1. Booking Conformation
Upon booking into a Sticky Fingers Kitchen cooking course, you will receive a written confirmation to secure your place.
2. Cancellations and Course Fees
By confirming a booking, the participant or responsible person/business agrees to pay the full course fee, even if the participant does not attend or complete the full course due to illness (including COVID-19) or personal reasons, unless otherwise required under Australian Consumer Law.
Cancellations made less than five (5) days before the course start date will incur the full course fee, except in exceptional or compassionate circumstances (e.g., medical emergencies) at Sticky Fingers Kitchen's discretion.
3. Invoicing and Payment Terms
An invoice will be issued upon course completion and is payable within seven (7) days.
A grace period of ten (10) business days will apply after the due date. After this period, a 10% late fee (before tax) may be applied monthly until the balance is settled.
In case of prolonged non-payment, Sticky Fingers Kitchen reserves the right to recover outstanding amounts in accordance with applicable laws.
4. NDIS Funding and Eligibility
To participate, the participant must be registered with the NDIS and have sufficient funding available in their NDIS Plan under "Development of Daily Living and Life Skills", "Increased Social and Community Participation", or an equivalent category.
It is the responsibility of the participant or their plan manager to ensure adequate funding is available prior to booking. Any shortfall in funding remains the responsibility of the participant or their nominee.
5. Participants Under 18 Years of Age
Participants under the age of 18 will remain under the care and supervision of Sticky Fingers Kitchen staff while attending classes or activities.
6. Work Health and Safety (WHS)
Sticky Fingers Kitchen is committed to complying with all relevant Work Health and Safety (WHS) legislation, Australian Standards, and Codes of Practice.
Participants must:
- Wear closed-toe shoes during all cooking activities
- Follow all reasonable safety instructions
- Take responsibility for their own safety and ensure their actions do not endanger others
Non-compliance with safety instructions may result in restricted participation or removal from the activity.
7. Behaviour and Conduct
Aggressive, discriminatory, or inappropriate behaviour will not be tolerated. Sticky Fingers Kitchen reserves the right to remove any participant from classes or activities in accordance with its Behaviour Management and Incident Response policies.
Support workers or carers may be requested to assist if additional supervision is required.
8. Transport Services
If transport is provided by Sticky Fingers Kitchen, cancellations must be made at least four (4) hours before the scheduled pick-up time.
Cancellations made with less than four hours’ notice will incur the full transport charge.
While being transported by Sticky Fingers Kitchen, participants agree to follow all safety instructions and remain under the supervision of staff for the duration of travel.
9. Competency and Supervision
Participant competency and supervision requirements will be reviewed regularly to ensure safety and appropriate support. Sticky Fingers Kitchen may adjust supervision levels or course participation requirements as needed.
10. Safety and Duty of Care
Sticky Fingers Kitchen has implemented a Safety Management Plan and associated policies and procedures to promote a safe learning environment.
All workers, contractors, and participants are expected to cooperate with these policies and to act in ways that support the health, safety, and well-being of all attendees.
11. Disclaimer
These Terms and Conditions are designed to ensure participant safety, fairness, and compliance with NDIS and WHS standards.
Sticky Fingers Kitchen reserves the right to amend these terms with reasonable notice. Nothing in this agreement limits the participant’s rights under the NDIS Code of Conduct or the Australian Consumer Law (ACL).
