The Grand Prairie Master Community, Inc. Facility Use Agreement

Terms used but not defined in this policy will have the meaning ascribed to such terms in that certain The Grand Prairie Master Covenant recorded in the Official Public Records of Harris County, Texas, as the same may be amended from time to time (the "Covenant").

These Use Guidelines are established to preserve the recreation facilities of the Association for the convenience and enjoyment of Facility Users and apply to and are enforced equally against all Facility Users. While all Facility Users are entitled to enjoy the lakes, pool, pickleball court and other common amenities of The Grand Prairie (collectively, the "Facilities"), they must do so while respecting the rights of others using the Facilities, and should be courteous and demonstrate common sense when using the Facilities.

All use of Facilities and participation in Association programs is purely voluntary. The recreational nature of all Association activities and programs potentially involves some personal or physical risk on the part of the participant. Program participation by a Facility User is therefore interpreted as tacit acknowledgement and acceptance of the inherent risks. Injuries, accidents or other serious incidents should be immediately reported to the Manager for an incident report to be completed and any needed action to be taken.

Facility Users, by mere use of the Facilities, have agreed the Association, the Manager, the Board, and the Declarant, and their respective owners, managers, directors, officers, representatives, agents and employees, are not liable for bodily injury, personal injury or inconvenience sustained during the use of the Facilities and any programs presented therein. Further, the Association, the Manager, the Board, and the Declarant, and their respective owners, managers, directors, officers, representatives, agents, and employees, are not responsible for the loss of any personal belongings of any Facility User, vendor, staff member or visitor to any Facilities. In ensuring that Facility Users are provided with a safe and enjoyable experience while using the Facilities, these reasonably comprehensive Use Guidelines and signage have been developed.

Prior to participating in any Association activity or program, Facility Users are encouraged to familiarize themselves with the layout of the Facilities and these Use Guidelines.

The authority granted to the Board to adopt these Use Guidelines is provided in the Documents. These Use Guidelines shall be binding upon all Facility Users. In addition, the Documents provide the Board the means to ensure compliance of these Use Guidelines the following rights for violations or abuse of these Use Guidelines:

The right of the Board to levy reasonable monetary fines.
The right to suspend a Facility User's right to use any of the Facilities.

Memberships that May Be Transferred: If an Owner leases his/her Lot, the Owner may transfer The Grand Prairie Full Membership. Upon the transfer of the membership to an Occupant, the Owner relinquishes all membership rights and privileges for the duration of the transfer. No membership transfer will be valid or recognized until the Owner provides to the Association a true copy of the lease agreement, all required contact information for the Occupant, and a written statement that the Owner desires to transfer his/her membership to the Occupant. An Owner who has transferred his/her membership to an Occupant may rescind the transfer at any time. Provided that, no rescission of the transfer of a membership will be recognized by the Association until the Owner notifies the Association in writing; the written notice to the Association must include a statement that the Owner has notified the Occupant that the transfer of the membership is being rescinded.

The Grand Prairie Full Membership may be suspended during a period in which an Owner is not in good standing with the Association, or due to serious misconduct. The Association may refuse to issue One Day Guest Memberships for an Owner during a period in which the Owner is not in good standing with the Association. A person is not in good standing with the Association if that person: (a) remains delinquent in the payment of annual assessments thirty (30) days after receiving written notice of the delinquency from the Association, (b) is delinquent in the payment of a fine levied by the Association, (c) has an unresolved violation, or (d) is determined to have provided false information to the Association in connection with an application for membership. If membership privileges are suspended for a reason set forth in (a), (b) or (c), above, the membership privileges will not be restored until the condition causing the suspension is resolved.

