PARENT PARTICIPATION: Parent participation is vital to the function of the club and is expected and appreciated. If your child participates in a meet, you will be expected to work a shift at that meet. Especially at Time Trials, every swimmer must have a parent work. Please note: If you are unable to work your shift, it is your responsibility to find a replacement, not the scheduler.
RELEASE FROM LIABILITY: Should the parent/guardian or the swimmer suffer any injury arising from being a member of or participating with Tustin Dolphins, or USA Swimming, we hereby and in advance waive, release, and forever discharge any and all rights of claims for damages which the swimmer or the parent/guardian may possess against Tustin Dolphins, its staff, officers, directors, agents and representatives. This release shall be binding on the swimmer, his parents, and their heirs, executors/administrators, agents and assigns.
MEDICAL AUTHORIZATION: Pursuant to Civil Code 25.8, the parent/guardian authorizes to any coach or officer of Tustin Dolphins to arrange for medical and dental care and to give oral or written consent on my behalf for medical and dental treatment including surgery by a licensed physician. The parent/guardian agrees to be responsible for all such charges. If your child suffers from any medical condition or allergies, you must notify the Dolphins Board in writing before he/she can practice.
USA SWIMMING: All swimmers must be members of USA Swimming to swim with Tustin Dolphins.

I hereby acknowledge that the Tustin Dolphins Swim Team ("Dolphins") is not owned, endorsed, sponsored,maintained, or operated by the Tustin Meadows Community Association, A California Non-Profit mutual benefit corporation ("Association"); that Dolphins is legally independent, separate and distinct from the Association; that it is currently fully sponsored, operated and maintained by Dolphins. I also acknowledge that Dolphins is not employed by or affiliated with Association and is funded solely by payments from the parents of the participating minor children
to Dolphins and through fundraising events; that the Association only provides Dolphins with the use of its East Pool, East Clubhouse, related facilities and equipment in conjunction with the Dolphins practice sessions, Swim Meets,and other activities conducted at the Association's facilities ("Activities").
I hereby agree to bear the complete risk for any injury or death suffered by myself, my family members, and by the Minor Children arising out of or resulting from the use, occupancy, or operation of the Association's facilities and equipment by myself, my guests, family members, and by the Minor Children as members of Dolphins, or while participating in any of the Activities, recreational sessions of Dolphins or in individual swim lessons, and to accept the complete risk for personal injuries or property damage suffered by said Minor Children and myself while in/on the Association clubhouse or facilities while using the facilities in conjunction with Dolphins.
I hereby also agree that I, my heirs, executors and administrators will not make any claim against, sue, file any legal action, attach the property of, or prosecute the Association, its directors, officers, employees, insurance carriers, insurance policies, agents, representatives and attorneys, for injury, death or damage resulting to said Minor Children, myself, my guests or family members caused by the negligence or other acts of the Association, its directors, officers, employees, agents, representatives and attorneys, and occurring during the use of the facilities by the Minor Children, myself or family members in conjunction with Dolphins.
Further, I agree to release the Association, its directors, officers, employees, agents, insurance carriers, insurance policies, representatives, and attorneys from any and all claims, demands, costs, loss, damage and liability for injury or death to said Minor Children, myself, my guests, and/or family members resulting directly or indirectly from the minors use of the Association's facilities and equipment, or at other locations, as members of Dolphins, and whether or not resulting from the negligence or other acts, howsoever caused, of any director, officer, employee, agent, representative or contractor of the Association.
I assume any and all risk for the conduct and welfare of said Minor Children, myself, my guest, and/or family members while in conjunction with their participation in any of the Activities or recreational sessions of Dolphins. I AM AWARE THAT USE OF THE ASSOCIATION FACILITIES MAY LEAD TO PERSONAL INJURIES OR DEATH.THE MINOR CHILDREN VOLUNTARILY PARTICIPATE IN THESE ACTIVITIES WITH KNOWLEDGE OF THEDANGERS INVOLVED. Further, I am fully aware of each and every one of the patent risks and hazards inherent in using the clubhouse, pool or recreational facilities at Association and hereby expressly acknowledge and affirm that I understand that by participating in the activity or recreational sessions that the Minor Children, my family members, my guests and myself risk the possibility of severe or life threatening personal injury, death, illness, brain damage, oxygen deprivation, drowning, play-related injury or illness, exposure to various chemicals, materials and property damage. I am fully aware of, and understand thoroughly such risks, and elect that the Minor Children, myself, my guests, and/or my family members may voluntarily engage in such activities and I agree to assume all risks of loss, damage, death and injury that may be sustained by said Minor Children, my guests, family members and myself while in the Association Pool, Clubhouse or related premises and facilities, while using the facilities in conjunction with Dolphins.
I also understand that the insurance carried by Dolphins may not be sufficient and may not cover, and that the Associations insurance policies will not cover, or pay for any injury, illness, death or damage which the Minor Children, myself, my guests and/or family members may incur as a result or not as a result of the Minor Children's', my participation, my guests participation, my family's participation in any of the Dolphins Activities.
I also understand that if I/we participate or engage in any fundraisers or other activities to benefit or on behalf of Dolphins, or engage or participate in any preparatory or cleanup activities at any time, that the same releases stated above will also apply to me/us during that time period.
This consent, agreement, release and authorization shall be valid and continue in effect until such time as I have provided written notice to the Association of my termination of it or until the end of the current swim season (August 31, 2026), whichever occurs first.
The foregoing representations and agreements are made for the benefit of the Association only, and may not be relied upon by any third party, including Dolphins for any purpose.

LIABILITY RELEASE AND INDEMNIFICATION FORM
I, the undersigned participant and parent, request voluntary participation for minor to participate in all events, which are hereinafter referred to as the "activities." sponsored by TMCA, Tustin Dolphins Club, USA Swimming and its local swimming committees. This agreement is valid while the participant is a member of USA Swimming.
I consent to my/minor's participation in the activities and acknowledge that the minor and I fully understand my/minor's participation may involve risk of serious injury or death, including losses which may result not only from my/minor's own actions, inaction or negligence, but also from the actions, inaction, or negligence of others, the condition of the facilities, equipment, or areas where the event or activity is being conducted, and/or the rules of play of this type of event or activity. I understand that if I have any risk concerns, I should discuss the risks associated with my participation with the activity coordinators and event staff, before I sign this document and before any activities begins.
Release - Minor's Rights:
In consideration of allowing Minor Participant to participate in the activities, I hereby release and hold harmless TMCA, Tustin Dolphins Club, USA Swimming and its local swimming committee and their members of its board of directors, officers, employees, volunteers, other participants, and agents (collectively, the "Released Parties"), of and from, and do discharge and waive, any and all claims, demands, losses, damages, and liabilities that Minor Participant may have or sustain with respect to any and all damage and/or injury, of any type, arising out of his or her participating in the activities. I also agree that if any portion of this agreement is held to be invalid the balance, notwithstanding, shall continue in full force and effect.

Indemnification by Parent/Guardian:
The undersigned parent/guardian further agrees to indemnify, save and hold harmless the Released Parties from any and all claims, demands, losses, damages and liabilities for indemnities, contribution or otherwise with respect to any damage and/or injury, of any type, arising from Minor Participant's participation in the activities. The undersigned also agrees that this Release and Waiver of Liability, Assumption of Risk and Indemnity Agreement extends to all acts of negligence by the Releasee and is intended to be as broad and inclusive as is permitted by the laws of the State in which the Event(s) is/are conducted and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
