  • Terms of Service 

    Please read these terms carefully before subscribing to Penelope's Garage. If you do not agree with these terms, you must refrain from subscribing.
  • 1. Subscription Overview
    Penelope’s offers a subscription-based member-only service ("Subscription Service") that primarily provides regular automotive maintenance and preventative services. By subscribing, you are considered a member, and will receive access to a variety of services, which may include:

    Routine maintenance (oil changes, fluid checks, etc.)
    Preventative services (tire rotations, brake inspections, etc.)
    Limited detailing services (as specified per plan)
    Loaner Vehicle during your service appointments (separate agreement to be filled out per use)

    Subscription details, including the specific services covered and pricing, are outlined on the “Subscription Agreement”. 

    2. Subscription Agreement
    Subscription Services are offered for an initial term of 3 months, beginning on the date you subscribe. The first payment will be processed on the day the subscription is activated, and subsequent payments will be due on the same day of each month.  Please refer to the “Subscription Agreement” further details and guidelines.

    3. Customer Responsibilities
    By subscribing to our service, you agree to:

    Provide Accurate Vehicle Information: Ensure that your vehicle's details (make, model, year, etc.) are accurate and up-to-date.

    Schedule Appointments: You agree to follow all manufacturer recommendations for vehicle maintenance and to attend scheduled maintenance appointments as required under your selected subscription plan.

    It is your responsibility to schedule and keep maintenance appointments. Failure to do so may result in a cancellation of your subscription service.

    Prompt Payment: Ensure your payment information is up-to-date and payments are made on time to avoid any late fees, service interruptions or cancellation.

    Cooperation During Services: Follow any instructions provided by Penelope’s regarding vehicle preparation for service (e.g., bringing the vehicle in at the appropriate time, ensuring it is safe to work on, etc.).

    4. Limitation of Liability
    Penelope’s is responsible for performing services in a professional and timely manner according to industry standards. However, Penelope’s is not responsible for:
    Pre-existing damage or conditions of your vehicle.

    Any issues caused by accidents, misuse, or improper vehicle handling after servicing.
    Damages caused by the Subscribers failure to follow manufacturer recommended maintenance.

    Any issues that arise unrelated to the services conducted.

    Damage to personal items left in your vehicle during the service.

    Delays in service due to factors outside our control, such as availability of parts or weather conditions.

    Issues arising from third-party products or services not provided directly by Penelope’s.
    Penelope’s liability is limited to the cost of the subscription or service provided, and we are not liable for any consequential or indirect damages.

    You are responsible for the condition of your vehicle and agrees to indemnify and hold harmless Penelope’s for any damages or issues arising from improper vehicle use, failure to maintain the vehicle as advised, or failure to follow safety instructions provided by Penelope’s.

    Failure to notify Penelope’s within 24 hours of service for immediate concerns may limit our ability to diagnose or address certain issues; however, applicable parts and labor warranties will remain subject to the terms and limitations outlined in Section 5.

    5. Warranties and Guarantees

    5.1 Limited Parts and Labor Warranty
    Penelope’s Garage warrants that any parts supplied and installed by Penelope’s will be free from defects in materials and workmanship for a limited period, subject to the terms outlined below. If a part installed by Penelope’s fails due to a manufacturing defect or improper installation during the applicable warranty period, Penelope’s will repair or replace the part at no additional cost to the Subscriber.

    5.2 Warranty Timeframes
    Unless otherwise stated in writing at the time of service, warranty coverage is as follows:

    Labor Warranty:
    Labor performed by Penelope’s Garage is warranted for 60 days or 2,000 miles, whichever occurs first.

    Parts Warranty:
    Parts supplied and installed by Penelope’s Garage are warranted for 90 days or 5,000 miles, whichever occurs first, unless the manufacturer provides a longer warranty.
    Some parts may carry manufacturer-specific warranties that differ in duration or coverage. In such cases, Penelope’s will pass through the applicable manufacturer warranty to the Subscriber when available.

    5.3 Warranty Exclusions
    This warranty does not cover failures or damage resulting from:
    Normal wear and tear
    Accidents, collisions, or external damage
    Abuse, misuse, neglect, or improper operation
    Failure to follow manufacturer-recommended maintenance
    Modifications or repairs performed by third parties after service
    Pre-existing conditions unrelated to the service performed
    Environmental factors (road hazards, corrosion, flooding, extreme conditions)
    Warranty coverage applies only to the specific part(s) replaced and does not extend to unrelated components or systems.

