Waiver of Liability & Assumption of Risk Agreement

1. Acknowledgment of Risk
I understand and acknowledge that boarding, daycare, and interaction with other dogs and staff at the Bark Barn involves inherent risks. These risks include, but are not limited to:

• Dog bites, scratches, or injuries caused by other dogs
• Rough play or normal canine behavior resulting in injury
• Exposure to contagious illnesses, including but not limited to canine cough (kennel cough), parasites, or other communicable conditions
• Stress-related illness or behavioral changes
• Unpredictable reactions in a group environment
• Bolting and running away

I understand that even with appropriate supervision and care, not all incidents can be prevented. Scratches, nicks, etc may occur and may go unnoticed despite supervision.

2. Assumption of Risk
I knowingly and voluntarily assume all risks associated with my dog’s participation in services at the Bark Barn, including risks that may result from:

• Interactions with other dogs
• Group or individual play
• Handling by staff
• Use of equipment, play yards, or boarding areas

I accept that these risks may result in injury, illness, or in rare cases death.

3. Vaccination Requirements
I understand that all dogs boarding at The Bark Barn must provide proof that required vaccinations were administered at least five days prior to their stay. The following vaccines are required: Rabies, Bordetella, Distemper, Hepatitis, Parvovirus, Parainfluenza, Leptospirosis.

4. Health & Sudden Medical Events
I certify that my dog is in good health, current on required vaccinations, and free from known contagious conditions. I understand and acknowledge that:

• Dogs, like humans, may experience sudden and unexpected medical events
• Conditions such as bloat (gastric torsion), heart failure, seizures, or sudden death can occur without warning - even in healthy dogs
• Exposure to fleas, ticks, or parasites can happen despite preventative measures
• These events may occur regardless of the level of care or supervision provided

I agree that the Bark Barn cannot be held responsible for such unforeseen medical incidents.

5. Right to Refuse/Remove Dog
I understand the Bark Barn has the right to remove a dog from group play, isolate them, or require immediate pickup. The Bark Barn may refuse and/or ban a dog from returning to the facility for any reason.

6. Payment Responsibility/Abandonment
I understand and agree that I am responsible for all boarding fees and that failure to pick up my dog may result in additional charges or further action.

7. Release of Liability
To the fullest extent permitted under Texas law, I hereby release, waive, and discharge the Bark Barn, its owner, employees, contractors, and representatives from any liability, claims, demands, or causes of action arising out of or related to:

• Injury, illness, or death of my dog
• Loss or damage to personal property
• Any incident occurring during my dog’s stay

This release includes claims arising from ordinary negligence but does not apply to gross negligence or willful misconduct.

8. Veterinary Care & Emergency Authorization
In the event of illness, injury, or emergency, I authorize the Bark Barn to:

• Seek veterinary care for my dog
• Transport my dog to a veterinarian or emergency clinic

I understand that reasonable efforts will be made to contact me or my emergency contact. If I cannot be reached, care will be sought at staff discretion. I agree to be fully responsible for all costs incurred, including veterinary treatment, medications, and transportation.

9. Group Environment & Behavior
I acknowledge that my dog will be in a social and group environment (unless otherwise arranged), and dogs may interact freely under supervision. Minor injuries (scratches, nicks, etc.) may occur and may not always be immediately noticed. I affirm that my dog has no history of dangerous or aggressive behavior that has not been disclosed and is suitable for a boarding/group environment.

10. Personal Property
I understand that any personal items sent with my dog (beds, blankets, toys, etc.) may become damaged, soiled or lost and will not be laundered or repaired by the Bark Barn. The Bark Barn is not responsible for damage or loss of personal items.

11. Agreement to Terms & Conditions
I acknowledge that I have received, read and agree to follow the Bark Barn Terms & Conditions. In the event of a conflict, this Waiver of Liability shall control with respect to risk allocation and legal responsibility.

12. Indemnification
I agree to indemnify and hold harmless the Bark Barn from any claims, damages, or expenses (including attorney’s fees) arising from my dog’s actions or any harm caused by my dog to other dogs, people, or property.

13. Photo/Video Release
I give permission to the Bark Barn to use photos/videos of my dog for marketing and social media.

14. Governing Law
This agreement shall be governed by and interpreted in accordance with the laws of the State of Texas. Any legal action must be brought in Madison county TX.

15. Acknowledgement & Signature
By signing below, I acknowledge that I have read and understand this agreement in full, have had the opportunity to ask questions, and voluntarily agree to all terms.
