In consideration for my participation in The Runway Classic (collectively known as "Activity"), hosted by Genesis: Pathways to Success, Inc. and Greensburg Municipal Airport, I represent, covenant, and agree to the following:
1. COMMUNICABLE DISEASES. In participating in the Activity, I will agree to follow all local and event regulations and protocols and all public health and safety guidelines, and I fully recognize that Genesis: Pathways to Success and Greensburg Municipal Airport cannot protect me from becoming exposed to, contracting, spreading COVID-19, or ANY OTHER ILLNESS, while I do so.
2. RELEASE OF CLAIMS. I waive all claims against Genesis: Pathways to Success and Greensburg Municipal Airport and their volunteers, agents, staff, and Board of Directors for any injuries, illness, damages, liabilities, or losses, whether known or unknown, foreseen or unforeseen, which arise during, or as the result of, my participation in the Activity, regardless of whether or not caused in whole or, in part by the negligence or other fault of any of the Released Parties. I release and forever discharge Genesis: Pathways to Success and Greensburg Municipal Airport from any and all such claims.
3. INDEMNIFICATION. I agree to indemnify and hold Genesis: Pathways to Success and Greensburg Municipal Airport harmless from and against any and all losses, liabilities, damages, costs, or expenses (including but not limited to attorneys' fees and other costs of litigation) incurred through me as a result of any claims or suits that I (or anyone claiming by, under or through me) may bring against Genesis: Pathways to Success and Greensburg Municipal Airport to recover any losses, liabilities, costs, damages, or expenses that arise during or result from my participation in the activity, regardless of whether or not caused in whole or in part by the negligence or other fault of Genesis: Pathways to Success and Greensburg Municipal Airport.
4. PHOTOGRAPHY AND VIDEOGRAPHY RELEASE. I understand that I may be photographed or videotaped for publicity purposes, including, but not limited to, online social media such as Facebook, Instagram, X, and LinkedIn. I hereby grant Genesis: Pathways to Success and Greensburg Municipal Airport, and its partners, the absolute right to take, use, publish, and copyright any and all photographic and video images of me, or submitted by me, in whole or in part, in any and all media forms now or hereinafter known, and for any purpose whatsoever. I hereby waive any right I may have to inspect or approve the finished product(s) and any copy to which it may be applied or the use to which said photographs or images may be applied. I hereby forever release and discharge Genesis: Pathways to Success and Greensburg Municipal Airport from any and all liability associated with the taking, using, and publishing any and all photographic images.
5. VOLUNTARY PARTICIPATION. I understand that I am willingly participating in The Runway Classic or Activity at my own risk, at which I may be exposed to certain dangers, known and unknown.
6. COMPREHENSION AND ASSUMPTION OF RISK. I acknowledge that there are inherent risks, including but not limited to walking, running, jumping, or coming into contact with or being in the presence of others, by participating in the Activity. I hereby waive all claims against Genesis: Pathways to Success and Greensburg Municipal Airport for any injuries, illness, damages, liabilities, or losses, whether known, or unknown, foreseen or unforeseen, which arise during or result from my participation in the Activity, regardless of whether or not caused in whole or in part by the negligence or other fault of any of the Released Parties. I understand that I release and forever discharge Genesis: Pathways to Success and Greensburg Municipal Airport from all such claims.
7. VEHICLE AND PROPERTY DAMAGE. I acknowledge that the Activity involves the display, parking, and potential movement of vehicles and that there is a risk of damage to vehicles or personal property. I assume all risk of loss, theft, or damage to my vehicle or personal property occurring before, during, or after the Activity, including while entering or leaving the event premises. I release and hold harmless Genesis: Pathways to Success, Inc., Greensburg Municipal Airport, and all Released Parties from any liability for such loss or damage.
8. VEHICLE OPERATION. If I operate or move a vehicle during the Activity, I represent that I hold a valid driver’s license and will operate the vehicle in a safe and lawful manner. I agree to follow all instructions from event staff and airport personnel. I assume all risks associated with vehicle operation during the Activity.
9. INSURANCE. I understand that Genesis: Pathways to Success, Inc. and Greensburg Municipal Airport do not provide health, medical, automobile, or liability insurance coverage for participants. As a condition of entry into and participation in the The Runway Classic, I warrant that I have in effect automobile liability insurance covering each vehicle brought onto, displayed at, moved within, or operated in connection with the event premises with limits of not less than the minimum financial responsibility limits required under applicable Indiana law.
10. MEDICAL AUTHORIZATION. I understand that there is a limited or a lack of first aid operations or medical treatment during The Runway Classic. The undersigned authorizes Genesis: Pathways to Success and Greensburg Municipal Airport and its agents to perform any acts reasonably believed necessary or proper to provide or facilitate emergency medical care to me if, in the reasonable judgment of a Genesis on-site representative(s), I or another emergency contact cannot be reached before such care must be rendered. This consent and authorization includes, without limitation, medical procedures by physicians, dentists, hospitals, or other emergency medical personnel, as they, in the exercise of their sole discretion, may deem necessary. I understand and agree that I am responsible, jointly and severally with all signatories, for all costs and expenses of such medical treatment.
11. TRANSPORTATION. I acknowledge and agree that I am solely responsible for providing my own transportation to and from all The Runway Classic–related activities, events, and locations, including the final competition. Genesis: Pathways to Success and Greensburg Municipal Airport does not provide transportation and assumes no responsibility or liability for any transportation arrangements, delays, accidents, or incidents occurring during travel to or from any program-related Activity.
12. EVENT MODIFICATION AND CANCELLATION. Genesis: Pathways to Success, Inc. and Greensburg Municipal Airport reserve the right to modify, delay, relocate, or cancel the Activity due to weather, airport operational requirements, safety concerns, or other circumstances beyond their control.
13. CODE OF CONDUCT. I acknowledge that Genesis: Pathways to Success and Greensburg Municipal Airport are committed to providing a professional, safe, respectful, and inclusive environment for all participants, staff, judges, vendors, and community members involved in or attending The Runway Classic. I agree to conduct myself in a professional manner at all times and to support a positive Activity environment by acting with honesty and integrity; using appropriate, respectful, and non-discriminatory language and behavior; respecting the rights, perspectives, and property of others; and complying with all applicable policies, procedures, rules, and instructions communicated before or during any The Runway Classic–related Activity or event. I understand and agree that Genesis: Pathways to Success reserves the right to take appropriate action, including removal from the Activity, for conduct that Genesis: Pathways to Success determines, in its sole discretion, to be disruptive, unsafe, unethical, or inconsistent with the objectives or values of the program.
14. ACKNOWLEDGMENT OF UNDERSTANDING. I HAVE CAREFULLY READ AND REVIEWED THIS WAIVER OF LIABILITY AND PHOTO RELEASE AGREEMENT, AND I KNOWINGLY AND VOLUNTARILY ENTER INTO THE SAME.
15. APPLICABLE LAW. I acknowledge that this Agreement shall be governed by Indiana law and that any dispute or claim related to the subject matter hereof would be subject to the sole and exclusive jurisdiction of the courts of the competent authority in Ripley County, Indiana, with such courts to be the sole and exclusive venue for any such action.
16. SIGNATORIES. I understand that by electronically signing and submitting this Waiver of Liability, I am providing the legal equivalent of my handwritten signature on this document and affirming the truth of all information contained herein. I further affirm that I am authorized to sign this Waiver on behalf of myself, and that my electronic signature binds me to the terms of this Waiver.
17. BINDING EFFECT. This Agreement shall be binding upon and inure to the benefit of the Participant and their respective heirs, personal representatives, executors, administrators, successors, and permitted assigns.
