AUTHORIZATION & CONSENT AGREEMENT
By submitting this application, you (“Applicant”) agree to the following terms. Please read carefully—this document covers how we contact you, how we use your information, and what happens next.
1. Credit Pull Authorization
You give the selected lender permission to obtain your personal and/or business credit report. This will include a hard pull once you move forward with the specific lender. A hard pull may temporarily affect your credit score.
They may pull credit from one or more of the major credit bureaus (Equifax, Experian, TransUnion) or business credit agencies (Dun & Bradstreet, SBFE, LexisNexis).
2. Lender Submission Authorization
You authorize Magenta Commercial Capital to share your application, financial information, and supporting documents with third-party lenders, funding partners, and financial institutions in our network for the purpose of securing financing on your behalf.
We will only share your information with lenders who may be able to meet your financing needs. We are not obligated to submit to any specific lender, and submission does not guarantee approval.
3. Communications Consent (TCPA)
You authorize Magenta Commercial Capital and its partners to contact you regarding your application and related financing opportunities using:
• Phone calls (including calls made with an autodialer or prerecorded messages) • Text messages (SMS/MMS) • Emails You may opt out at any time by replying STOP to any text message or by contacting us directly. Message and data rates may apply. Consent to receive marketing communications is not required to obtain our services.
4. Electronic Signature & E-Sign Consent
You agree to conduct business with us electronically. This means that your electronic signature, typed name, or digital acknowledgment carries the same legal weight as a handwritten signature, in accordance with the Electronic Signatures in Global and National Commerce Act (E-SIGN Act).
You have the right to request paper copies of any documents. To do so, contact us directly.
5. Privacy & Data Use
We take your privacy seriously. The information you provide will be used to:
• Process and evaluate your financing application • Match you with appropriate lenders in our network • Communicate with you about your application status • Comply with legal and regulatory obligations
We do not sell your personal information to third parties for marketing purposes. Your data may be shared with lenders, service providers, and as required by law. For full details, request to review our Privacy Policy.
6. Broker Fee Disclosure
Magenta Commercial Capital earns a broker fee for arranging financing on your behalf. Here is how the fee works:
• The fee is determined by the type of loan product being arranged and will be clearly outlined on the term sheet provided by the lender (or a separate broker agreement). • In most cases, the broker fee is paid by you, the client. In some instances, depending on the loan product and lender, the fee may be paid by the lender. • The broker fee is only collected at the time of funding — you owe nothing unless your loan closes. • You will have the opportunity to review and approve the fee before moving forward.
We are committed to full transparency. If you have any questions about the fee at any point in the process, please ask before signing anything. The fee isn't determined until after the pre-qualification process to determine the type of loan and the lender who can fund it.
7. No Guarantee of Funding
Submitting this application and receiving a prequalification does not guarantee loan approval, specific loan terms, or funding. Final approval decisions are made solely by the lender. Loan terms, rates, and amounts are subject to change based on full underwriting review.
