Photography Services Terms & Agreement

By booking Gifted One LLC photography services, the Client agrees to the terms outlined in this agreement.
2. Photography Services
The Photographer agrees to provide the photography services selected by the Client, including but not limited to:
Event photography
Wedding photography
Portrait photography
Headshots
Branding photography
Business photography
Product photography
Promotional photography
Other agreed-upon photography services
The specific package, hours, location, number of images, and deliverables will be outlined in the Client's invoice or booking confirmation.
3. Booking & Retainer
A non-refundable retainer/deposit is required to secure the Client's date and time.
The date is not considered officially booked until the required payment has been received.
a 50% deposit is required to begin the project and reserve the date.
The remaining balance must be paid according to the payment schedule provided by the Photographer.
4. Payments
All payments must be made according to the agreed payment schedule.
Failure to make payments on time may result in cancellation of services and/or withholding of final images until the account is paid in full.
The Photographer reserves the right to decline additional services until outstanding balances are resolved.
5. Cancellation Policy
The Client may cancel their booking; however, all retainers/deposits are non-refundable because the Photographer has reserved the date and potentially declined other bookings.
If the Client cancels after the Photographer has begun providing services, the Client remains responsible for any completed work or additional approved expenses.
6. Rescheduling
The Client may request to reschedule a session or event.
Rescheduling is subject to the Photographer's availability.
The Photographer will make reasonable efforts to accommodate the new date, but availability is not guaranteed.
Weather-related rescheduling for outdoor sessions may be handled at the Photographer's discretion.
7. Late Arrival
Clients are responsible for arriving on time.
If the Client arrives late, the session may still end at the originally scheduled time.
Additional time may be available at an additional charge, depending on the Photographer's availability.
8. Image Delivery
Final edited images will be delivered through an online gallery, digital download, or another agreed-upon method.
Estimated delivery times may vary depending on the size and type of project.
The Photographer will make reasonable efforts to deliver images within the estimated timeframe.
9. Editing & Retouching
The Photographer will provide professional editing consistent with their creative style.
Basic editing may include:
Exposure adjustments
Color correction
Cropping
Lighting adjustments
Minor skin corrections
Overall image enhancement
Extensive retouching, object removal, body alterations, or advanced editing may require an additional fee.
The Photographer's artistic judgment regarding editing and final image selection shall be respected.
10. RAW & Unedited Images
RAW, unedited, or unfinished photographs are not included unless specifically agreed upon in writing.
The Photographer retains ownership of RAW files and is not required to provide them to the Client.
11. Photographer's Creative Style
The Client acknowledges that they have reviewed the Photographer's portfolio and understand the Photographer's artistic style.
The Photographer will use professional judgment when selecting compositions, poses, lighting, editing, and final images.
The Client may communicate preferences before the session, but the Photographer retains creative control over the final artistic product.
12. Copyright & Ownership
The Photographer retains copyright and ownership of the photographs created during the session unless otherwise agreed upon through a separate written licensing or copyright transfer agreement.
The Client receives permission to use the delivered images for personal or agreed-upon business/promotional purposes.
The Client may not sell, license, alter, or commercially redistribute the photographs without written permission from the Photographer.
13. Photographer's Portfolio & Marketing Rights
Unless the Client provides written notice restricting this use before the session, the Photographer may use selected photographs from the session for:
Portfolio purposes
Website
Social media
Advertising
Marketing
Promotional materials
Photography competitions or publications
If the Client requires a private or confidential session, this must be discussed and agreed upon before photography services are provided.
14. Client Responsibilities
The Client is responsible for:
Providing accurate event/session information
Arriving on time
Communicating special requests in advance
Providing access to the event/location when necessary
Obtaining required permits or permissions
Informing the Photographer of important schedule changes
Ensuring guests and participants cooperate with reasonable photography requests
15. Location & Travel Fees
Travel outside the Photographer's standard service area may require an additional travel fee.
Parking, tolls, permits, admission fees, lodging, or other necessary expenses may be charged to the Client when applicable.
Any additional fees should be communicated to the Client before they are incurred whenever reasonably possible.
16. Equipment Failure & Unforeseen Circumstances
The Photographer will take reasonable precautions to protect equipment and client images.
In the unlikely event of equipment failure, loss of images, illness, emergency, severe weather, venue restrictions, or another circumstance beyond the Photographer's reasonable control, the Photographer will make reasonable efforts to provide an alternative solution.
The Photographer's maximum liability for a failure to provide services shall generally be limited to the amount actually paid by the Client for the affected services, to the extent permitted by applicable law.
17. Cooperation & Safety
The Photographer reserves the right to stop or refuse photography services if the Photographer, assistant, equipment, or other participants are placed in an unsafe situation.
Threatening, abusive, or inappropriate behavior toward the Photographer or their team will not be tolerated and may result in termination of services without refund.
18. Event Changes
The Client must notify the Photographer as soon as possible of changes to:
Event location
Event start/end time
Schedule
Number of participants
Requested services
Photography coverage
Additional charges may apply when changes require additional time, equipment, personnel, or travel.
19. Agreement Changes
Any changes to this agreement must be agreed upon by both parties in writing.
Verbal agreements that change the scope, price, or terms of the original booking should be confirmed in writing.
20. Client Acknowledgment
By signing below, the Client confirms that they have read, understood, and agreed to these Photography Services Terms & Agreement.
