GENERAL RELEASE AND LIABILITY WAIVER
Farm & Agribusiness Tour - July 16, 2026
This General Release and Liability Waiver (āAgreementā) is entered into by the undersignedĀ registrant (āParticipantā) in favor of Jackson County SWCD, its owners, officers, employees, agents, host sites, volunteers, affiliates, sponsors, representatives, and other participants (collectively, the āReleased Partiesā).
1. ACKNOWLEDGMENT OF RISKS
Participant understands and acknowledges that participation in a farm and agribusiness tour involves inherent risks, including but not limited to:
Possible interaction with farm animals and livestock;Ā Exposure to uneven terrain, mud, gravel, equipment areas, and natural hazards;Ā Operation or proximity to agricultural machinery and vehicles;Ā Weather conditions, insects, wildlife, allergens, dust, and agricultural materials;Ā Slips, trips, falls, or other personal injury risks common to farm environments; and Participant voluntarily chooses to participate despite known and unknown risks.
2. ASSUMPTION OF RISK
Participant knowingly and voluntarily assumes all risks, both foreseeable and unforeseeable, associated with participation in the farm tour, including risks that may result from the negligence of the Released Parties, to the fullest extent permitted by Alabama law.
3. RELEASE AND WAIVER OF LIABILITY
In consideration for being permitted to participate, Participant hereby releases, waives, discharges, and covenants not to sue the Released Parties from any and all claims, demands, causes of action, damages, losses, or liabilities, including personal injury, illness, death, or property damage arising out of or related to participation in the farm or agricultural business tour.
This release includes claims arising from the ordinary negligence of the Released Parties, except where prohibited by Alabama law.
4. ALABAMA AGRITOURISM NOTICE
Participant acknowledges the following notice pursuant to the Alabama Agritourism Liability Act:
WARNING:
Under Alabama law, there is no liability for an injury or death of a participant in an agritourism activity conducted at this agritourism location if such injury or death results from the inherent risks of the agritourism activity. Inherent risks include, among others, risks of injury inherent to land, equipment, and animals, as well as the potential for negligent acts of a participant that may contribute to injury.
Participant affirms understanding of this warning.
5. HEALTH & SAFETY REPRESENTATIONS
Participant certifies that:
- They are physically capable of participating in the tour.
- They will follow all written or spoken rules and staff instructions.
- They will supervise any minors under their care at all times.
- Participant agrees that failure to follow safety instructions may result in immediate removal from the premises or refraining from participating in remaining activities.Ā Closed-toe shoes are required for this tour. (Tennis shoes are appropriate.)Ā
6. MINOR PARTICIPANTS
If signing on behalf of a minor, the undersigned parent or legal guardian:
Understands tour is restricted to Ages 12 - 18 for minor participants accompanied by an adult parent, guardian or grandparent; Consents to the minorās participation;Ā Assumes all risks on behalf of the minor; and
Releases the Released Parties to the same extent as an adult participant.
7. MEDICAL AUTHORIZATION
In the rare occurence medical treatment is necessary, Participant authorizes the Released Parties to obtain emergency medical treatment, if necessary, and agrees to be financially responsible for any medical services rendered.
8. PHOTO & MEDIA RELEASEĀ
Participant grants permission for photographs or video taken during the tour to be used for promotional, educational, or marketing purposes without compensation.
9. INDEMNIFICATION
Participant agrees to indemnify and hold harmless the Released Parties from any claims brought by or on behalf of Participant or any minor arising from participation in the activity.
10. GOVERNING LAW
This Agreement shall be governed by and interpreted under the laws of the State of Alabama.
11. SEVERABILITY
If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
12. ACKNOWLEDGMENT OF UNDERSTANDING
Participant acknowledges that:
- They have read this Agreement carefully
- They understand its legal significance
- They are signing voluntarily, and
- This Agreement is intended to be as broad and inclusive as permitted under Alabama law.