    5.4 Reporting Warranty Concerns
    Subscribers must notify Penelope’s Garage of any suspected warranty-related issue as soon as reasonably possible after discovery. For concerns immediately following service, Subscribers are encouraged to contact Penelope’s within 24 hours to allow prompt inspection and resolution.

    Failure to notify Penelope’s Garage within a reasonable timeframe, or continued operation of the vehicle after a suspected issue arises, may void warranty coverage.

    5.5 No Open-Ended Warranty
    Warranty coverage does not extend indefinitely. Parts or labor failures occurring months or years after installation, outside the applicable warranty period, are not covered. Penelope’s Garage makes no guarantees regarding the future performance or lifespan of any part beyond the stated warranty terms.

    5.6 Sole Remedy
    Repair or replacement of the defective part or labor, at Penelope’s Garage’s discretion, shall be the Subscriber’s sole and exclusive remedy under this warranty. No cash refunds or credits will be issued for warranty claims.

    6. Modifications to the Terms of Service
    Penelope’s reserves the right to modify these Terms of Service at any time. We will notify you of any material changes, and your continued use of the Subscription Service after changes have been made constitutes your acceptance of the new terms. If you do not agree to the modified terms, you may cancel your subscription.

    7. Privacy and Data Protection
    Penelope’s takes your privacy seriously. All personal information you provide to Penelope’s, including billing details and vehicle data, will be handled in accordance with our Privacy Policy. By subscribing to our service, you consent to the collection and use of your data as described in the Privacy Policy.

    8. Termination and Suspension
    Your subscription service with Penelope’s will begin on the date the subscription is activated, for an initial term of 3 months. Your subscription will automatically renew on a month-to-month basis unless terminated by either party in accordance with the terms indicated below:

    Cancellation by Subscriber: You may cancel your subscription after your initial term of 3 months by providing a written notice to Penelope’s within 30 days of your next billing cycle. Should you need to cancel your subscription during the initial term, you will be responsible for the remaining billing cycles of the initial term. Should you provide less than a 30 days’ notice you will be responsible for paying the next billing cycle.

    Cancellation by Provider: Penelope’s reserves the right to cancel your subscription at any time, with or without cause, by providing you with written notice. You will receive a pro-rated refund of your monthly subscription payment for the remaining days of the current billing cycle within 30 days of cancellation. You will not receive any refunds for services already provided.

    Failure to Maintain Payment: If you fail to maintain timely payment for three subsequent billing periods, Penelope’s reserves the right to suspend or cancel services.

    Misuse of Services: Engaging in illegal activities or misuse of our services may result in termination.

    Non-Utilization of Services: We reserve the right to cancel your subscription if you fail to adhere to recommended service appointments for standard maintenance on your vehicle, as outlined by the manufacturer. Failure to conduct regular maintenance may lead to the development of additional issues with your vehicle, which we may not be equipped to address or that could result in significant additional costs to you. It is your responsibility to ensure that your vehicle receives the necessary maintenance to avoid such complications.

    Violation of Terms: If you violate any of the terms outlined in this agreement or subsequent agreements, your subscription may be suspended or terminated.

    9. Governing Law and Dispute Resolution
    This Terms of Service and all relevant Agreements will be governed by and construed in accordance with the laws of the state of Ohio, without regard to its conflicts of law principles. Any disputes arising from or related to these terms shall be resolved through mediation or in the courts of Columbus, Ohio (Franklin County).

    We take the security of your personal information seriously. We implement reasonable administrative, technical, and physical safeguards to protect your data from unauthorized access, loss, or misuse. Payment information is processed securely using industry-standard encryption.

    4. Sharing Your Information
    We do not sell, rent, or lease your personal information to third parties. However, we may share your information with third-party service providers to process payments, communnicate, provide necessary services, or as required by law. These third parties are obligated to protect your information and use it solely for the purposes for which we engage them.

    5. Cookies and Tracking Technologies
    Our website may use cookies and similar tracking technologies to enhance your user experience, track website usage, and personalize content. You can choose to disable cookies in your browser settings, but this may affect your ability to use certain features of our website.

    6. Your Rights and Choices
    You have the right to access, correct, or delete your personal information. If you would like to update your information or have any concerns regarding your privacy, please contact Penelope’s.

