To ensure a safe, positive, and enjoyable environment for all participants, students enrolled in Minds and Motion programs and their respective parents/ guardians are required to follow our Code of Conduct:
  • 1. SHOW RESPECT
    Treat instructors, staff, and fellow participants with kindness and respect at all times. Bullying, teasing, or other disrespectful behavior will not be tolerated and handled pursuant to Minds and Motion's Discipline and Behavior Policy and our Respect and Anti-Bullying Policy.
  • 2. FOLLOW INSTRUCTIONS
    Students must listen to and follow all directions given by instructors to ensure activities run smoothly and safely.
  • 3. PRACTICE SAFE PLAY
    Use equipment appropriately and participate in activities safely as described in Minds and Motion's Safety Rules for Physical Activity Policy. Participants must always follow instructor guidance while running and jumping, and during other vigorous movements.

  • 5. SUPPORT A POSITIVE ENVIRONMENT

  • Students are expected to contribute to a fun, inclusive, and supportive atmosphere where everyone feels welcome and able to participate. Parents/guardians are also expected to be encouraging to all students and treat all students, staff and other parents/guardians with courtesy and respect.
  • Discipline and Behavior Policy

  • Our goal is to provide a positive, safe, and encouraging environment where all participants can learn, move, and enjoy physical activity. To ensure a successful experience for everyone, students are expected to follow instructions, treat instructors and other participants with respect, and demonstrate safe behavior during all program activities.
  • If a student demonstrates unsafe, disruptive, or disrespectful behavior, the following steps may be taken:
  • 1. Verbal Reminder: The instructor will remind the student of the expected behavior and provide an opportunity to correct the behavior.
  • 2. Warning: If the behavior continues, the student will receive a clear warning and may be asked to sit out briefly from the activity.
  • 3. Parent/Guardian Notification: If the behavior persists, the parent or guardian may be informed and asked to assist in addressing the behavior.
  • 4. Removal from Activity: Continued unsafe or disruptive behavior may result in the student being removed from the activity for the remainder of the class session.
  • For serious safety concerns or repeated behavior issues, Minds and Motion reserves the right to dismiss a participant from the program. In such cases, refunds will not be issued. Our priority is maintaining a safe and respectful environment for all students, instructors, and families participating in the program.

  • Safety Rules for Physical Activity Policy

  • Participation in Minds and Motion programs involves active physical movement including running, jumping, throwing, and other physical activities. To ensure a safe environment for everyone, students are expected to follow all safety instructions provided by instructors.
  • Participants must:
    • Follow instructor directions at all times
    • Use equipment only as instructed
    • Keep hands and feet to themselves unless part of the activity
    • Demonstrate good sportsmanship and safe play
    • Immediately report any injury or unsafe condition to the instructor
  • Students who repeatedly ignore safety instructions or engage in unsafe behavior may be asked to sit out of activities or be removed from the class session. Our instructors prioritize safety and will modify activities when needed to maintain a safe and supportive environment for all participants.
  • Respect and Anti-Bullying Policy

  • Minds and Motion is committed to providing a safe, inclusive, and respectful environment for all participants. Bullying, teasing, intimidation, or exclusionary behavior of any kind will not be tolerated. Students and their parents/guardians are expected to treat instructors and other students with kindness, respect, and good sportsmanship at all times. This includes using appropriate language, following directions, and supporting a positive team environment.
  • If bullying or disrespectful behavior occurs, instructors will address the situation promptly. Parents/guardians may be notified if behavior continues or becomes problematic for other students, instructors or the program. Repeated or serious incidents may result in removal from the activity or dismissal from the program without a refund. Our goal is to foster confidence, teamwork, and positive social interaction through physical activity.

  • Payment must be submitted by June 1st 2026 to hold a child's place in class. Parent/ Guardian agrees to provide proof of payment by sending a screenshot confirmation via email or text.
  • Responsibility to Pay

  • By registering or attending class, the parent/guardian agrees to pay all program fees. Failure to pay may result in refusal of service.
  • Refund Policy

  • Refund requests submitted before the first scheduled day of class are eligible for a refund of the registration fee minus any non-refundable payment processing or transaction fees incurred at the time of registration. Once the first scheduled class session has begun, no refunds will be issued for any reason, including but not limited to: withdrawal from the class, scheduling conflicts, travel, missed classes, or changes in personal circumstances. Enrollment secures a student's place in the class and allows us to plan staffing, space, and materials in advance. For this reason, refunds cannot be granted after the program has started.

  • ASSUMPTION OF RISK, RELEASE AND WAIVER OF LIABILITY, INDEMNIFICATION AND MEDICAL AUTHORIZATION FOR MINOR PARTICIPANTS

  • In consideration for my minor child's being permitted to participate in any classes and activities organized by Minds and Motion LLC including but not limited to physical education classes, sports instruction, games, drills, and other related activities (the "Activities"), I, as the minor child's parent or legal guardian agrees to the following on behalf of myself and my minor child(ren) participating in Minds and Motion's Activities ("Participant"), and our respective heirs, executors, administrators, assigns, hereby agree as follows:
  • Agreement to Follow Directions

  • Participants agree to follow all rules, warnings, and instructions provided by Minds and Motion LLC staff, instructors, or representatives.
  • Assumption of Risk

  • Participation in physical education and sports activities involves inherent risks that cannot be completely eliminated regardless of the care taken to avoid injuries. I understand and acknowledge that participation in the Activities involves inherent risks and dangers, including but not limited to: falls, collisions with other participants or objects, injuries from equipment or

