    • Who is a member?

The legal definition of a member "of a not-for-profit organisation is someone who has satisfied the requirements of formal membership of the organisation".

Your group's Constitution will include further specific formal definitions of who qualifies as a member.

    • Does your group have member groups (that are separate legal entities)?*
    • Any group members of your group, that are independent legal entities, are not covered by Landcare NSW insurance cover unless they become members of Landcare NSW in their own right.

Landcare NSW member groups, that have their own member groups underneath them, are considered District Networks under the Landcare NSW Constitution, and do not have voting rights with Landcare NSW.

    • What are sub-committees?

A sub-committee is defined according to NSW Associations Law & Regulation.

It is governed and auspiced by the Committee of an incorporated association or other legal entity. A sub-committee is not a legal entity in its own right, and cannot hold an ABN or enter into a contract.

For sub-committees that identify as local Landcare Groups and are recognised as a Landcare Group by a Landcare group name/logo, the following applies:

      • They are eligible for membership with Landcare NSW
      • They are not automatically covered by your Landcare NSW insurance unless they have been nominated in this form and approved as a sub-committee by Landcare NSW
      • A $50 membership fee applies per sub-committee if your group wishes to extend your insurance to this sub-committee
    • Does your group have sub-committees (that are governed by your group and are NOT separate legal entities) that you would like covered under your insurance policy?*
    • Complete this form for each sub-committee listed above: https://form.jotform.com/LNSWjotform/landcare-groups-sub-committee

Please note, without complete information about each sub-committee we will not be able to appropriately provide insurance cover, and enable membership rights.

    • As a member group, you must appoint a Representative, who can represent your group at Landcare NSW's AGM, and vote on behalf of your group (if applicable).

      • A Representative may exercise any and all powers of the Landcare Member Group unless the appointment specifies otherwise.
      • The appointment may be made by reference to a volunteer position held.
      • An employee may not be appointed a member representative (this does not apply to group members defined under 5.3 (a) (C) in our constitution - e.g., external organisations that perform activities similar to those of a Landcare Group).

    • Is your Representative the same as your Primary Contact?*
    • Would you like to nominate an Alternate Representative (e.g., in case of absence of Representative)?*
