LICENSE FOR USE OF FACILITIESTHIS LICENSE is issued this ____ day of ______________, 20___, by Clay Hollow, LLC (hereafter called “LLC”),4080 Middle Glading Road, Magnolia, MS 39652; to_____________________________________________________(hereinafter called “Licensee”)NAME_____________________________________________________________________________.LICENSEE’S ADDRESS,_____________________________________________________________________________TELEPHONE& EMAILFOR AND IN CONSIDERATION of the sum of $___________ and the terms and conditions of this License, subject to the terms,conditions, restrictions and rules herein, below, LLC grants to Licensee the right to use the facilities, equipment and land of LLC located at theabove-stated address, for the recreation activity of Sporting Clays and related recreational shooting as authorized by the LLC.Licensee’s use of the said facilities is limited to those days and times posted at the facility. Licensee shall provide his/her own weapon andammunition, which shall comply with the law and the rules of the LLC. Licensee shall abide by, observe and follow all rules and regulations ofthe LLC, which are posted on signs and otherwise available at the entrance to the facility and at each station. LLC reserves the right to change,amend and add to its rules and regulations. Use of the LLC’s facilities is limited to Sporting Clays and other recreational shooting asauthorized by the LLC, and to the path and shooting stations as designated by the LLC. Alcoholic beverages and illegal substances are notallowed at the facilities, and use of facilities while under the influence of alcohol or other impairing substance is prohibited.Licensees are allowed to bring guests to use the facilities provided each guest, upon each visit, signs and deposits with the LLC the Assumption of Risk, Hold Harmless and Release of Claims form provided by the LLC at its entrance. All guests of Licensee must abide by all rules and regulations of the LLC, and Licensee is responsible for the actions and inactions of Licensee’s guests. Licensee hereby agrees to release, indemnify and hold harmless the LLC from and against any and all claims, demands, damages, liabilities, expenses and fees, and all injuries, including death, caused by or to a Licensee’s guest.This License may be cancelled and terminated by the LLC, with or without cause, and in the event of such cancellation and termination, the LLC shall refund to Licensee that part of Licensee’s payment, prorated to the termination date.LICENSEE hereby acknowledges his/her understanding and acceptance of the following:a. I understand that serious risk of injury and death from the activities involved at the LLC are significant, including but not limited to the potential for permanent disability, paralysis and death, both to the shooter and to onlookers.b. I understand that serious hearing loss may result from being in the proximity of a discharging firearm, and Iack knowledge that the LLC has advised me to wear eye and ear protection.c. I knowingly and freely assume all risks, both known and unknown, even if arising from the negligence of the LLC or others, and I assume full responsibility for my participation in the activities at the LLC’s facilities. Risk, liability, injury or death caused by any LLC Owner, Member, employee, guest, invitee, Licensee, trespasser or agent are also assumed by me.d. If desired by me, I will provide my own transportation on the facilities course, which transportation will comply with the restrictions and requirements of the LLC. I will not allow anyone to operate a transportation vehicle on the premises of the LLC who is not a licensed driver or who is impaired by alcohol or other substance.e. I assume all risks and full responsibility for all food and beverages consumed on the LLC’s premises, and all actions that may occur after leaving the LLC’s premises.f. I certify that I have no pre-existing medical condition that would be aggravated or otherwise adversely affected by activities on the LLC’s premises.g. I acknowledge and understand that I am responsible for the actions and inactions of any guest that I bring to theLLC and for my guests abiding by all rules and regulations of the LLC, and in consideration of my use of the LLC’s facilities, I promise to release, hold harmless and indemnify the LLC from any and all claims, demands, damages, expenses, injuries and death of and to, and caused by or contributed to by, my guests.h. Further, in consideration of my use of the LLC’s facilities, I have voluntarily executed the attached Clay HollowLLC Waiver of Liability and Hold Harmless Agreement, which is and shall be considered a part of this License, the same as if copied completely herein, and which shall survive termination of License and remain in full force and effect after termination of this License for whatever reason.
