  • LIABILITY WAIVER, ASSUMPTION OF RISK, AND RELEASE — DOWNWARD DOG PUPPY YOGA

    By signing this document, I acknowledge and agree to the following terms. I understand this is a legally binding contract.

    1. ASSUMPTION OF RISK. I voluntarily participate in a puppy yoga session involving live animals and physical exercise. I knowingly assume all risks, including but not limited to: dog bites, scratches, jumping, knockdowns, allergen exposure (dander, saliva, fur), slipping, falling, strains, sprains, contact with animal waste, disease transmission, and damage to personal property.

    2. ALLERGEN ACKNOWLEDGMENT. I confirm I have disclosed any known dog allergies. I understand Downward Dog Puppy Yoga cannot provide an allergen-free environment, and I assume full responsibility for any allergic reaction.

    3. MEDICAL FITNESS. I represent that I am in good health and physically able to participate. I have no medical condition that participation would aggravate. If I am uncertain, I have consulted a physician.

    4. ANIMAL CONDUCT. I agree to follow all staff instructions regarding the animals. I will not pick up, chase, feed, or remove puppies from the activity area without staff permission. I understand staff may remove me from the session without refund if my conduct endangers the animals or other participants.

    5. ANIMAL BEHAVIOR. Animals are unpredictable. Downward Dog Puppy Yoga makes reasonable efforts to ensure animal health and temperament but cannot be held liable for injury or damage resulting from animal behavior.

    6. SANITARY CONDITIONS. I acknowledge that puppies may urinate, defecate, or vomit during sessions. I will not hold Downward Dog Puppy Yoga liable for contact with animal waste or any resulting illness.

    7. RELEASE OF LIABILITY — INCLUDING NEGLIGENCE. I HEREBY RELEASE, WAIVE, AND DISCHARGE DOWNWARD DOG PUPPY YOGA, ITS OWNERS, OFFICERS, EMPLOYEES, INDEPENDENT CONTRACTORS, VOLUNTEERS, AND AGENTS FROM ANY AND ALL CLAIMS, DEMANDS, ACTIONS, DAMAGES, LOSSES, OR LIABILITY OF ANY KIND ARISING FROM MY PARTICIPATION — INCLUDING CLAIMS BASED ON THE NEGLIGENCE OF DOWNWARD DOG PUPPY YOGA OR ITS OWNERS, EMPLOYEES, OR AGENTS. THIS RELEASE COVERS ALL INJURIES, ILLNESSES, AND PROPERTY DAMAGE, WHETHER NOW APPARENT OR LATER DISCOVERED.

    8. COVENANT NOT TO SUE. I agree not to file any lawsuit or claim against Downward Dog Puppy Yoga arising out of my participation.

    9. INDEMNIFICATION. I agree to indemnify, defend, and hold harmless Downward Dog Puppy Yoga from any claim, demand, or lawsuit brought by me, my family, or any third party on my behalf arising from my participation, including reasonable attorneys' fees.

    10. MEDICAL AUTHORIZATION. In an emergency, I authorize Downward Dog Puppy Yoga staff to seek medical assistance on my behalf, at my expense.

    11. PHOTO & VIDEO RELEASE. I grant Downward Dog Puppy Yoga permission to use any photographs or video taken during my visit for promotional, marketing, and social media purposes, worldwide, in all media now known or later developed, in perpetuity, without compensation — unless I opt out below.

    12. GOVERNING LAW. This agreement is governed by the laws of the State of Texas. Any dispute will be resolved in the state or federal courts located in Denton County, Texas.

    13. SEVERABILITY. If any provision is found unenforceable, the remaining provisions remain in full force.

    I HAVE READ AND UNDERSTOOD THIS WAIVER IN ITS ENTIRETY AND AGREE TO ITS TERMS VOLUNTARILY.