    7. Data Retention
    We retain your personal information only for as long as necessary to fulfill the purposes outlined in this Privacy Policy or as required by law. Once your information is no longer needed, we will securely delete or anonymize it.

    Penelope's Garage reserves the right to update or modify this Privacy Policy at any time. You will be notified of any changes with an updated effective date. We encourage you to review this policy periodically to stay informed about how we are protecting your information.

  • Subscription Agreement

    This Subscription Agreement (the "Subscription Agreement") is made and entered into by and between Penelope’s Garage, a company with a principal place of business at 894 Scott St., Columbus OH 43222 (“Penelope’s”) and ­the "Subscriber" for the provision of auto maintenance and preventative services under a subscription model. By signing this Agreement, the Subscriber agrees to the terms and conditions outlined below.

  • 1. Services Provided
    Penelope’s agrees to offer the Subscriber a subscription to automotive maintenance and preventative services. The Subscriber’s monthly cost, exact services, and scope of the subscription will depend on the plan selected by the Subscriber, as outlined, and selected in this agreement.

  • The Subscriber is registering the following amount of vehicles under their subscription plan*
  • An estimate will be provided to the Subscriber, by Penelope’s, for any necessary vehicle service not priced out or specifically mentioned in the selected subscription plan. The final pricing and scope of all additional services will be approved by the Subscriber before any work is performed. Prices are non-negotiable.

    3. Term and Termination
    This Agreement will begin on the date the subscription is activated, for an initial term of 3 months, and will automatically renew on a month-to-month basis unless terminated by either party in accordance with the “Termination and Suspension” terms indicated in the Terms of Service.

    5. Subscription Plan Changes
    Penelope’s may update, modify, or discontinue any subscription plans at its sole discretion. Any changes to the subscription plan will be communicated to the Subscriber in advance. If the Subscriber does not agree with the changes, they may cancel their subscription as outlined in “Termination and Suspension” terms indicated in the Terms of Service.

    The Subscriber may update their subscription plan after the initial term by contacting Penelope’s.

    6. Payments and Billing Cycles

    Billing Cycle: The Subscriber’s first full payment is due on the day your subscription services are activated. Subsequent payments will be automatically charged on the same day of each following month that your services were activated. For example, if your subscription is activated on the 15th of February, your next payment will be charged on the 15th of March, and each subsequent payment will occur on the 15th of each following month. If the same day does not exist in a given month, your payment will be charged on the last day of that month.

  • Payment Methods: Penelope’s accepts payments via ACH, credit or debit card. Penelope’s, under specific circumstances, can accept payments via Venmo. We do not accept payments via Paypal, Zelle, or Cash App. You authorize Penelope’sto charge the primary card on file for any outstanding balances and subscription fees.
    Information on File: The Subscriber agrees to provide two valid credit or debit cards to be kept on file by Penelope's for payment purposes. In the event that the first card is declined, Penelope’s will charge the second card on file. If both payments fail, Penelope’s will contact you for valid/updated payment information. This payment information will be kept confidential and will not be shared with any third parties, except as necessary for processing payments or as required by law.

    Late Payments: If the Subscriber’s payment is not received within 7 days of the billing date, a late fee of $15 will be applied. Penelope’s reserves the right to waive the late fee due to death, illness, natural disasters, or other exceptional circumstances beyond the customer's control, at Penelope’s sole discretion, upon request and with appropriate documentation. Failure to make timely payments may result in suspension or termination of the Subscriber’s subscription.

    Outstanding Balances: Penelope’s reserves the right to refer any outstanding debt to a collection agency of its choosing if payment is not received within 90 days after the due date. You acknowledge that, in such event, additional fees may be incurred, and Penelope’s will not be liable for any actions taken by the collection agency.

  • Master Loaner Vehicle Agreement

    This Master Loaner Vehicle Agreement (“Agreement”) is entered into between Penelope’s Garage (“Company”) and the undersigned member (“Member”). This Agreement is incorporated into the Member’s Penelope’s Garage membership paperwork and applies each time the Company provides the Member with temporary use of a loaner vehicle.For purposes of this Agreement, “Loaner Vehicle” means any vehicle provided to the Member by Penelope’s Garage and identified through a checkout form, work order, electronic record, text message, email, or other written documentation. This Agreement remains effective throughout the Member’s membership unless replaced or terminated in writing.
  • 1. Purpose of Vehicle Loan
    Penelope’s Garage may provide the Member with temporary use of a Loaner Vehicle while the Member’s personal vehicle is undergoing inspection, maintenance, service, or repairs.