  • environmental conditions, sprains, fractures, concussions, heat-related illnesses, emotional or psychological harm, serious bodily injury, permanent disability, paralysis, and even death. These risks may arise from the Participant's own actions or fitness level, the actions or negligence of others (including other participants, instructors, or volunteers), the condition of the facilities or equipment, slippery or uneven playing surfaces, environmental or weather conditions, physical exertion or the rules of an activity itself. I voluntarily assume all such risks on behalf of the Participant, and I agree that the Participant may participate despite these risks.
  • Release and Waiver of Liability

  • I hereby release, waive, discharge, and agree not to sue Minds and Motion LLC, its owners, officers, directors, employees, instructors, volunteers, agents, affiliates, sponsors, and any other persons or entities associated with the Activities (collectively, the "Released Parties") from any and all liability, claims, demands, actions, or causes of action whatsoever, whether known or unknown, arising out of or related to any loss, damage, injury (including death), or property damage that may be sustained by the Participant or me while participating in the Activities, or while traveling to or from the Activities.
  • Indemnification

  • I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, lawsuits, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to the Participant's involvement in the Activities, including any claims brought by or on behalf of the Participant, me, or any third party.
  • Medical Authorization and Responsibility

  • I represent that the Participant is in good physical health and has no medical condition that would prevent safe participation. In the event of any injury or illness, I authorize Minds and Motion LLC and its staff to seek emergency medical treatment for the Participant and agree to be fully responsible for all related medical expenses. I confirm that I have adequate health/ medical insurance coverage for the Participant.

  • ADDITIONAL POLICIES AND INFORMATION Parent/Guardian Presence Policy

  • For the safety of all Participants, a parent, guardian, or responsible adult must remain on-site and available during the entire duration of the class session, unless the specific program or event has been specifically designated by Minds and Motion as a drop-off program.
  • Parents/guardians are responsible for:
    • Ensuring their child arrives safely to the class area
    • Remaining within the park or facility during the class session when required
    • Being available in case of emergency or behavioral concerns
    • Supervising their child immediately before and after class
    • Supervise siblings or other children in their care not enrolled in Minds and Motion programs
  • Minds and Motion instructors are responsible for conducting the class session for the benefit of Participants only and are not responsible for supervising children outside of scheduled program times unless the program has been specifically designated as a drop-off program. If a parent, guardian, or responsible adult is not present when required for a particular class or program, Minds and Motion reserves the right to deny a Participant's participation for that session.

  • Heat Safety Policy- For Outdoor activities

  • Because Minds and Motion classes often take place outdoors in Arizona, we prioritize heat awareness and Participant safety during all physical activities.
  • Hydration:

  • Participants must bring their own water bottle to every class. Students will be given regular water breaks during activities.
  • Activity Modifications

  • When temperatures are high, instructors may:

    • Utilize shaded areas when available
    • Adjust lesson plans to prioritize safety
  • Safety decisions will be made at the discretion of the instructor or program leadership. Parents/guardians are responsible for ensuring their child arrives hydrated and prepared for outdoor activity.
  • Weather Policy

  • Because classes are held outdoors, weather conditions may occasionally impact scheduled sessions. Classes may be modified, delayed, or cancelled due to unsafe conditions including but not limited to:
    • Extreme heat
    • Lightning
    • Heavy rain
    • Poor air quality
    • Unsafe field or park conditions
  • If a class must be cancelled due to weather, parents will be notified via one or more of the following methods:
    • Email
    • Text message
    • Program communication platform (if applicable)
  • Make-Up Classes

  • When possible, Minds and Motion may attempt to schedule make-up classes, though make-ups are not guaranteed due to park availability, instructor schedules, and other factors. No refunds will be issued if a make-up class is not scheduled.
  • Illness Policy

  • Participants who have a fever, contagious illness, or significant symptoms of illness should remain home. If a child becomes ill to any drop-off program, a parent or guardian will be contacted and must arrange prompt pickup.

    • Closed-toe tennis shoes
    • Modest clothing that covers undergarments and private areas This policy promotes respect for oneself and others.
  • If students do not attend class with the appropriate attire they may be asked to sit out.
  • Photo and Video Release

  • Participation is voluntary and at the parent/guardian's discretion.
  • Parent/guardian grants permission for Minds and Motion LLC to use photographs or videos of Participants for:
    • Promotional materials
    • Advertising
    • Educational purposes
    • Social media
    • Website content
  • Participants may be photographed during classes.
  • Force Majeure

  • Minds and Motion LLC shall not be liable for delays, cancellations, or program interruptions caused by events beyond its control including:

  • The parties agree to attempt to resolve disputes through good-faith negotiation and mediation before pursuing other legal remedies.

  • DROP-OFF PROGRAM POLICY (APPLICABLE TO DESIGNATED PROGRAMS ONLY)

  • Certain Minds and Motion programs, such as summer camps, specialty workshops, or designated events, may operate as drop-off programs. These programs will be clearly identified in program descriptions.
  • For these programs, the following policies apply:
  • Check-In and Check-Out Procedures

  • Parents or guardians must sign their child in and out of the program each day. Only the parent/ guardian or an authorized adult listed on the registration form may pick up the child.
  • If someone not listed on the registration form will be picking up a child, the parent/guardian must notify Minds and Motion staff in advance in writing. Staff may request photo identification before releasing a child to an authorized individual. Participants may be asked to wear labeled wristbands during the duration of the drop off program.
  • Arrival and Pick-Up Times

  • Participants should arrive no earlier than the designated check-in time and must be picked up promptly at the scheduled end time.
  • Late pick-ups may result in:
    • Additional supervision fees
    • Loss of participation privileges if repeated
