Terms and Conditions
HIIT Australia Pty Ltd - HIIT Kids Gym Class Terms and Conditions&#13;&#10;Location: Unit 3/178 Redland Bay Rd, Capalaba, QLD 4157&#13;&#10;&#13;&#10;These Terms and Conditions apply to all participants of the HIIT Australia Pty Ltd (“HIIT Australia”) Kids Gym Class. By enrolling your child in the program, you agree to the following:&#13;&#10;&#13;&#10;1. Eligibility&#13;&#10;Your child must be between 6 and 12 years of age to participate in the HIIT Kids Gym Class at HIIT Australia Pty Ltd.&#13;&#10;&#13;&#10;2. Coaching&#13;&#10;Your child will be coached by qualified and experienced instructors. While every effort is made to ensure the safety and wellbeing of all participants, parents/guardians acknowledge that physical exercise carries inherent risks.&#13;&#10;&#13;&#10;3. Liability for Injury or Death&#13;&#10;By enrolling your child in this class, you acknowledge that there are inherent risks associated with physical activity, which may result in injury, illness, or in extreme cases, death. You agree that HIIT Australia Pty Ltd, its staff, coaches, and affiliates will not be held liable for any injury, harm, or death that may occur during participation, except where caused by gross negligence on the part of HIIT Australia Pty Ltd.&#13;&#10;&#13;&#10;4. Medical Clearance&#13;&#10;Parents/guardians must ensure that their child is medically fit to participate in physical activities. If your child has any medical conditions, allergies, or special requirements, these must be disclosed upon registration. Failure to disclose relevant health information may result in the child being denied participation in classes for safety reasons.&#13;&#10;&#13;&#10;5. Payment Terms&#13;&#10;All payments for the HIIT Kids Gym Class must be made in full at the time of registration. No refunds or transfers will be provided once payment is made, including for missed classes.&#13;&#10;&#13;&#10;6. Missed Classes&#13;&#10;There will be no make-up sessions, refunds, or credits issued for missed classes, regardless of the reason for absence. HIIT Australia encourages parents to ensure consistent attendance for their child's optimal benefit from the program.&#13;&#10;&#13;&#10;7. Parent/Guardian Supervision&#13;&#10;A parent or guardian must remain on the premises for the entire duration of the class. HIIT Australia Pty Ltd will not be responsible for the supervision of children outside class hours.&#13;&#10;&#13;&#10;8. Image and Video Consent&#13;&#10;By signing this form, you consent to your child’s image being captured during classes and potentially shared on HIIT Australia’s social media platforms and marketing materials. If you do not consent, you must notify HIIT Australia in writing prior to the first class.&#13;&#10;&#13;&#10;9. Code of Conduct&#13;&#10;Participants must adhere to the class rules and instructions provided by the coaches. HIIT Australia reserves the right to remove any child from the class for disruptive behavior or failure to follow instructions, without any refund.&#13;&#10;&#13;&#10;10. Waiver of Liability&#13;&#10;By signing this form, you agree to release and discharge HIIT Australia Pty Ltd, its employees, contractors, and coaches from any and all liability for claims, demands, losses, or damages resulting from participation in the class, to the extent permitted by law.&#13;&#10;&#13;&#10;11. Assumption of Risk&#13;&#10;By enrolling your child in the HIIT Kids Gym Class, you acknowledge that participation in physical fitness activities involves certain risks, including but not limited to falls, equipment failure, overexertion, or unintentional contact with other participants. You voluntarily assume all risks associated with your child’s participation, including any that may result in injury or illness, and agree that HIIT Australia Pty Ltd and its employees will not be held liable except in the case of gross negligence.&#13;&#10;&#13;&#10;12. Indemnification Clause&#13;&#10;You agree to indemnify, defend, and hold harmless HIIT Australia Pty Ltd, its directors, employees, contractors, agents, and affiliates from and against any and all claims, liabilities, damages, losses, expenses, including legal fees, arising out of or related to your child's participation in the HIIT Kids Gym Class. This includes claims arising from your child’s own conduct, or any breach of these terms and conditions.&#13;&#10;&#13;&#10;13. Emergency Medical Treatment Consent&#13;&#10;In the event of an injury or medical emergency during the class, you authorise HIIT Australia Pty Ltd and its staff to provide basic first aid and, if deemed necessary, arrange for your child to receive medical treatment from a qualified professional or emergency services. You agree to bear any costs associated with such treatment and release HIIT Australia Pty Ltd and its staff from any liability arising out of such decisions or actions.&#13;&#10;&#13;&#10;14. No Guarantee of Results&#13;&#10;HIIT Australia Pty Ltd does not guarantee specific fitness or health outcomes from participation in the HIIT Kids Gym Class. Every child’s progress may vary based on individual circumstances, including physical fitness levels and personal effort.&#13;&#10;&#13;&#10;15. Amendment of Terms&#13;&#10;HIIT Australia Pty Ltd reserves the right to amend these Terms and Conditions at any time. Any changes will be communicated in writing, and continued participation in the HIIT Kids Gym Class constitutes acceptance of the revised terms.&#13;&#10;&#13;&#10;16. Force Majeure&#13;&#10;HIIT Australia Pty Ltd will not be liable for any failure to perform its obligations if such failure is due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, government restrictions, or any other event that prevents the operation of the HIIT Kids Gym Class.&#13;&#10;&#13;&#10;By signing this document, you confirm that you have read, understood, and agree to the terms and conditions outlined above.