    Loaner vehicles are provided as a membership convenience. Availability is not guaranteed and remains subject to vehicle availability, driver eligibility, insurance requirements, and Company approval.

    2. Loaner Vehicle Checkout
    Each time a Loaner Vehicle is provided, Penelope’s Garage will create a checkout record identifying, as applicable:

    The Loaner Vehicle’s year, make, model, and license plate;
    The checkout date and expected return date;
    The odometer reading and fuel level;
    Existing damage or wear;
    The authorized mileage allowance; and


    Any additional conditions applicable to that particular loan period.

    Penelope’s Garage may take photographs of the Loaner Vehicle before releasing it to the Member. These photographs may document the odometer, existing wear and tear, fuel level, and interior and exterior condition.

    The Member is encouraged to take their own photographs at the time of pickup.

    3. Loan Period and Return
    The Loaner Vehicle must be returned by the date and time communicated by Penelope’s Garage, immediately upon completion of the Member’s vehicle service or repairs, or upon request by Penelope’s Garage, whichever occurs first.

    Penelope’s Garage may require the return or exchange of a Loaner Vehicle at any time.

    The Member must return the Loaner Vehicle to the location designated by Penelope’s Garage unless another return arrangement is approved in writing.

    4. Mileage Limit
    Unless otherwise stated in the applicable checkout record, the Loaner Vehicle includes a mileage allowance of 200 miles per authorized day.

    Any mileage exceeding the authorized allowance will be subject to an additional charge of $0.35 per mile.

    5. Insurance and Liability
    The Member acknowledges and agrees that the Member’s personal automobile insurance policy shall serve as the primary insurance coverage during each loan period, to the fullest extent permitted by applicable law and the terms of the applicable insurance policies.

    Any insurance maintained by Penelope’s Garage or the titled owner of the Loaner Vehicle shall serve as secondary or excess coverage in the event the Member’s insurance does not fully cover a claim, except where applicable law or the terms of an insurance policy require otherwise.

    The Member agrees to contact their insurance carrier and verify that their policy provides coverage for their operation of a temporary substitute, borrowed, non-owned, or loaner vehicle before taking possession of a Loaner Vehicle.

    The Member must maintain active personal automobile insurance throughout every loan period and provide Penelope’s Garage with current proof of insurance upon request.

    The Member is responsible for:

    Insurance deductibles;
    Uninsured or underinsured losses;
    Policy exclusions;
    Denied claims;
    Amounts exceeding available insurance coverage; and
    Damage or expenses not paid by an insurance carrier.

    In the event of an accident, damage, vandalism, or theft, the Member agrees to promptly notify both their insurance provider and Penelope’s Garage and to cooperate fully with any resulting claim, investigation, or legal proceeding.

    The Member authorizes Penelope’s Garage to contact the Member’s insurance carrier and provide relevant documents or information concerning the Loaner Vehicle, loan period, accident, damage, or claim.

    Ohio requires financial responsibility for operation of a motor vehicle, including when the driver is not the owner of that vehicle.

    6. Authorized Drivers
    Only the Member and any additional driver expressly approved by Penelope’s Garage may operate the Loaner Vehicle.

    Each authorized driver must:

    Be at least 18 years old;
    Hold a current and valid driver’s license;
    Maintain active automobile insurance applicable to their operation of the Loaner Vehicle; and
    Meet any additional eligibility requirements established by Penelope’s Garage or its insurance provider.

    The Member may not allow an unauthorized person to drive or otherwise take possession of the Loaner Vehicle.

    The Member remains responsible for the Loaner Vehicle and for any loss, claim, or damage caused by a person to whom the Member provides access.

    7. Conditions of Use
    The Member agrees to:

    Operate the Loaner Vehicle responsibly and lawfully;
    Use the Loaner Vehicle only for ordinary personal transportation;
    Follow all applicable traffic and parking laws;
    Secure the vehicle and safeguard its keys;
    Immediately notify Penelope’s Garage of any warning light, mechanical problem, or unsafe condition; and
    Stop operating the vehicle if continued operation could create a safety risk or cause additional damage.

