Please read it thoroughly, sign and Click Submit below to return this signature page to 314 TSM. This is required for you to participate in the tour. If your signed form is not received at least 30 days prior to departure (or immediately upon registering if less than 30 days prior to departure), 314 TSM has the right to consider your reservation cancelled.
314 TSM TOUR TERMS & CONDITIONS
These Terms & Conditions constitute a legally binding agreement between:
314 Tourism LLC d/b/a 314 TSM (“314 TSM”)
and
the tour participant (“Participant”).
By submitting a deposit or participating in the tour, the Participant acknowledges that they have read and agreed to be bound by these Terms and Conditions.
1. Role of the Tour Operator
314 TSM organizes and coordinates group travel experiences.
314 TSM acts solely as an intermediary for travel services provided by independent third-party suppliers
including:
• hotels
• transportation companies
• restaurants
• breweries
• guides
• event organizers
• attractions
These suppliers are independent contractors and are not employees or agents of 314 TSM.
2. Tour Price Includes
Unless otherwise stated in the itinerary, the tour price includes:
• accommodations during the tour (double occupancy unless noted, single supplement applies)
• ground transportation during the tour
• guided sightseeing activities
• brewery visits and tastings listed in the itinerary
• tour leader services
• meals listed in the itinerary
• taxes on included services
3. Tour Price Does Not Include
The tour price does not include:
• airfare or transportation to/from the tour start location
• airport transfers unless specifically listed
• travel insurance
• passport or visa fees
• meals not listed in the itinerary
• beverages except where included
• gratuities for guides or drivers
• personal expenses
4. Reservations and Payment
Tour Prices are per person and based upon shared twin room occupancy.
A deposit of $1000 per person is required to secure a reservation.
Final payment is due 90 days prior to departure.
Bookings made within 90 days of departure require full payment at booking.
Failure to pay by the required deadline may result in cancellation of the reservation.
5. Cancellation Policy
All cancellations must be submitted in writing.
Cancellation penalties apply as follows:

You will receive a refund of all payments made to date, minus the applicable cancelation fee listed above. Refunds will be processed 30 days after our receipt of your written cancellation.
6. Cancellation by 314 TSM:
We reserve the right to cancel a tour due to insufficient sign-up, or any other reason. If a tour is canceled due to insufficient signups, we will notify you at least 30 days prior to the start of the tour. In this case, you will receive a refund of all payment made to date.
Refund of payments made constitutes full settlement, and releases 314 TMS from any further liability. 314 TSM is not responsible for any additional expenses incurred by tour participants preparing for a canceled tour, such as nonrefundable airline tickets or passport fees.
If a tour is canceled due to natural disaster, strike, or other event outside our control, 314 TSM shall not be held responsible.
Any cancellations by guests made prior to a cancellation by 314 TSM will remain in penalty and will not receive any further reimbursements or refunds.
7. Itinerary Changes
314 TSM reserves the right to modify the itinerary when necessary due to circumstances beyond its
control including:
• weather
• operational requirements
• supplier availability
• safety considerations
Comparable alternatives will be provided whenever possible. No refund is given for any part of the tour
in which you choose not to participate.
8. Participant Requirements
Participants must:
• be at least 21 years of age
• be physically capable of participating in tour activities
• follow the instructions of tour leaders
9. Alcohol Responsibility
This tour includes brewery visits and Oktoberfest experiences where alcohol is served.
Participants are responsible for their own alcohol consumption.
314 TSM reserves the right to remove any participant whose behavior becomes disruptive or unsafe.
No refund will be issued if removal occurs.
10. Travel Documents
Participants are responsible for obtaining required travel documents including passports and visas.
Passports should be valid for at least six months beyond the end of the tour.
11. Limitation of Liability
314 TSM shall not be liable for:
• acts or omissions of third-party suppliers
• travel delays
• lost luggage
• injuries occurring during travel
12. Limitation of Damages
To the fullest extent permitted by law, the maximum liability of 314 Tourism LLC d/b/a 314 TSM shall not
exceed the total amount paid by the participant for the tour.
314 TSM shall not be liable for:
• indirect damages
• consequen.al damages
• emotional distress
• loss of enjoyment
13. Force Majeure
314 TSM shall not be liable for delays or cancellations caused by events beyond its control including:
• natural disasters
• pandemics
• strikes
• government actions
• acts of war or terrorism
14. Dispute Resolution
Any dispute arising from participation in the tour shall be resolved through binding arbitration under the
rules of the American Arbitration Association.
Arbitration shall occur in Clark County, Nevada, USA.
Participants waive the right to a jury trial.
15. Class Action Waiver
Participants agree that any dispute shall be resolved individually and not as part of a class action.
16. Governing Law
This Agreement shall be governed by the laws of the State of Nevada.
