Rental Agreement

Please read over and sign the following agreement.
This Point Use Rental Agreement (the "Agreement") is made by and between the Disney Vacation Club Member (the "Member") and (the "Guest"). This transaction is facilitated with the assistance of DVC Marketplace, LLC, acting solely as an intermediary between the Member and the Guest (the "Intermediary").
1. Reservation Details: At the request of the Guest, the Member agrees to a one-time use and rent of their Disney Vacation Club ("DVC") vacation points to secure the following accommodations (the "Reservation"):

2. Non-Refundable Payment Schedule: The Guest shall pay a total of {totalPrice41} If you (the "Point Use Rate") to the Intermediary in exchange for the Reservation.
Guest explicitly understands and agrees that all funds paid toward the Point Use Rate are NON-REFUNDABLE at all times and under all circumstances, including but not limited to, weather events, travel delays, illnesses, or personal conflicts.

Payment is due in full pursuant to the following terms:

Full Payment: A non-refundable payment of 100% of the Point Use Rate is required upon execution of this Agreement to secure the Reservation.

Authorization Hold: To protect the Guest, the Intermediary will place a temporary authorization hold on the Guest's payment method upon signing. The full payment will only be captured and processed once the Intermediary provides the Guest with the official Disney Confirmation Number.

3. Compliance and Liability:
No Agency: The Guest acknowledges that DVC Marketplace, LLC acts only as an intermediary. The Intermediary is not an agent for the Walt Disney Company and is not responsible for any actions, omissions, or conditions outside of its direct control.
Waiver of Liability: The Guest waives the right to any claims against the Intermediary or Member for injuries, damages, or losses sustained in connection with the Reservation, including closures, abnormal conditions, or illness.
Resort Rules: The Guest agrees to abide by all DVC Resort rules, including the strict no-smoking policy and age requirements for check-in. The Guest is financially responsible for any damages assessed to the Member's account during their stay.
