POINT USE RENTAL AGREEMENT
This Point Use Rental Agreement (the “Agreement”) is entered into by and between the Disney Vacation Club owner or member whose points are being used for the reservation (the “Member”) and the guest identified at checkout (the “Guest”). This transaction is facilitated by DVC Marketplace, LLC, a Florida limited liability company, acting solely as an intermediary between the Member and Guest (the “Intermediary”).
By signing or electronically accepting this Agreement, Guest agrees to the terms below.
1. Reservation Details
At Guest’s request, Member agrees to use Disney Vacation Club vacation points to secure the following reservation for Guest’s use:

Total Reservation Price: {totalPrice}
The Reservation is subject to Disney Vacation Club and resort rules, policies, availability, and confirmation by Disney.
2. Nature of Transaction
Guest understands that this transaction is for the one-time use of a Disney Vacation Club reservation secured with Member’s Disney Vacation Club points.
Guest is not purchasing, receiving, owning, or being transferred any Disney Vacation Club points, membership interest, deeded interest, real estate interest, or ownership rights of any kind.
DVC Marketplace, LLC is not Disney Vacation Club, Disney, or an affiliate of The Walt Disney Company. Disney Vacation Club, Disney, and the applicable resort are not parties to this Agreement.
3. Payment Authorization and Capture
Guest authorizes the Intermediary to place a temporary authorization hold on Guest’s payment method upon execution or electronic acceptance of this Agreement.
The full payment will be captured and processed only after the Intermediary provides Guest with the official Disney confirmation number for the Reservation.
Once the official Disney confirmation number has been provided to Guest, the Reservation is considered confirmed, and Guest becomes responsible for the full Total Reservation Price, subject only to the limited exceptions expressly stated in this Agreement.
4. Failed Payment or Declined Authorization
Guest understands that the Member may secure the Reservation in reliance on Guest’s signed Agreement and submitted payment authorization.
If Guest’s payment method is declined, fails, is reversed, is rejected, or cannot be captured after the official Disney confirmation number has been provided to the intermediary, Guest remains responsible for the full Total Reservation Price and must provide an alternate valid payment method within twenty-four (24) hours of notice from DVC Marketplace, LLC.
Guest may not cancel, withdraw, or refuse the Reservation because Guest’s original payment method failed after the official Disney confirmation number has been provided.
If Guest fails to provide valid alternate payment within twenty-four (24) hours, DVC Marketplace, LLC may pursue any available remedies, including collection of the unpaid balance, payment processing fees, bank fees, chargeback fees, administrative costs, and reasonable attorney’s fees where permitted by law.
5. Non-Refundable Payment Terms
Guest understands and agrees that, once the official Disney confirmation number has been provided, all amounts paid or owed toward the Total Reservation Price are non-refundable.
This non-refundable policy applies regardless of the reason Guest is unable or chooses not to travel, including but not limited to illness, personal emergencies, weather events, hurricanes, flight delays, travel disruptions, park closures, schedule changes, family conflicts, work conflicts, or other circumstances outside the Intermediary’s or Member’s direct control.
Guest is strongly encouraged to purchase independent travel insurance.
6. Failure to Secure Reservation
If the requested Reservation cannot be secured and the official Disney confirmation number is not provided to Guest, Guest will not be charged, or any captured payment for the unavailable Reservation will be refunded.
The Intermediary may, but is not required to, offer Guest alternate resorts, room types, dates, or reservation options.
7. Reservation Changes and Cancellations
After the Reservation is confirmed, the Reservation is final. Guest does not have the right to cancel the Reservation, change travel dates, change the resort, change the room type, reduce the length of stay, substitute a different reservation, or otherwise modify the material terms of the Reservation.
Any request involving a material change to the Reservation may be declined in the sole discretion of DVC Marketplace, LLC, the Member, Disney Vacation Club, or the applicable resort. If a requested change is considered, it is subject to Disney Vacation Club rules, Member approval, availability, point requirements, and any additional costs or fees.
Non-material requests, such as noting a celebration, requesting a crib, or making other simple resort requests, may be submitted through DVC Marketplace, LLC when applicable. Such requests are not guaranteed and do not modify this Agreement or the confirmed Reservation.
Guest understands that failure to travel, late arrival, early departure, or non-use of the Reservation does not entitle Guest to a refund, credit, date change, replacement reservation, or other compensation.
8. Communications and Payments
Guest agrees that all payments, reservation communications, and requested changes related to this Reservation must be handled through DVC Marketplace, LLC unless otherwise directed in writing.
Guest understands that the Member is responsible for securing and maintaining the Reservation, but DVC Marketplace, LLC will coordinate communications, payment processing, documentation, and confirmation delivery for this transaction.
Guest agrees not to make separate payment arrangements directly with the Member for this Reservation unless expressly authorized in writing by DVC Marketplace, LLC.
9. Resort Rules and Guest Conduct
Guest agrees to comply with all Disney Vacation Club, Disney, and resort rules, policies, check-in requirements, occupancy limits, smoking policies, parking rules, pet policies, and conduct standards.
Guest is responsible for all charges, damages, incidentals, room charges, resort fees, parking charges, cleaning charges, policy violations, or other costs assessed during or resulting from Guest’s stay.
Guest agrees to reimburse the Member or Intermediary for any damages, charges, penalties, or costs assessed to the Member’s Disney Vacation Club account as a result of Guest’s stay, conduct, guests, invitees, or failure to comply with resort rules.
10. Chargebacks and Payment Disputes
Guest agrees not to initiate a chargeback, payment reversal, or payment dispute for a confirmed Reservation that has been properly secured and for which an official Disney confirmation number has been provided.
If Guest initiates an improper chargeback or payment dispute, Guest agrees to reimburse the Intermediary for the disputed amount, payment processor fees, chargeback fees, collection costs, and reasonable attorney’s fees where permitted by law.
11. Force Majeure
The Intermediary and Member are not responsible for cancellations, closures, interruptions, travel restrictions, weather events, hurricanes, natural disasters, illness, pandemics, government actions, transportation delays, park closures, resort limitations, or other events outside their direct control.
If the Reservation remains valid and available for Guest’s use, Guest is not entitled to a refund because Guest is unable or chooses not to travel.
12. Limitation of Liability
Guest acknowledges that the Intermediary acts only as an intermediary and does not own or control Disney Vacation Club, Disney resorts, Disney systems, Disney policies, transportation providers, airlines, weather conditions, or third-party services.
To the maximum extent permitted by law, Guest waives claims against the Intermediary and Member for indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to travel costs, lost vacation time, emotional distress, lost wages, airfare, tickets, meals, transportation, alternate accommodations, or other expenses incurred in connection with the Reservation.
Nothing in this Agreement limits liability that cannot legally be limited under applicable law.
13. Guest Acknowledgment
By signing or electronically accepting this Agreement, Guest acknowledges that Guest has read, understands, and agrees to this Agreement, including the non-refundable payment terms.
Guest further acknowledges that once DVC Marketplace, LLC provides the official Disney confirmation number, Guest’s payment is non-refundable and the Reservation is subject to Disney Vacation Club and resort rules.

By signing below, Guest confirms that Guest has read, understands, and agrees to this Point Use Rental Agreement, including the non-refundable payment terms. Guest further acknowledges that once DVC Marketplace, LLC provides the official Disney confirmation number, Guest’s payment is non-refundable and the Reservation is subject to Disney Vacation Club and resort rules.
