DOG TRIBE ACADEMY LLC / CHICAGO PET SERVICES, INC.
LIABILITY WAIVER, ASSUMPTION OF RISK, RELEASE OF CLAIMS, AND INDEMNITY AGREEMENT
This Liability Waiver, Assumption of Risk, Release of Claims, and Indemnity Agreement (“Agreement”) is entered into by the undersigned participant (“Participant”) in favor of Dog Tribe Academy LLC, Chicago Pet Services, Inc., and each of their respective owners, officers, directors, members, managers, employees, contractors, agents, instructors, trainers, affiliates, successors, and assigns (collectively, the “Released Parties”).

1. Purpose
Participant desires to participate in educational, training, observational, practical, handling, kennel, classroom, workshop, sport, boarding, travel, lodging, and other related activities offered, hosted, supervised, or organized by Dog Tribe Academy LLC and/or Chicago Pet Services, Inc. (collectively, the “Activities”).

Participant understands that the Activities may take place on company property, third-party property, lodging sites, training fields, indoor facilities, outdoor grounds, event sites, vehicles, and other related locations.

2. Acknowledgment of Inherent Risks
Participant understands, acknowledges, and agrees that participation in the Activities involves inherent risks, known and unknown, which may result in bodily injury, illness, emotional distress, property damage, permanent disability, or death.

These risks may include, but are not limited to:

• dog bites, scratches, jumping, lunging, pulling, collisions, or other dog-related contact
• exposure to aggressive, fearful, reactive, untrained, young, or high-drive dogs
  slips, trips, falls, uneven terrain, mud, gravel, concrete, stairs, equipment, obstacles, or weather-related hazards
• exposure to cleaning chemicals, pet waste, allergens, hair, dander, saliva, and zoonotic illness
• use of leashes, long lines, crates, tethers, kennels, muzzles, vehicles, gates, and training tools
• physical exertion, lifting, restraint, handling, and repetitive movement
• participation in demonstrations, decoy work, sport work, field exercises, and other practical applications
• risks associated with group settings, shared housing, travel, transportation, and third-party premises
• negligent acts or omissions of other participants, dog owners, visitors, vendors, or third parties.

Participant understands that working with dogs and participating in dog trainingenvironments carries a heightened risk of injury, and Participant voluntarily accepts and assumes all such risks.

3. Voluntary Participation
Participant acknowledges that participation in the Activities is voluntary. Participant affirms that they are physically, mentally, and emotionally able to participate safely and responsibly, and that they will immediately inform Dog Tribe Academy LLC and/or Chicago Pet Services, Inc. of any medical condition, limitation, injury, or concern that may affect participation.

4. Agreement to Follow Rules and Instructions
Participant agrees to comply with all policies, rules, safety protocols, handling instructions, housing rules, and directions given by instructors, staff, or representatives of the Released Parties.

Participant understands that failure to follow instructions, safety requirements, or operational standards may result in immediate removal from an activity, class, housing, campus, or program without refund, where applicable.

5. Release and Waiver of Liability
To the fullest extent permitted by law, Participant, on behalf of themselves and their heirs, family members, executors, administrators, legal representatives, and assigns, hereby waives, releases, acquits, and forever discharges the Released Parties from any and all claims, demands, causes of action, liabilities, damages, losses, costs, and expenses of any kind, whether known or unknown, foreseen or unforeseen, arising out of or related to Participant’s participation in the Activities, including but not limited to claims involving:

• personal injury
• bodily injury
• illness or disease
• property loss or damage
• emotional distress
• disability
• death

This release applies to claims arising from ordinary negligence of the Released Parties, to the fullest extent permitted by applicable law.

6. Indemnification and Hold Harmless
Participant agrees to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

• Participant’s acts or omissions
• Participant’s violation of policies or instructions
• Participant’s negligent, reckless, or intentional conduct
• injury or damage caused by Participant to any person, dog, or property

Participant’s breach of this Agreement

7. Medical Treatment Authorization
In the event of an injury, illness, or emergency, Participant authorizes Dog Tribe Academy LLC, Chicago Pet Services, Inc., and their representatives to seek medical care on Participant’s behalf if Participant is unable to do so.

Participant understands and agrees that the Released Parties are not obligated to provide medical treatment, insurance coverage, or reimbursement for any medical expenses. Participant accepts full responsibility for all medical costs and related expenses incurred.

8. No Guarantees
Participant understands that Dog Tribe Academy LLC and Chicago Pet Services, Inc. make no promises, guarantees, or warranties regarding educational outcomes, certifications, employment, placement, business success, training success, handling ability, or future opportunities resulting from participation in the Activities.

9. Personal Property
Participant understands that the Released Parties are not responsible for loss, theft, or damage to Participant’s personal property, including luggage, vehicles, electronics, tools, training equipment, and other belongings brought onto the premises or used during the Activities.

10. Photo, Video, and Media Release
Participant grants Dog Tribe Academy LLC and Chicago Pet Services, Inc. the irrevocable right and permission to photograph, film, record, and otherwise capture Participant’s name, voice, likeness, image, and participation during the Activities.

Participant authorizes the Released Parties to use such materials for educational, training, promotional, advertising, marketing, internal, and commercial purposes, in any media now known or later developed, without further approval, compensation, or notice.

Participant waives any right to inspect or approve the final use of such materials.

11. Housing, Travel, and Off-Site Activities
If Participant utilizes on-campus housing, shared accommodations, transportation, or participates in off-site activities, Participant acknowledges that such participation creates additional risks. Participant voluntarily assumes those risks and agrees that the release, waiver, and indemnity provisions in this Agreement apply equally to those circumstances.

12. Illinois Law and Venue
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Illinois, without regard to conflict of law principles.

Any dispute arising out of or related to this Agreement or the Activities shall be brought exclusively in a court of competent jurisdiction located in Cook County, Illinois, unless another venue is required by law.

13. Severability
If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

14. Binding Effect
This Agreement shall be binding upon Participant and Participant’s heirs, next of kin, family members, executors, administrators, legal representatives, and assigns.

15. Acknowledgment of Understanding
Participant acknowledges that they have carefully read this Agreement, fully understand its contents, understand that they are giving up substantial legal rights by signing it, and sign it freely and voluntarily without inducement.

Participant further acknowledges that they have had the opportunity to ask questions and seek independent legal advice before signing.
