Contract Agreement

Being a volunteer with Kitty Whispers Haven, Inc. involves some risk of injury and illness. Injuries include, but are not limited to, those caused by slips and falls, cat scratches and cat bites. Cat bites (and severe scratches) may cause infections. Illnesses include, but not limited to are gardia, toxoplasmosis, scabies, parasitic or fungal conditions such as ringworm. Without proper sanitation you could spread illnesses to the foster, foster's personal pets, or other resident's who interact with the foster animals. By signing below, you understand and accept the risk and agree to that Kitty Whispers Haven, Inc. will not be liable for damage, injury or illness sustained while fostering, volunteering, transporting, trapping cats for TNVR or in any capacity.

• I agree to provide a Kitty Whispers Haven, Inc. representative access to all parts of my home and property for a home inspection before my application to foster is approved.

• I understand that I may be required to provide foster care to my foster animal for an extended period of time.

• I agree that I am over 21 years of age.

• I understand that Kitty Whispers Haven, Inc. provides no guarantee as to the health of my foster animal and that my foster animal may have medical needs, socialization problems.

• I agree to provide my foster animal with veterinary care as authorized by Kitty Whispers Haven, Inc. I will not arrange or pay for any elective veterinary care for my foster animal without the expressed consent of an authorized Kitty Whispers Haven, Inc. representative.

• I understand that I may only have my foster animal temporarily.

• I agree that I am fostering this animal for Kitty Whispers Haven, Inc., and that I do not have any right of ownership over my foster animal. I agree to provide Kitty Whispers Haven, Inc. representative(s) access to my home and property to check on my foster animal, at any time that I am in possession of my foster animal.

• I agree to immediately return any foster animal in my care to Kitty Whispers Haven, Inc. at the request of its authorized representative(s) at any time and for any reason. If Kitty Whispers Haven, Inc. is forced to undertake legal action to enforce this provision of the agreement, I agree to indemnify Kitty Whispers Haven, Inc. for all court costs and attorneys fees connected with such an action.

• I understand that I will be expected to keep the cat/kitten secure and indoors only, return it to Kitty Whispers Haven, Inc. when requested to do so; and not promise the animal to anyone, or imply that I have authority to approve a potential adoption.

•I understand that all veterinary visits must be to vets that are endorsed by Kitty Whispers Haven, Inc.. and must be approved in advance by the president. Likewise, all medical expenses must be authorized for payment in advance by one of the board members. I understand that medical expenses not approved in advance are the sole responsibility of the foster caregiver (me). This includes regular wellness visits, emergency hospitals and medical visits. I understand all adoption and medical decisions regarding the foster cat or kitten in my care will be made by Kitty Whispers Haven, Inc..

• I understand that I will pay any just and reasonable amount to cover costs and expenses accrued by Kitty Whispers Haven, Inc. in securing the safe return of a foster cat or kitten that was in my care, if it is determined I gave or adopted it to someone without prior approval of Kitty Whispers Haven, Inc.

• If I am planning to move at any time during the period when I am housing a foster animal, I agree to contact Kitty Whispers Haven, Inc. prior to my move and provide Kitty Whispers Haven, Inc. with my new contact information. I understand that Kitty Whispers Haven, Inc. has the right to request return of my foster animal based on my change of residence, and agree that I will surrender my foster animal to Kitty Whispers Haven, Inc. immediately upon request.

• I understand that as long as I provide foster care to my foster animal to Kitty Whispers Haven, Inc. satisfaction, I will be given the first right of adoption of my foster animal, at such time as Kitty Whispers Haven, Inc. decides to place my foster animal for adoption. However, after 2 adoptions Kitty Whispers Haven, Inc. has the right to terminate the fostering agreement if we feel necessary.

• If at any point I can no longer, or do not want to continue to, provide care and shelter for my foster animal, I agree to contact Kitty Whispers Haven, Inc. and arrange for surrender and return of my foster animal back to Kitty Whispers Haven, Inc. with proper notice of at minimum of 5 days.

• I will not transfer possession or custody of my foster animal to any other person at any time, except for temporary, short-term possession for the purpose of vet care, grooming, etc.

• I agree to contact Kitty Whispers Haven, Inc. with any and all questions or concerns about my foster animal or the Foster Care Program as well as with updated contact information.

• I agree that if I refuse or fail to comply with any provision of this agreement, Kitty Whispers Haven, Inc. has the right to terminate this agreement and also has the right to the immediate surrender and return of my foster animal(s). I further consent to provide Kitty Whispers Haven, Inc. access to my premises if necessary to facilitate the return.

• I agree that the opportunity given to me to help rehabilitate my foster animal, as well as the chance of a potential future adoption is of significant benefit to me, and serves as proper legal consideration in exchange for my agreement to the terms of this contract. I have read this application and Agreement in its entirety, and I agree that all statements and agreements contained in this document are made by me and are truthful, under penalty of perjury under the laws of the State of Florida.

I understand that applying does not ensure approval and that untruthful answers or failure to comply with the requirements of this application can result in the forfeiture of any of Kitty Whispers Haven, Inc. animal fostered by me.

I certify that the above information is correct, and I understand that the information will be verified.

I understand that by submitting this form electronically, I agree to release and covenant to hold harmless Kitty Whispers Haven, I and it's members from any claims, damages, costs, or actions incurred because of the care or actions of the foster cat.

I accept full responsibility for the cat(s) actions at all times, and release Kitty Whispers Haven, Inc. from any liabilities or damages that may be incurred because of fostering such cat(s).