1. Facility Users shall abide by the Documents and all other Rules posted in respective areas.
2. Facility Users shall conduct themselves in a courteous and respectful manner at all times; refrain from any verbal harassment of any other Facility User, Manager, volunteer, vendor, etc.; shall obey all safety rules, and not compromise the safety of others by their actions. Actions that jeopardize or interfere with the safety, rights and privileges of others, use of profanity, abusive or disruptive behavior, etc. may result in loss of privileges to Use the Facilities.
3. Facility Users use the Facilities and Common Area at their own risk. The Association, the Board, the Manager and/or the Declarant, and their respective assigns, owners, managers, directors, officers, representatives, agents and employees, are not liable for any personal or accidental injury, damage, and/or loss or theft of property, occurring in or around the Facilities or Common Area.
4. The Facilities and Common Area are open to all Owners, Occupants and their guests, and may not be used for any commercial, or religious purpose without the prior written approval of the Association.
5. Owners and Occupants must accompany their guests at all times when visiting the Facilities or Common Area. Children must be supervised by an adult eighteen (18) years of age or older.
6. Owners and Occupants may not post notices or advertisements of any kind at any of the Facilities or Common Area without the prior written approval of the Association.
7. Use of the Facilities and Common Area are subject to the Declarant's promotions for the sales and marketing of homes during the Development Period, free of charge.
8. Owners, Occupants and their guests shall respect, protect and preserve the property, furniture, furnishings and equipment of the Facilities and Common Area. Each Owner and Occupant is strictly liable for any damage to any property of the Association caused by the Owner or Occupant, their family or guests, including any and all expenses, collection costs, charges and attorneys' fees incurred to repair the damage or replace the property. Furniture, furnishings, decorations, equipment, etc. shall not be removed from their respective locations unless otherwise stated in these Use Guidelines.
9. When using photographic equipment of any kind, Owners, Occupants and their guests should take care not to include in the photo or video any person who has expressed a wish not to be included. Use of photographic equipment of any kind is not permitted inside the restrooms.
10. Facility Users are permitted entry and access for specific authorized uses. For example, a user who is otherwise authorized to enter the pickleball courts and use the area shall not use the pickleball courts for any other purpose (e.g., using the pickleball courts as a place to lounge without actively using the facilities for their intended purposes).

1. No vehicle may be parked overnight in any common area, including parking lots and spaces adjacent to any public or private lake.
2. Recreational vehicles (RVs) are strictly prohibited from being parked or stored in common areas or near any public or private lake at any time.
3. Temporary parking of RVs for loading or unloading purposes is permitted for a maximum of one (1) hour, provided prior notice if given to the Manager.
4. Rigs, including, but not limited to, commercial vehicles, semi-trucks and similar oversized vehicles are strictly prohibited from being parked or stored in common areas or near any public or private lake at any time.
5. Trailers, including but not limited to, utility trailers, boat trailers and any other non-motorized vehicles designated to be towed are strictly prohibited from being parked or stored in common areas or near any public or private lake at any time.

The swimming pools and pool area are private Facilities (collectively, the "Pool"), and to be used by Owners, Occupants and their guests only. Use of the Pool is at the Facility User's risk. Lifeguards are not provided unless otherwise stated. Facility Users are strongly encouraged not to utilize the Pool alone.

