RAFFLE TERMS AND CONDITIONS – “Phelan Like a Ride” (NSW COMPLIANT)
1. Promoter
The promoter of this raffle is Phelan Like A Ride (“Promoter”), conducted on behalf of Phelan-McDermid Syndrome Foundation Australia Ltd (ABN 87 169 499 601) (“Beneficiary”), a registered Australian charity.

2. Eligibility Criteria
- Entry is open to residents of Australia aged 18 years and over.
- Foundation Directors of the Beneficiary and the Promoter, its volunteers, and those persons involved in conducting the prize draw are not eligible to enter, to ensure transparency and integrity of the draw.
- Entrants must comply with all applicable laws and regulations in their State or Territory, including any licensing requirements relevant to the prize.
3. Competition Period
- The raffle commences at 12:00pm (AEST) on 10 April 2026.
- The raffle closes at 7:00pm (AEST) on 24 April 2026, if ticket allocation is not exhausted prior.
- Entries received after this time or once tickets are sold out will not be accepted.
4. Entry Method
- Tickets must be purchased via the Promoter’s authorised sales channels.
- Ticket price: AUD $100 per ticket.
- Total number of tickets available: 500.
- Each ticket purchased constitutes one (1) entry into the draw.
- No limit on the number of entries per person, subject to availability.
- All entries must be fully paid prior to the draw to be valid.
- Tickets are non-refundable, except where required by law.
5. Prize Details
- The prize is a Honda NX500 motorcycle (RRP AUD $11,347).
- The prize is not transferable, exchangeable, or redeemable for cash.
- The winner is responsible for all additional costs associated with the prize, including but not limited to: Vehicle registration & transfer fees; Compulsory (CTP) insurance; Comprehensive Insurance; Licensing requirements.
- The prize must be taken as offered and is subject to availability.
6. Winner Selection
- The draw will take place at 8:00pm (AEST) on 24 April 2026.
- The draw will be conducted at a location determined by the Promoter within New South Wales.
- The winner will be selected by random draw from all valid entries.
- The draw will be conducted in accordance with the Charitable Fundraising Act 1991 (NSW) and associated regulations.
- The winner will be notified within 2 business days via phone and/or email.
- The winner’s name will be published on the Promoter’s website and/or social media within 7 days of the draw.
7. Permit / Authority Details
- This raffle is conducted under the Beneficiary’s NSW fundraising authority: CFN/26271.
- Under NSW law, a separate trade promotion or lottery permit is not required for charitable fundraising raffles conducted in accordance with the Charitable Fundraising Act 1991 (NSW) and Charitable Fundraising Regulation 2021 (NSW).
- Given the prize value ($11,347), this raffle is within the standard charitable gaming provisions and does not require an additional permit, provided all legislation requirements are met.
8. Unclaimed Prize Procedure
- The winner must claim the prize within 3 months of notification.
- If the prize is not claimed within this timeframe, a redraw will be conducted.
- The redraw will take place at the same location at 8:00pm (AEST) on 25 July 2026 (or the next business day if required).
- The redraw winner will be notified in the same manner as the original winner and published as required.
9. Privacy Information
- The Promoter and Beneficiary collect personal information (including name, phone number, and email address) for the purpose of conducting this raffle and contacting the winner.
- Personal information may also be used for marketing and promotional purposes unless the entrant opts out at the time of entry.
- All personal information is handled in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
10. Liability
- To the extent permitted by law, the Promoter and Beneficiary are not liable for any loss, damage, or injury suffered as a result of entering the raffle or accepting the prize.
- The Promoter is not responsible for late, lost, incomplete, or misdirected entries.
11. Compliance with NSW Laws
- This raffle is conducted in accordance with the Charitable Fundraising Act 1991 (NSW) & Charitable Fundraising Regulation 2021 (NSW)
- The Promoter will ensure all record-keeping, reporting, and conduct obligations are met as required by NSW Fair Trading.
12. General Conditions
- The Promoter reserves the right to verify the validity of entries and disqualify any entrant who tampers with the entry process.
- The Promoter reserves the right to cancel, suspend, or amend the raffle if necessary due to unforeseen circumstances beyond its control, subject to regulatory approval where required.
- By entering, participants agree to be bound by these Terms and Conditions.
