WAIVER AND RELEASE OF LIABILITY
In consideration of being permitted to participate in the Town of Louisa Sunset Market (the “Event”), I, on behalf of myself, my business (if applicable), employees, agents, representatives, and any minor participants under my supervision, agree to the following:
1. Assumption of Risk
I understand that participation in the Event involves inherent risks, including but not limited to:
Setup and breakdown of tents, equipment, displays, or materials
Electrical connections, generators, cooking equipment/
Food preparation and service
Walking, riding, or operating vehicles, floats, or equipment
Interaction with large crowds, pedestrians, and other participants
Distribution of items
Weather conditions, including wind, heat, or storms
Road conditions, surfaces, and event site conditions
I voluntarily assume all risks associated with participation.
2. Release of Liability
I hereby release and discharge:
The Town of Louisa, Louisa County, event sponsors, and all respective officers, directors, employees, volunteers, agents, and representatives (collectively, the “Released Parties”) from any and all claims, damages, or causes of action arising out of or related to my participation in the Event, including setup and breakdown.
3. Indemnification
I agree to indemnify and hold harmless the Released Parties from any and all claims, liabilities, damages, or expenses (including attorney’s fees) arising from:
My participation in the Event
My business operations (if applicable)
Products sold or distributed (if applicable)
Food or beverage service (if applicable)
Operation of vehicles, equipment, or materials
Actions of my employees, contractors, representatives, or participants in my group
4. Insurance and Compliance
I certify that:
I am responsible for maintaining all required licenses, permits, and insurance
I will comply with all applicable health, safety, fire, and local regulations
I will operate in a safe and responsible manner at all times
5. Equipment and Property
I am solely responsible for my equipment, inventory, materials, and setup. The Released Parties are not responsible for loss, theft, or damage.
6. Conduct and Site Responsibility
I agree to:
Maintain a safe and clean space
Properly secure tents, equipment, and materials
Follow all event guidelines, instructions, routes, and assigned areas
I understand that failure to comply may result in removal from the Event.
7. Responsibility for Participants
I acknowledge that I am responsible for:
My own actions and participation
The actions and safety of any individuals, employees, volunteers, or participants under my direction or supervision
Ensuring safe operation of any vehicles or equipment (if applicable)
8. Medical Responsibility
I understand that I am responsible for any medical needs or costs resulting from participation.
9. Third-Party Responsibility
I acknowledge that the Event includes multiple participants. The Released Parties are not responsible for the actions of other participants or attendees.
10. Media Release
I grant permission for photos and video taken during the Event, including my participation, materials, or group, to be used for promotional purposes.
11. Minor Participants
If I am signing on behalf of a minor, I certify that I am the parent or legal guardian and accept all responsibility on their behalf.
12. Severability
If any provision of this agreement is deemed invalid, the remainder shall remain in full force and effect.
By checking this box, I acknowledge that I have read, understand, and agree to the Vendor Waiver and Release of Liability for the Town of Louisa Sunset Market. I understand that this is a legal agreement and that I am giving up certain rights, including the right to bring a claim against the event organizers.
