  • PART A — REFERENCE CHECK PROCEDURES

  • For the purpose of this agent reference check, "the Agent" (hereinafter referred to as the Agent) means the education agent engaged by the Provider to recruit and/or assist overseas students.
    PURPOSE: Omni College is required under Standard 4.1 of the National Code of Practice for Providers of Education and Training to Overseas Students 2018 to take all reasonable measures to ensure education agents are suitable and provide accurate and ethical information to prospective international students. As part of this due diligence process, Omni College conducts reference checks in accordance with its Education Agent Policy and Procedures to assess the suitability, integrity, and past performance of prospective agents.
  • A.1 Who Must Conduct Reference Checks

  • Reference checks must be conducted by the Marketing Coordinator or delegate — not by the agent applicant. A minimum of two (2) reference checks are required for every new agent appointment.
    • At least one (1) referee must be a CRICOS-registered provider who has directly engaged the agent to recruit international students.
    • The second referee may be a registered provider, an education sector representative, or another professional who can attest to the agent's character, conduct, and compliance.
    • Referees must not be family members, business partners, or employees of the agent.
    • Referees must have directly observed the agent's recruitment practices within the past three (3) years.
  • A.2 Reference Check Steps

  • Step 1 Obtain referee contact details from the agent application form (EA-001). Do not ask the agent to contact the referee on Omni College's behalf.
    Step 2 Contact each referee directly by phone or email.
    Step 3 Conduct the check using Part C (Reference Check Questions) on this form. Record responses in detail.
    Step 4 Complete Part D (Outcome and Recommendation).
    Step 5 Obtain signature of the person who conducted the check.
    Step 6 File the completed form in the agent's onboarding record.
    Step 7 Do not proceed to appoint the agent unless at least two (2) satisfactory reference checks have been obtained.
  • A.3 Unsatisfactory Reference Check

  • IMPORTANT: If a referee raises concerns about misleading recruitment, migration advice, student welfare, or ethical conduct, do not proceed with the appointment. Escalate to the CEO / Principal with a written summary of concerns.
  • Unsatisfactory outcomes include any of the following:
    • Referee declines to recommend the agent for appointment with a registered provider
    • Referee raises concerns about misleading or fraudulent student recruitment
    • Referee discloses complaints or regulatory investigations involving the agent
    • Referee discloses that the agent provided immigration advice without RMA registration
    • Referee is unable to verify the agent's conduct or recruitment practices
    • Agent provides false referee contact details
  • A.4 Record-Keeping

    • File completed EA-002 forms in the agent's onboarding record immediately upon completion.
    • Retain for a minimum of two (2) years after the Agreement expires or is terminated.
    • Make available for ASQA audit on request.
    • Store securely — accessible only to authorized Omni College staff.

    Referee recommends the agent. No concerns raised about ethical conduct, informationaccuracy, or compliance. Proceed to Reference 2 (if this is Reference 1) or proceed toappointment recommendation (if Reference 2).

    If Unsatisfactory -
    Referee raised one or more concerns. DO NOT proceed with appointment. Escalate to CEO /Principal with written summary. File this form on the agent's record.