    The Loaner Vehicle may not be used for:

    Ridesharing or delivery services;
    Racing or speed testing;
    Towing or pushing another vehicle or object;
    Driver training;
    Commercial transportation;
    Off-road operation;
    Any illegal activity; or
    Any other unauthorized or abusive purpose.


    The Loaner Vehicle may not be operated by anyone who is impaired by alcohol, marijuana, medication, or any other substance.

    Smoking and vaping are prohibited inside the Loaner Vehicle.

    8. Fuel, Cleanliness, and Vehicle Condition
    The Member must return the Loaner Vehicle in substantially the same condition in which it was provided, excluding ordinary wear and tear.

    The Loaner Vehicle must be returned with the same fuel level recorded at checkout. If additional fuel is required, the Member will be charged the cost of the fuel plus a $10 convenience fee.

    The Member may also be responsible for reasonable charges associated with:

    Excessive cleaning;
    Smoke or odor remediation;
    Stains or interior damage;
    Pet-related damage;
    Lost or damaged keys;
    Missing equipment or accessories; and
    Damage beyond ordinary wear and tear.


    9. Accidents, Damage, and Theft
    The Member must immediately notify Penelope’s Garage of any accident, collision, damage, vandalism, theft, impoundment, or police contact involving the Loaner Vehicle.

    When an accident occurs, the Member agrees to:

    Contact law enforcement or emergency services when appropriate;
    Obtain the other driver’s contact and insurance information;
    Photograph the vehicles, damage, and accident scene when safely possible;
    Obtain a police report or incident number when available;
    Avoid admitting fault or promising payment; and
    Cooperate with Penelope’s Garage, the vehicle owner, and all applicable insurance carriers.


    The Member may not authorize repairs, disposal, settlement, or release of the Loaner Vehicle without approval from Penelope’s Garage, except where immediate emergency action is reasonably necessary to protect people or property.

    10. Damage, Tickets, Tolls, and Other Charges
    The Member is responsible for any damage not covered by insurance, including applicable deductibles and non-covered events.

    The Member is responsible for all traffic citations, parking tickets, tolls, impound charges, towing charges, and other violations or expenses incurred during the loan period.

    The Member agrees to reimburse Penelope’s Garage for these amounts and any reasonable administrative expenses incurred in identifying the responsible driver, responding to the charge, or recovering the Loaner Vehicle.

    11. Indemnification
    To the fullest extent permitted by law, the Member agrees to indemnify and hold harmless Penelope’s Garage, its owners, employees, agents, affiliates, and the titled owner of the Loaner Vehicle from claims, damages, liabilities, penalties, expenses, or losses arising from:

    Misuse or unauthorized use of the Loaner Vehicle;
    Operation by an unauthorized driver;
    The Member’s violation of this Agreement;
    The Member’s violation of applicable law; or
    Inaccurate information provided concerning the Member’s driver’s license, insurance, or eligibility.


    12. Driver’s License and Insurance Records
    The Member agrees to provide Penelope’s Garage with:

    A copy or photograph of the Member’s valid driver’s license;
    Current automobile insurance information; and
    Updated documentation whenever the Member’s license or insurance information changes or expires.

    The Member authorizes Penelope’s Garage to securely retain this information for identification, vehicle-loan, insurance, and claims-related purposes during the membership and any applicable loan period.

    Failure to maintain a valid driver’s license or active automobile insurance will immediately suspend the Member’s eligibility to receive or operate a Loaner Vehicle.

    13. Continuing Effect
    This Agreement applies to every Loaner Vehicle provided to the Member. The Member will not be required to sign a new complete agreement for each vehicle, but Penelope’s Garage may require the Member to sign or electronically acknowledge a vehicle-specific checkout record.

    The Member’s responsibilities concerning insurance, damage, reimbursement, tickets, tolls, claims, and indemnification survive the return of the Loaner Vehicle and the termination of membership.

     

  • Acknowledgment and Agreement
    By signing below, the Member acknowledges and agrees that:

    They have read and agree to this Master Loaner Vehicle Agreement;
    Their personal automobile insurance is intended to serve as primary coverage during each loan period, to the fullest extent permitted by law and the applicable policies;
    They are responsible for deductibles, exclusions, uninsured losses, denied claims, and damage not paid by insurance;
    They will not allow an unauthorized driver to operate a Loaner Vehicle;
    They will maintain a valid driver’s license and active automobile insurance; and
    These terms apply each time they accept possession of a Loaner Vehicle from Penelope’s Garage.
