THIS IS A RELEASE OF LIABILITYAND A WAIVER OF YOUR RIGHTS
In consideration of my admission to the Los Alamos Tuff Riders and/or for participation in any the activities organized by the Los Alamos Tuff Riders, I agree to the following:
I understand that mountain biking is a hazardous activity, and that injuries can and do occur. Hazards include falling, impact with rocks, trees, other stationary objects, and other riders. Some sections of trails may be beyond my skill level, and I accept sole responsibility for deciding whether to ride any trail, or section of trail. Walking a difficult section of a trail is always an option. Helmets are required on club rides, and other personal protective equipment may be worn at my discretion. I understand and accept the inherent dangers in this sport, including the risk of personal injuries, including PARALYSIS and DEATH. I WILLFULLY AGREE TO PARTICIPATE IN THIS SPORTS AND TRIPS AT MY OWN RISK.
I understand that maintenance of my bicycle is solely my responsibility. The Los Alamos Tuff Riders does not maintain or repair bicycles, and while other participants may offer advice and/or assistance, I understand that ensuring my bicycle is properly maintained is ultimately my responsibility.
I understand that other hazards of this sport include traveling to remote destinations, injuries that may occur during trail maintenance, and encounters with wildlife that includes snakes, deer, elk, coyotes, bears, and mountain lions. I agree that I alone am responsible for deciding whether to participate in this inherently risky sport and/or trips. I understand that there are more hazards than are enumerated here, and that there are unknown and unforeseeable hazards.
Some rides are in remote locations, and I understand that medical treatment may not be immediately available if I am injured on a Los Alamos Tuff Riders trip.
I therefore, for myself, my heirs, successors, representatives, and anyone else who might have a claim by reason of my injury or death, hereby KNOWINGLY AND INTENTIONALLY WAIVE AND RELEASE FROM LIABILITY, and AGREE TO INDEMNIFY, HOLD HARMLESS, and DEFEND Tuff Riders, its directors, officers, agents, volunteers, sponsors and their estates, from any and all liability for any and all such damage, injury, paralysis, or death to myself or any other person or to property. I explicitly agree that this release and indemnification extends to harm resulting from any NEGLIGENCE of the parties released or any party released.
If I violate the terms of this contract and sue any party released, that party shall be entitled to recover his/her expenses, including attorneys’ fees, from me.
This contract is severable; that is, if any part of it is held by a court of law to be unenforceable, the rest of it shall nevertheless be effective.
