ZRS Singers
Join the National Symphonic Chorus, under the direction of Dr. Zanaida Robles, comprised of outstanding singers from across the country in collaboration with our professional orchestra. Rehearsals and a final performance will take place at world-famous Carnegie Hall.

Included as part of the National Concerts experience is:

VENUE
Sound check and performance at world-renowned Carnegie Hall.

EXPERIENCE
Nationally-recognized guest conductor to lead rehearsals and performance, professional orchestra, ticket to attend other half of concert as audience member, and official photographer.

STAFF
Artistic faculty including conductor, composer, instrumentalists, soloists, designer, production team, concert promotion, audience development, concert and venue management: stage crew, house management, ushers, box office, and official concert program.

PREPARATION
Chorus development, preparation monitoring, part learning tracks, rehearsal space, and professional collaborators.

POST CONCERT
Archival recording of your performance, commemorative poster, and catered post-concert reception.

Agreement Terms
I understand that performance repertoire will be announced at least six months prior to first rehearsal.
I understand that I am responsible for providing original scores in a black music folder.
I agree to arrive with all of the music thoroughly prepared and to attend all mandatory rehearsals as an active, engaging singer.
In order to ensure a level of consistency and equally well-prepared singers, I understand that I may be required to submit a 45-day preparation recording to demonstrate my preparation of the music prior to my concert residency.
I understand that, if I'm not musically prepared, NC reserves the right to exclude me from rehearsals and the final performance without a refund.
I confirm that I am at least 18 years old, I am able to take direction from a conductor, and that I can independently perform choral music of moderate difficulty on my own voice part.
I understand that $400 per person is non-refundable and no monies is refundable within 30 days of the performance. However, I understand that in the event the performance is canceled by NC for a reason other than a Force Majeure Event, all monies will be refunded.
I indemnify and hold NC harmless for any claim or liability arising from my participation.

Appearance Release Waiver
For good and valuable consideration, the receipt and sufficiency of which is acknowledged, I agree that NC may (a) tape, film, photograph and/or record me; and (b) use my name, voice, likeness, conversation and sounds, the results and proceeds of my participation and performance (including the performance of any musical composition(s)) and biographical information concerning me, including, without limitation, any statements, interviews or performances by me, whether contained in existing materials or as photographed by or on behalf of NC (“Appearance”) in and in connection with the performance residency and/or Platform, and any version(s) thereof or other works. I agree that the results and proceeds of my participation in the performance residency shall be deemed to be a work specially commissioned for use in an audiovisual work and as such shall be deemed to be a “work-made-for-hire,” for NC, as that term is defined by United States Copyright Law, and NC is the sole and exclusive author thereof. To the extent that any such results and proceeds are not deemed to be a work-made-for-hire, I hereby assign to NC all right, title and interest therein. I expressly waive any so called "moral rights" which may now be or may hereafter be recognized.

All physical embodiments of my Appearance in connection with the performance residency shall be known as “Materials, ” which shall include without limitation all footage and photography (still and motion) shot by NC including, without limitation, so-called “making-of” and “behind-the-scenes” footage or any promotion or marketing thereof, and/or any sketches, drawings, designs, performances, recordings, choreography, or other dramatic materials photographed, recorded, drawn, performed or contributed by me in connection therewith. NC shall have the right to edit, dub, modify, add to and/or delete any or all of the Materials or other material contained in the performance residency or any version or otherwise photographed for or used in connection therewith, in whole or in part. Without limiting the foregoing, NC shall be the exclusive owner of the Materials with the right, throughout the universe, including under copyright, to use and to license others to use in any and all languages, versions, formats, manner or media, now known or hereafter devised, all or any portion of the Materials, or other materials made available to NC, in and in connection with the performance residency and/or Platform, and the advertising, promotion, or publicity thereof (including, but not limited to, co-promotion and commercial tie-ins), and/or the sale, or re-creations of events in connection with performance residency, Platform, or otherwise, an unlimited number of times, and in perpetuity. NC is not obligated to use my Appearance, the Materials and/or produce the performance residency, any version thereof or other work.

I hereby waive any right of inspection or approval of the Materials or the uses to which my Appearance or the Materials may be put. I hereby also waive any so-called rights of publicity, privacy, and any other similar right. I hereby release NC from any claims, demands and causes of action that I, or any person claiming through me, may have at any time relating to my Appearance, the Materials, the performance residency, versions thereof or other works. I represent that any statements made by me as part of the Materials are, to the best of my knowledge, true, and that neither my Appearance nor any such statements will violate or infringe upon the rights of any third party. I acknowledge that NC will rely on this agreement, potentially at substantial cost to NC, and hereby agree not to assert any claim of any nature whatsoever (including any claims for injunctive relief and/or money damages) against anyone relating to the exercise of the rights granted hereunder. I acknowledge and consent to the collection and processing of my personal data as necessary in connection with the exercise of the rights I am granting hereunder by NC, Platform and their respective designees, licensees, and assigns.

I agree that all of the rights herein granted may be exercised by NC, its designees, licensees or assigns and that NC shall have the right to assign this agreement and/or license, assign or otherwise transfer any or all rights hereunder, in whole or in part, without restriction including, without limitation, to the Platform which shall be an express third-party beneficiary of this instrument. The rights granted hereunder are irrevocable; in no event shall I have the right to seek or obtain injunctive relief or other equitable relief to enjoin or restrain or otherwise interfere with the exercise of any rights hereunder and/or the production, distribution or other exploitation of my Appearance, the Materials, the performance residency, versions or other works. This agreement will be construed in accordance with the laws of the state of New York, applicable to agreements to be wholly performed therein. The New York courts (state and federal), only, will have exclusive jurisdiction of any controversies regarding or arising out of this agreement. This
agreement may not be modified or amended except in a writing signed by the parties and is the sole and entire understanding of the parties with respect to its subject matter.

I represent and warrant that: (i) I am at least eighteen (18) years of age and a legal U.S. resident (or, if not, that my parent or legal guardian has agreed to the foregoing and signed below); (ii) my participation in the Project is not employment and does not entitle me to wages; (iii) I have the full power and right to enter into this agreement and the consent of no other person or entity is necessary to grant the rights hereunder; (iv) I have not given or received, or agreed to give or receive, directly or indirectly, anything of value to arrange my appearance or to include any matter in the Project or any advertisements therefor; (v) my participation will not violate or infringe upon any rights of any third-party and will not cause me to be in breach of any agreements to which I am a party; and (vi) any statements made by me during my Appearance are true to the best of my knowledge.