1. Pool hours are as posted on signage on the perimeter of the Pool. The Association reserves the right to close the Pool as needed. Use of the Pool after hours is strictly prohibited and can result in the revocation of an Owner's or Occupant's Access Pass.
2. Guests must be accompanied by an Owner or Occupant the age of eighteen (18) years of age or older at all times, and each Household may have no more than four (4) guests at the Pool per day. The Association reserves the right to make further accommodations upon receipt of an advance written request from an Owner or Occupant.
3. Facility Users are required to shower before entering the Pool. If suntan lotions or other similar preparations are used, showering is required before each use of the Pool.
4. Appropriate swimming attire must be worn at all times. Cut-offs are prohibited in the Pool.
5. All infants/toddlers must wear swim diapers. No regular disposable diapers or other diapers are allowed at ANY time.
6. Those with health problems such as: diarrhea, nausea, infections, wounds, or open cuts are not allowed in the Pool.
7. Running, jumping or diving into the Pool is not allowed.
8. Music/sound producing equipment (i.e. personal radios, iPods, CD players, boom boxes, etc.) is not permitted at the Pool. Earphones are required for any personal music/sound producing equipment.
9. Food and beverages may be consumed in areas provided with tables and chairs. Only beverages in plastic bottles or cans are allowed at the Pool. Food and beverages may not be consumed while in the Pool.
10. Glass containers of any kind and chewing gum are strictly prohibited.
11. Only Coast Guard approved flotation devices are permitted in the Pool. Water toys and inflatables are not permitted during periods of peak activity. The Manager reserves the right to determine what is considered "peak activity". A minor's use of such flotation devices does not eliminate the need for direct supervision by an adult. Plastic swim goggles are acceptable.
12. Water guns and water balloons are strictly prohibited.
13. Any lifestyle programming or Pool maintenance takes precedence over the Pool schedule, and will determine the times for open swimming.
14. During thunder and lightning storms or other inclement weather conditions, the Manager will close the Pool until inclement weather conditions pass. Facility Users must immediately exit the Pool if directed to do so. If the Manager is not present to direct Facility Users to exit the Pool, it is the Facility Users' responsibility to exit the Pool at the first indication of thunder or lightning.
15. Facility Users are required to comply with all Rules governing the use of the Pool, and at no time should they inconvenience or detract from the enjoyment of another Facility User.
16. Any Facility User failing to abide by the Rules will be asked to leave the Pool. The judgment of the Manager with respect to safety, decorum and sanitation will prevail.
17. Chemicals are used in the Pool to ensure a sanitary and safe water environment, and conditions are tested and documented on a regular basis. If unacceptable conditions occur, the Manager reserves the right to close the Pool at any time to preserve the health and well-being of all Facility Users.
18. Pets are prohibited from entering the Pool except those assisting disabled persons. The Association reserves the right to plan pet-related events at the Pool outside of the designated swimming season.
19. Climbing on the surrounding fenced areas or in the landscaping beds is strictly prohibited.
20. Furniture, equipment and supplies that are the property of the Association shall not be removed from the Facilities or placed in the Pool.

1. The use of the playgrounds within the Development is for the exclusive use of Owners, Occupants and their guests.
2. The playgrounds located in the Development are available for use by Facility Users from dawn until dusk.
3. Only one (1) rider permitted on the zipline at a time.
4. Helmets are strongly recommended for those riding the zipline.
5. Riders on the zipline must hold on with both hands until the ride has come to a complete stop.
6. No pushing, pulling or reckless behavior is allowed.
7. Running alongside or attempting to stop another rider of the zipline is not permitted.
8. Glass, ceramic, or other breakable products of any kind are prohibited. Plastic and paper products are recommended.
9. All trash must be disposed of in appropriate trash receptacles. Pet waste must be collected and properly disposed of in appropriate trash receptacles.
10. Playgrounds are smoke-free environments.

1. Use Courts at your own risk.
2. Please keep noise to a minimum.
3. Courts are available on a first-come, first-serve basis.
   1. Please utilize the "Good Neighbor" policy, meaning that when other residents are waiting to play, please limit your court time to one hour.
   2. No commercial use of the courts shall be allowed outside of an Association-coordinated event.
4. Courts are for pickleball use only.
   1. Pickleball courts are for playing pickleball only. No "soccer-tennis" is permitted.
   2. Skateboards, scooters, bikes, roller blades (including wheeled shoes), or similar items are not allowed on the courts.
5. Guests must be accompanies by an owner or occupant while they are on the Courts. Owners and Occupants will be accountable for their guests.
6. No loud music.
7. No more than 3 guests are allowed to be on the court at the same time.
8. Children 12 and under must be accompanied by an adult.
9. No food or beverage items, other than water in plastic containers, are allowed on the Courts. Each person is responsible for cleaning up all trash and other debris generated by his/her use. Trash and debris must be deposited in trash receptacles. Keep the Courts free of litter and debris.
10. No tobacco products, smoking, or vaping of any kind are permitted.
11. No pets are allowed.
12. Court guests must wear appropriate footwear so as not to damage the surface.
13. Climbing, hanging, or standing on the Court fences, nets, or benches is not allowed.
14. Failure to comply with these rules may result in a loss of Court privileges.
15. These rules are subject to change.

