    CHARTER AGREEMENT & LIABILITY WAIVER

    1. ASSUMPTION OF RISK

    Participant acknowledges that boating and water-related activities involve inherent risks including, but not limited to: drowning, slips and falls, vessel movement, collisions, wakes, waves, tides, rapidly changing and unpredictable weather conditions, marine life, equipment malfunction, and the actions of other participants. This includes, without limitation, risks associated with docks, marinas, gangways, and boarding or disembarking the vessel. Participant voluntarily assumes all risks, known or unknown, foreseeable or unforeseeable, from the time of arrival at any meeting location through boarding, participation in the charter, and disembarkation, including, without limitation, any claims arising from the negligence (active or passive) of the company, to the fullest extent permitted by law.

    2. IN-WATER ACTIVITIES

    Participant understands that all swimming, floating, wading, sandbar activities, beach activities, and snorkeling are undertaken at their own risk. No lifeguard is on duty. The Company has no duty to supervise, monitor, or rescue participants in the water. Participant acknowledges that beach and sandbar environments may include uneven terrain, slippery surfaces, wildlife, and other natural hazards. Use of snorkeling equipment, including masks and snorkels, involves inherent risks including, but not limited to, breathing diGiculty, panic, water inhalation, and drowning. Equipment is provided as a convenience only, “as is,” without warranties, and no instruction or supervision is provided. Participant aGirms they are physically capable of participating in water activities or voluntarily choose to participate despite any limitations and assumes all associated risks.

    3. RELEASE OF LIABILITY

    Participant hereby releases, waives, discharges, and covenants not to sue Lei’d Back Charters and Salty Girl Enterprises LLC, including its owners, captains, crew, employees, and agents, from any and all liability, claims, or causes of action arising from participation in any aspect of the charter, including, without limitation, claims arising from negligence (active or passive), to the fullest extent permitted by law.

    4. INDEMNIFICATION

    Participant agrees to defend, indemnify, and hold harmless the Company from any claims, damages, losses, or expenses, including attorney’s fees, arising out of their participation or conduct.

    5. ALCOHOL & PERSONAL RESPONSIBILITY

    Participant acknowledges that alcohol consumption increases risk. Participant is solely responsible for their behavior and any consequences resulting from alcohol use. The Company assumes no liability for alcohol- related incidents.

    6. CAPTAIN AUTHORITY

    The captain has full authority over vessel operation, safety decisions, and passenger conduct. Failure to comply may result in termination of the charter without refund.

    7. THIRD-PARTY LOCATIONS

    Participant understands that stops may occur at locations not owned or controlled by the Company, including sandbars, beaches, marinas, restaurants, bars, and other establishments. Participant assumes all risks associated with such locations and agrees that the Company is not responsible for any incidents, injuries, or damages occurring at these locations.

    8. MEDICAL AUTHORIZATION

    Participant authorizes emergency medical treatment if necessary and agrees to be responsible for all associated costs.

    9. PERSONAL PROPERTY

    Participant is solely responsible for their personal belongings. The Company is not liable for lost, stolen, or damaged property.

    10. PHOTO & VIDEO RELEASE

    Participant grants permission to Lei’d Back Charters and Salty Girl Enterprises LLC to capture photographs and/or video during the charter and to use such media for marketing, advertising, and promotional purposes without compensation.

    11. LEGAL INTERPRETATION

    This agreement is intended to be as broad and inclusive as permitted by Florida law. If any portion is deemed invalid, the remainder shall remain in full force and eGect.

    12. ACKNOWLEDGMENT

    Participant certifies that they have read this agreement, fully understand its terms, and voluntarily agree to be bound by it.
