This Rental Agreement and Waiver of Liability Agreement is entered into between OTTERLY FUN KAYAK RENTAL LLC and the undersigned renter (“Participant” and/or “Parent/Guardian”).By signing this Agreement, Participant acknowledges and agrees to the following terms and conditions:⸻1. ACKNOWLEDGMENT OF RISKSI understand that kayaking, tubing, paddle boarding, swimming, transporting equipment, entering or exiting watercraft, using embankments, docks, shorelines, rivers, lakes, and waterways involve inherent and unpredictable risks that may result in serious bodily injury, illness, drowning, paralysis, property damage, or death.Risks include but are not limited to:• Slipping or falling on wet or uneven surfaces• Collision with objects, boats, docks, wildlife, or other persons• Capsizing or falling into the water• Exposure to weather, sun, heat, cold, currents, waves, or changing water conditions• Equipment failure or misuse• Physical exertion• Negligence of other participants• Injuries occurring during loading, unloading, transporting, entering, or exiting equipmentI knowingly and voluntarily assume all risks associated with participation in these activities.2. RELEASE OF LIABILITYIn consideration for being allowed to rent and use equipment from OTTERLY FUN KAYAK RENTAL LLC, I hereby release, waive, discharge, and hold harmless OTTERLY FUN KAYAK RENTAL LLC, its owners, employees, agents, volunteers, contractors, and affiliates from any and all claims, liabilities, demands, actions, damages, losses, costs, or expenses arising from or related to:• Personal injury• Death• Property damage• Loss or theft• Negligence• Equipment malfunction• Participation in watersport activitiesThis release applies whether caused by negligence or otherwise to the fullest extent permitted by Michigan law.3. MEDICAL FITNESSI certify that I and all minors under my supervision are physically capable of safely participating in these activities and have no medical condition that would create unreasonable risk.I understand the Company does not provide medical insurance.4. LIFE JACKET REQUIREMENTI understand that properly fitted life jackets/personal flotation devices (PFDs) are required and must be worn according to Michigan law and Company rules.I accept full responsibility for ensuring all minors under my supervision wear required safety equipment.5. RESPONSIBILITY FOR MINORSIf signing on behalf of a minor child, I certify that I am the parent or legal guardian of the minor(s) listed below.I agree:• I am responsible for supervising all minors in my care• I accept all risks on behalf of the minor(s)• I release OTTERLY FUN KAYAK RENTAL LLC from claims brought by or on behalf of the minor(s)• I accept full financial responsibility for damages caused by the minor(s)6. EQUIPMENT RESPONSIBILITY & DAMAGE AGREEMENTI understand that I am fully responsible for all rented equipment during the rental period, including but not limited to:• Kayaks• Paddle boards• Tubes• Paddles• Life jackets• Straps• Seats• AccessoriesI agree to return all equipment in the same condition in which it was rented, excluding normal wear and tear.I understand and agree that:• I am financially responsible for any lost, stolen, damaged, or destroyed equipment• I may be charged repair costs or the full replacement value of equipment if necessary• OTTERLY FUN KAYAK RENTAL LLC may charge the payment method on file for damages, cleaning, late returns, missing items, or replacement costs• Failure to return rented equipment may result in additional legal action and financial liability.