1. The Kitchen Area may not be used for commercial purposes, catering, or events requiring a food permit.
2. Users must clean up immediately after use, including wiping down counters, appliances, sinks, and tables.
3. All trash, food waste, and recyclables must be properly disposed of.
4. No open flames, candles or portable burners are permitted.

1. Only Non-Motorized Watercraft, such as canoes, kayaks and paddle boards, are permitted on any lake within the Community. THE USE OF MOTORIZED WATERCRAFT IS PROHIBITED WITHOUT PRIOR WRITTEN AUTHORIZATION FROM THE BOARD.
2. Rented Watercraft may not be removed from the Community, or any of the public or private lakes within the Community.
3. Watercraft is prohibited on any private or public lake within the Community before dawn and after dusk. This may result in changes to reservation times based on the season.
4. All Users must wear a properly fitting, Coast Guard-approved life jacket while using the Watercraft.
   1. The Community provides life jackets for rent, but availability may be limited.
   2. Users are responsible for ensuring enough life jackets are available or must bring their own.
   3. If no life jackets are available, the Watercraft cannot be used until one is secured.
5. Users must respect the natural environment and remove all trash and personal belongings at the end of the rental period.
6. Tobacco products, smoking, or vaping of any kind is prohibited while operating the Watercraft.
7. Drugs, alcohol, and glass containers are strictly prohibited while operating the Watercraft.
8. The User is liable for any damage, loss, or replacement cost exceeding the deposit.
9. Reservations are provided on a first-come, first-served basis and shall be limited to one reservation per household per day.
10. A valid ID and proof of residency may be required to finalize your reservation.

Voluntary Participation 

• User acknowledges that the use of the Watercraft on any of the public or private lakes, waterways, shorelines, and related facilities within the Community involves inherent risks, including but not limited to: drowning, collision with objects or other watercraft, weather-related hazards, physical injury, and property damage. User voluntarily elects to participate in such activities with full knowledge of the dangers involved.

Watercraft Rental

This is an important legal document. 

RELEASE AND COVENANT NOT TO SUE
I, for myself, and for my heirs, personal representatives, assigns, and for any minor identified below, acknowledge and agree that:

Watercraft Use – I, for myself, and for my heirs, personal representatives, assigns, and for any minor identified below, agree that any use of any Watercraft controlled by the parties named below as “Released Parties” is AT MY, OR THE USER’S, OWN RISK.

Public and Private Lake Use - I, for myself, and for my heirs, personal representatives, assigns, and for any minor identified below, agree that the use of the public and private lakes involves inherent risks, including but not limited to: drowning, collision with objects or other watercraft, weather-related hazards, physical injury, and property damage and the use is AT MY, OR THE USER’S, OWN RISK.

No Lifeguard on Duty – I understand that no lifeguards are on duty at any of the public or private lakes, and I am solely responsible for my safety and the safety of any minors under my supervision.

Acknowledgement of Responsibility for Guests – By signing this Waiver of Liability, Owner or Occupant acknowledges and agrees that the privilege of guest access to the public and private lakes and the use of the Watercraft is conditioned upon the Owner or Occupant’s acceptance of full responsibility for guest compliance and conduct.

Severability – If any provision herein is found to be unenforceable under Applicable Law, the remainder shall continue in full force and effect to the maximum extent permitted by law.

