Credit Application Form

I, the undersigned, hereby bind myself as surety and co-principal debtor in solidum for all amounts which may now or in future be owing by the Applicant to First Trade Global (Pty) Ltd. I confirm that I have read, understood, and agree to the terms and conditions of this credit application.

CUSTOMER COLLECTION, DELIVERY & PRODUCT ACCEPTANCE INDEMNITY 1. COLLECTION FROM THIRD PARTIES The Customer acknowledges and agrees that where goods are collected from any third-party cold store, warehouse, or supplier: Such collection is undertaken entirely at the Customer’s own risk The Customer (or their appointed transporter) assumes full responsibility for: Correct product collection Condition of goods at time of collection Temperature control and cold chain maintenance from point of collection First Trade Global (Pty) Ltd (Registration No. 2020/155029/07) shall not be liable for any: Loss Damage Shortages Temperature deviations once the goods have been made available for collection. 2. DELIVERY AND TRANSFER OF RISK All risk in the goods shall pass to the Customer: Upon dispatch, or Upon collection, whichever occurs first Where First Trade Global (Pty) Ltd arranges delivery: The Customer must ensure immediate offloading and proper storage Any delays, improper handling, or failure to maintain required conditions shall be for the Customer’s account 3. COLD CHAIN RESPONSIBILITY The Customer expressly acknowledges that: Products supplied may be temperature-sensitive The Customer is fully responsible for maintaining the required cold chain from: Time of collection, or Time of delivery First Trade Global (Pty) Ltd shall not be held liable for: Any deterioration in product quality Spoilage or contamination Loss or damage arising from a break in the cold chain, regardless of cause after risk has passed. 4. ACCEPTANCE OF GOODS ("AS IS") The Customer agrees that: Goods are accepted “as is” and in good order upon: Collection, or Delivery A signed delivery note / invoice / collection document shall constitute: Final and conclusive proof that goods were received in good condition and correct quantity Any claims for: Damages Shortages Incorrect items must be: Noted at the time of delivery or collection, and Reported in writing within 24 hours Failure to comply shall result in no claim being valid or enforceable. 5. NO RETURNS POLICY (FROZEN & PERISHABLE GOODS) No returns will be accepted on: Frozen goods Refrigerated goods Perishable products unless: Agreed to in writing by First Trade Global (Pty) Ltd prior to return Under no circumstances will goods be accepted for return where: The cold chain may have been compromised The goods have been handled, stored, or transported by the Customer or third parties 6. RETENTION OF OWNERSHIP (VERY IMPORTANT) All goods supplied remain the sole and absolute property of First Trade Global (Pty) Ltd (Registration No. 2020/155029/07) until: The full purchase price, and Any other amounts owing have been paid in full. Until such payment: The Customer shall: Store the goods in a manner that clearly identifies them as the property of First Trade Global Not pledge, cede, or encumber the goods in any way First Trade Global shall have the right to: Enter the Customer’s premises to recover unpaid goods Cancel the sale and take possession of the goods without notice The Customer irrevocably grants permission for such access and recovery. 7. LIMITATION OF LIABILITY To the fullest extent permitted by law, First Trade Global (Pty) Ltd (Registration No. 2020/155029/07) shall not be liable for: Any indirect or consequential loss, including: Loss of profit Loss of business Loss of contracts Loss of goodwill Any damages arising from: Improper storage Handling by third parties Transport arranged by or on behalf of the Customer 8. NO CLAIM AFTER RESALE OR USE No claims of any nature shall be valid: After goods have been: Resold, Processed, or Used in any manner This includes claims relating to: Quality Packaging Shelf life Suitability 9. INDEMNITY The Customer hereby indemnifies and holds harmless First Trade Global (Pty) Ltd (Registration No. 2020/155029/07) from and against any and all claims, losses, damages, liabilities, costs, and expenses arising out of or in connection with the collection, transport, storage, handling, resale, or use of the goods after risk has passed to the Customer.
