PLAYFORGE ATHLETICS PARTICIPATION WAIVER AND RELEASE OF LIABILITY
READ CAREFULLY — THIS IS A LEGAL DOCUMENT
By registering for or participating in PlayForge Athletics programs, I, the undersigned, as the parent or legal guardian of the minor participant(s) listed below, acknowledge and agree to the following:
1. Assumption of Risk
I understand that participation in athletic development programs involves physical activity that may result in injury, including but not limited to sprains, fractures, heat-related illnesses, concussions, or other serious bodily harm.
I knowingly and voluntarily assume all risks, whether known or unknown, foreseeable or unforeseeable, including those that may arise from the ordinary negligence of:
PlayForge Athletics, a sole proprietorship operated by Rheise Dobson, and J5 Athletic Facilities, LLC d/b/a J5 Athletics, along with their respective owners, officers, employees, contractors, volunteers, affiliates, and agents (collectively, the “Released Parties”).
2. Waiver and Release of Liability
In consideration of my child’s participation, I, on behalf of myself, my child, and our heirs, executors, and assigns, voluntarily release, waive, and discharge the Released Parties from any and all claims, demands, or causes of action arising from or related to participation in PlayForge Athletics programs.
This includes, but is not limited to, claims arising from the ordinary negligence of the Released Parties.
This release does not apply to claims arising from gross negligence, intentional misconduct, or willful acts by the Released Parties.
3. Medical Authorization
In the event of an injury or medical emergency, I authorize PlayForge Athletics staff to provide or obtain emergency medical treatment for my child.
I understand that I am solely responsible for any associated medical costs.
4. Indemnification
I agree to indemnify and hold harmless the Released Parties from any claims, demands, or legal actions brought by or on behalf of my child, or by third parties, arising out of or related to participation in the program.
5. Media Release
PlayForge Athletics may photograph or video participants during activities for use in promotional materials, including websites, social media, and flyers.
By signing below, I grant permission for my child’s image or likeness to be used without compensation or further notice.
If you do not consent, you must submit a written opt-out via email to PlayForgeAthletics@gmail.com
with your child’s full name. Verbal opt-outs or checkbox selections alone are not valid.
6. Acknowledgment of Minor Waiver Limits
I understand that the enforceability of this waiver as it applies to claims by or on behalf of my minor child may be subject to judicial review under Texas law.
7. Physical Condition and Participation
I certify that my child is physically able to participate in athletic activities and that I have disclosed any known medical conditions, injuries, or limitations.
I understand that PlayForge Athletics does not evaluate medical fitness and relies on my representations.
8. Rules and Conduct
I understand that participants are expected to follow all instructions and remain within designated training areas.
I understand that PlayForge Athletics may suspend or remove the Participant from an activity or session if staff determines, in their sole discretion, that participation presents a safety risk or disruptive behavior issue. No refund is required unless PlayForge Athletics chooses otherwise in writing.
9. Booking Cancellation Policy
We understand that plans can change. To best accommodate all clients, we have implemented the following cancellation policy:
Cancellations or rescheduling requests must be made at least 48 hours prior to your scheduled appointment time
If you cancel or reschedule at least 48 hours in advance, you will receive a full refund or credit toward a future booking
Cancellation requests made less than 48 hours before the booking will not be accepted
No-shows will be charged the full booking amount and are not eligible for a refund or credit
10. Severability
If any portion of this waiver is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
11. Governing Law
This waiver shall be governed by the laws of the State of Texas, and any legal action shall be brought exclusively in a court of competent jurisdiction within Texas.
12. Acknowledgment and Signature
I certify that I am the parent or legal guardian of the participant and that I have read and understand this agreement in full.