I, for myself, and for my heirs, personal representatives, assigns, and for any minor identified below, AGREE TO HOLD HARMLESS AND RELEASE THE RELEASED PARTIES FROM ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO USE OF THE WATERCRAFT AND PUBLIC AND PRIVATE LAKES, INCLUDING PERSONAL INJURY AND PROPERTY DAMAGE CLAIMS.

RELEASED PARTIES: The Grand Prairie Master Community, Inc. and its directors, officers, managers, agents, employees, and affiliates, including any Declarant entity. 

Capitalized terms used but not defined in this agreement have the meaning ascribed to such terms in that certain The Grand Prairie Master Covenant [Residential] recorded in the Official Public Records of Harris County, Texas, as the same may be amended from time to time (the “Covenant”).

Access Passes are the sole property of The Grand Prairie Master Community, Inc. and are issued to Owners or Occupants for their use. A resident the age of 18 or older must accompany all guests while using each facility.

ISSUED ACCESS PASSES a maximum of four (4) Access Passes will be issued to the Owner(s) of a Lot in The Grand Prairie to gain entry into controlled access Facilities.

Mobile access is free while physical fobs are $20 each.

RETURNING FOBS Owner(s) are required to return all issued Access Fobs to the Association prior to selling their home. If the Association receives a request for a Resale Certificate for a Lot prior to the Owner returning the Access Fobs, a charge of $75.00 per unreturned/lost fob will be added to the Resale Certificate. If an Owner(s) returns their issued Access Fobs prior to closing, the $75.00 charge will be removed from the Resale Certificate for each fob returned.

I/we and/or my child(ren) (“I”/“my”) am a member(s) of the Association (collectively, the “Association”). I hereby ACKNOWLEDGE AND AGREE THAT, in consideration of The Grand Prairie Master Community, Inc., and its affiliates, parent companies, officers, directors, partners, managers, agents and employees (referred to herein, collectively, as the “Association”), granting me access to the lakes, pools, pickleball courts and other common amenities of the Association (the “Facilities”), for my voluntary personal use for recreational and other activities, I will be bound by the terms, conditions, and provisions of this Facilities Use Agreement (this “Agreement”). I agree that access to and use of the Facilities is AT MY OWN RISK and that the Association does not, by provision of the Facilities, assume any responsibility or liability to me, my family members, my guests, tenants, occupants, agents and invitees (collectively, “My Guests”). I also agree to indemnify and hold harmless the Association from all liability associated with use of the Facilities, by myself and My Guests, as further set forth in this Agreement.

Furthermore, I accept the current and future condition of the Facilities and the property on which the Facilities are located (the “Property”) as is and with all faults. I understand that the Association does not make implied or express representations or warranties of any kind whatsoever regarding the Facilities and the Property, including, but not limited to, the safety or security of the Facilities and the Property, the compliance of the Facilities and the Property with any applicable law, or the fitness for any use by me or My Guests. I understand that no affirmation of the Association, by words or actions, shall constitute a warranty of any kind whatsoever. In addition, I understand that the Association shall not be liable to me or My Guests for any damage to person or property proximately caused by any of my acts, omissions or neglect, or the acts, omissions or neglect of My Guests; and I agree to indemnify and hold harmless the Association from all claims, demands, actions, suits, and liabilities, of any kind whatsoever, for any such damage. I understand that the Association shall in no event be liable for any damage to person or property proximately caused by any act, omission, or neglect of the Association. Furthermore, I understand that the use of the Facilities is a privilege that may be suspended for a length of time to be determined by the Association’s Board of Directors if: (1) any assessments, fines, fees or other amounts are unpaid to the Association; (2) me, my Lot or home, or my Occupant is in violation of any of the governing documents; (3) me or My Guests violate any rules, policies or provisions of the governing documents; and/or (4) I or members of our immediate family have asserted claims against and there is unresolved pending litigation against the Association.

I hereby release, on behalf of myself and any minor child to whom I am guardian, and on behalf of my heirs, executors, administrators and assigns, the Association from liability for any claims, demands, and causes of action with respect to the Facilities or the Property. I understand that I will be financially responsible for any damage that is caused by me or my family members, tenants/occupants, invitees, guests, etc., may cause to the Facilities or Property.

