUMENT IS A LEGALLY BINDING INSTRUMENT, PLEASE READ IT THOROUGHLY, REFUSE TO PARTICIPATE IN THE ACTIVITIES AND CONSULT WITH AN ATTORNEY IF YOU HAVE ANY QUESTIONS AS TO ITS CONTENTS.
In consideration of being permitted to participate in volunteer activities at the New Skete Communities (The Monks of New Skete, Inc. and the Sisters of St. Clare, Inc. d/b/a The Nuns of New Skete (hereinafter collectively referred to as “New Skete” or “releasee”) operations and premises as well as the property of others with whom the New Skete may from time to time agree with to utilize such property for activities, the undersigned:
1. Agrees that prior to participating, or in the case of a minor participant, the parent(s) or legal guardian(s) will instruct the minor participant that prior to participating, he/she should inspect the facilities, equipment and animals to be used, and if the participant believes anything is unsafe, or has any concerns about a particular facility, equipment or animal, he/she should immediately advise an employee of New Skete or the owner/ employee of the property upon which the activity is occurring of such conditions and refuse to participate.
2. Agrees to or in the case of a minor participant, the parent(s) or legal guardian(s) will instruct the minor participant that prior to participating, he/she should listen to and follow all instructions and warnings given by employees, agents and volunteers of New Skete, including any posted rules or warnings or similar instructive document.
3. Acknowledge and fully understand that each participant will be engaging in activities that involve inherent risk of serious injury, including permanent disability and death, and severe social and economic losses which might result not only from their own actions, inactions or negligence but the actions, inactions or negligence of others, or the actions of animals which are impossible to predict or control and may cause serious injury, including permanent disability and death due, but not limited to: bites, scratches, knock downs, slips, falls, fractured limbs, broken bones, concussions, contusions, dislocated joints and dismemberment resulting from the volunteer activities. Further, there may be other risks not known to New Skete and / or its employees, agents or volunteers or not reasonably able to foresee at this time.
4. Assume all the foregoing risks both known and unknown and accept personal responsibility for the dangers following such injury, permanent disability or death.
5. Release, waive, discharge and covenant not to sue New Skete, its officers, directors, agents or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners, lessees and lesssors of the premises used to conduct such operations, all of which are hereinafter referred to as “releasees” from liability to each of the undersigned, his/her heirs and next of kin for claims demands, losses or damages on account of injury, including death or property damage caused or alleged to be caused in whole or in part by the negligence of the releasee or otherwise.
By submitting this application, I affirm that the facts set forth in it are true and complete. I understand that if I am accepted as a volunteer, any false statements, omissions, or other misrepresentations made by me on this application may result in my immediate dismissal. I also understand and agree that this position is strictly a volunteer position and that no employer/ employee relationship is formed or contemplated and that no compensation will be provided for the services rendered by me as a volunteer. I agree to be bound by the terms of the Release and Hold Harmless Agreement submitted herewith
