    1. Acceptance of Terms

    Welcome to MCN Online (“MCN,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of www.mcnonline.net and any related sites, services, products, content, applications, and communications (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy located at: https://web.mcnonline.net/legal-agreement?id=privacy.

    If you do not agree to these Terms, please do not use the Services.

    2. Eligibility

    You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. By using the Services, you represent and warrant that you meet eligibility requirements.

    We may update these Terms from time to time. The “Last Updated” date indicates the latest revision. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.

    4. Accounts & Security

    You may need to create an account to use certain features. You are responsible for safeguarding your login credentials and for all activity under your account. Notify us immediately of any unauthorized use or security breach.

    5. Privacy

    Your use of the Services is subject to our Privacy Policy: https://web.mcnonline.net/legal-agreement?id=privacy, which explains how we collect, use, and share information—including information related to our SMS program.

    6. Communications; 10DLC-Compliant SMS Program Terms

    We may offer SMS (text message) communications related to account notifications, transactional updates, marketing, promotions, and customer support (the “SMS Program”).

    Program Name: HAAM Alerts
    Short Description: Updates, account notices, and promotional messages from MCN Online.
    Message Frequency: Varies; typically, e.g., up to 4 messages/month for marketing; transactional messages as needed.


    Opt-In Methods:

    • Written/recorded consent captured by customer service and/or Human Resources at Your sign-up Facility.

    By opting in, you authorize MCN to send SMS messages to the mobile number you provide. Message & data rates may apply. Carriers are not liable for delayed or undelivered messages.

    Supported Keywords:

    STOP: Text STOP to The Number provided to you at your Sign-Up Facility to opt out. After you send STOP, you may receive a confirmation message acknowledging you opt-out.
    Additional commands (if any): NONE.


    Opt-Out:
    You may opt out of SMS messages at any time by texting STOP to The Number provided to you at your Sign-Up Facility. Opting out of marketing does not affect transactional or service messages where permitted by law (e.g., order updates), unless you opt out of all messaging.

    Consent & Data Handling:

    • You must provide accurate mobile number information and have authority to consent to receiving messages at that number.
    • We may process your mobile number and messaging-related metadata per our Privacy Policy: https://web.mcnonline.net/legal-agreement?id=privacy.
    • If you change or deactivate your mobile number, please update your account and preferences to avoid messages being sent to the wrong number.

    Program Eligibility & Restrictions:

    • The SMS Program is intended for U.S. subscribers on supported carriers.
    • Carriers are not liable for delayed or undelivered messages.
    • Service availability may vary by carrier and location.  

    Compliance:
    Our SMS Program is intended to comply with applicable laws and industry guidelines, including the Telephone Consumer Protection Act (TCPA) and CTIA messaging principles. You agree not to use our Services to send or receive unlawful, harmful, or prohibited content

    7. User Content & License

    If you submit content (e.g., reviews, comments, media), you grant MCN a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, distribute, display, and perform the content in connection with the Services. You represent that you own or have rights to the content and it does not infringe third-party rights.

    8. Prohibited Conduct

    You agree not to:

    • Violate laws, regulations, or rights of others
    • Interfere with Service operations, security, or access controls
    • Upload or transmit malicious code
    • Engage in spamming, phishing, or unlawful messaging
    • Misrepresent identity or affiliation
    • Reverse engineer or scrape the Services except as allowed by law

    9. Intellectual Property

    The Services and all related content, trademarks, logos, and materials are owned by MCN or its licensors and are protected by intellectual property laws. No rights are granted except as explicitly stated in these Terms.

    10. Third-Party Services & Links

    We may link to third-party websites or services. We are not responsible for their content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.

    11. Disclaimers

    THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

    12. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, MCN AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE APPLICABLE SERVICES IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

    13. Indemnification

    You agree to defend, indemnify, and hold harmless MCN and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the Services, your violation of these Terms, or your infringement of any third-party rights.

    14. Governing Law & Jurisdiction

    These Terms are governed by the laws of the State of New Jersey, without regard to its conflicts of law principles. You agree to the exclusive jurisdiction of the state and federal courts located in New Jersey for any disputes not subject to arbitration.

    15. Termination

    We may suspend or terminate your access to the Services at any time for any reason, including violation of these Terms. Upon termination, provisions that by their nature should survive (e.g., ownership, disclaimers, limitations of liability) shall survive.

    16. Changes to Services

    We may modify or discontinue all or part of the Services without notice. We are not liable for any modification, suspension, or discontinuation.

    17. Entire Agreement

    These Terms, together with the Privacy Policy and any supplemental terms presented with specific Services, constitute the entire agreement between you and MCN concerning the Services.
