Facility Hire
The Shire reserves the right to:
- refuse any application to hire; or
- cancel or alter the booking at any time.
Application for hire of a venue must be made on the online form located on Leschenault Leisure Centre's website and be completed by a person over the age of 18 years who will be responsible for payment of fees and any other charges arising from the booking, and for the observance of these conditions of hire.
Amendment of Hire Conditions
Hirers are advised that these conditions of hire may be amended by the Shire without notice at any time. Notwithstanding this, when conditions are amended every effort will be made to inform all hirers.
Bookings
All bookings must be submitted on the official booking request form and confirmed prior to use. Approved booking times include set-up and pack-down. Use outside allocated times may incur additional charges and affect future bookings.
Fees and Charges
Fees are payable in accordance with the Shire of Harvey’s current adopted fees and charges. Payment for the entire booking must be made prior to use unless otherwise arranged.
Cancellations
Cancellations must be made with a minimum of 24 hours’ notice. Failure to do so may result in full fees being charged.
Use of Ovals
Ovals must only be used for the approved purpose. The Shire reserves the right to restrict or cancel use due to weather, maintenance, or safety concerns.
Subletting
The hirer must not assign, transfer or sublet the booking, or any part of the facility, to another or organisation without prior written approval from the Shire of Harvey. Any unauthorised subletting may result in cancellation of the booking and forfeiture of fees.
Supervision and Conduct
Hirers are responsible for the behaviour and supervision of all participants and spectators. Activities must be conducted safely and in an orderly manner at all times.
Condition of Grounds
Hirers must ensure the oval is left in a clean and tidy condition. All litter must be removed and placed in bins. Damage to turf, infrastructure, or surrounding areas must be reported to the Shire of Harvey as soon as practicable.
Vehicles
Vehicles are not permitted on ovals or grassed areas without prior written approval.
Equipment
Hirers are responsible for the safe use and storage of their own equipment. The Shire accepts no responsibility for loss or damage to equipment.
Alcohol
Alcohol is not permitted without prior written approval from the Shire and must comply with the Liquor Control Act 1988. Appropriate licences must be obtained where required.
Smoking
Smoking is not permitted on Shire of Harvey ovals or within surrounding facilities.
Emergencies
The hirer will give effect to any reasonable direction of a designated Shire officer, where such direction has the intention of dealing with an emergency or preventing a foreseeable accident or loss. Where no Shire officer is present, the hirer shall undertake responsibility to respond to an emergency by clearing the area, contacting emergency services and minimising the hazard as appropriate and safe to do so.
Liability and Insurance
The Shire of Harvey Insurers do not provide Public Liability coverage for any person or group of persons that are an Association, Corporation, Sporting Body, Club, Business or Incorporate Body who hire a Shire facility.
If required by the Shire, hirers shall provide public liability insurance coverage with a minimum cover of $20 million to protect their group from any damage or injury that may occur. When required, evidence of Public Liability cover must be provided prior to commencement of hire.
All liability of loss or damage to property or persons during the hire of Shire premises is the responsibility of the hirer.
The Shire shall not accept liability for any damage, illness or injury caused or found to be caused to any person or property as a result of acts or omissions of the hirer, guests, invitees, or persons under their control.
The Shire is indemnified against any claim, loss or expense which may be made or arise as a result of the use of the hired premises.