ACKNOWLEDGMENT AND AGREEMENT I have read and understand this Agreement. I have read the rules applicable to the Facilities as found in the Association’s governing documents, and agree to abide by those rules and all other rules and policies of the Association. I acknowledge that the rules applicable to the Facilities and other rules and policies of the Association may be changed from time to time. The current rules and all governing documents for the Association are available at the Association’s office.

THE UNDERSIGNED GUARDIAN (“GUARDIAN”) IS A PARENT OR LEGAL GUARDIAN OF USER. GUARDIAN ASSUMES FULL RESPONSIBILITY FOR RISK OF BODILY INJURY, DEATH, OR PROPERTY DAMAGE CAUSED OR SUSTAINED BY USER, INCLUDING USER’S OR GUARDIAN’S GUESTS, INVITEES, OR LICENSEES, WHILE USER OR USER’S OR GUARDIAN’S GUESTS, INVITEES, OR LICENSEES ARE IN, ABOUT, UPON, OR USING THE ASSOCIATION FACILITIES OR ATTENDING ASSOCIATION EVENTS AS DESCRIBED IN THIS AGREEMENT, WHETHER OR NOT CAUSED BY THE SOLE, JOINT, COMPARATIVE, OR CONTRIBUTORY NEGLIGENCE OF THE INDEMNIFIED PARTIES.AS A CONDITION OF USER’S USE OF THE ASSOCIATION FACILITIES OR PRESENCE AT ASSOCIATION EVENTS, GUARDIAN (i) MUST CAUSE USER TO COMPLY WITH ALL TERMS OF THIS AGREEMENT, WITH THE ASSOCIATION’S RULES, REGULATIONS, GUIDELINES, POLICIES, AND RESTRICTIONS GOVERNING THE USE OF THE ASSOCIATION FACILITIES AND PRESENCE AT ASSOCIATION EVENTS, AND WITH ALL LOCAL AND FEDERAL GUIDANCE, RULES, AND LAWS GOVERNING USER’S USE OF AND PRESENCE AT THE ASSOCIATION FACILITIES OR PRESENCE AT ASSOCIATION EVENTS, INCLUDING ANY GUIDANCE, RULES, AND LAWS PERTAINING TO USER’S CONSUMPTION OF ALCOHOL AT THE ASSOCIATION FACILITIES OR AT ASSOCIATION EVENTS, AND (ii) SHALL, TO THE FULLEST EXTENT PERMITTED BY LAW, INDEMNIFY, HOLD HARMLESS, AND DEFEND (ON DEMAND) THE INDEMNIFIED PARTIES FROM, FOR, AND AGAINST ALL CLAIMS (INCLUDING, WITHOUT LIMITATION, CLAIMS BROUGHT BY USER AND ANY GUESTS, INVITEES, OR LICENSEES OF USER OR GUARDIAN) IF SUCH CLAIMS ARISE OUT OF OR RELATE TO USER’S OR ANY OF USER’S OR GUARDIAN’S GUESTS’, INVITEES’, OR LICENSEES’ PRESENCE IN OR USE OF THE ASSOCIATION FACILITIES OR PRESENCE AT ASSOCIATION EVENTS (THE “GUARDIAN INDEMNIFIED CLAIMS”). THIS COVENANT TO INDEMNIFY, HOLD HARMLESS, AND DEFEND INCLUDES (WITHOUT LIMITATION) CLAIMS CAUSED, OR ALLEGED TO BE CAUSED, IN WHOLE OR IN PART BY THE INDEMNIFIED PARTIES’ OWN NEGLIGENCE. FURTHERMORE, GUARDIAN MAY NOT COMMENCE OR MAINTAIN ANY GUARDIAN INDEMNIFIED CLAIMS AGAINST ANY OF THE INDEMNIFIED PARTIES.
