I, the undersigned participant, acknowledge that participation in any athletic, recreational, instructional, or competitive activities organized, hosted, instructed, or operated by Fierce Sports Performance, LLC (including but not limited to pickleball lessons, clinics, leagues, tournaments, camps, training sessions, fitness activities, and related events) involves inherent risks. These risks may include, but are not limited to, physical injury, illness, permanent disability, death, concussion, heat-related illness, dehydration, property damage, or other losses. I voluntarily choose to participate and fully assume all such risks, both known and unknown, even if arising from the negligence of the released parties, to the fullest extent permitted by law. In consideration of being allowed to participate, I hereby release, waive, discharge, and covenant not to sue Fierce Sports Performance, LLC, its owners, officers, directors, employees, independent contractors, coaches, volunteers, sponsors, partnering organizations, and facility owners from any and all claims, demands, causes of action, or liabilities arising out of or related to my participation. I agree to indemnify and hold harmless Fierce Sports Performance, LLC from any claims, damages, or liabilities arising from my actions or participation. I certify that I am physically and medically able to participate in these activities and that I have not been advised otherwise by a qualified medical professional. I understand that I am solely responsible for my own medical care and expenses. I grant permission to Fierce Sports Performance, LLC to seek emergency medical treatment on my behalf if necessary. I acknowledge that Fierce Sports Performance, LLC does not own, operate, or control the facilities used for activities and is not responsible for the condition of courts, playing surfaces, or premises. I also grant permission for Fierce Sports Performance, LLC to use photographs, video recordings, or other media taken during events for promotional, educational, or marketing purposes without compensation. This waiver applies to all registrations, online sign-ups, and participation in any Fierce Sports Performance, LLC activities. Electronic acknowledgment or registration shall constitute acceptance of this waiver. This waiver and release shall be governed by and interpreted in accordance with the laws of the State of Florida. If any portion of this agreement is found to be invalid, the remaining portions shall continue in full force and effect. By signing below, I acknowledge that I have carefully read this Waiver and Release of Liability, fully understand its contents, and sign it freely and voluntarily.
