EMPIRE WATER SPORTS – PONTOON RENTAL AGREEMENT & LIABILITY WAIVER

1. RENTAL TERMS
Renter agrees to rent the pontoon boat from Empire Water Sports for the agreed time period. A minimum rental of four (4) hours is required. Renter agrees to return the boat in the same condition as received, excluding normal wear and tear.

2. PAYMENT & DEPOSIT
Renter agrees to pay $100 per hour with a 4-hour minimum. A security deposit of $____250____ is required prior to departure and may be used to cover damages, late returns, or violations.

3. OPERATION OF VESSEL
Renter agrees that:

The boat will be operated safely and responsibly at all times
No reckless, illegal, or negligent behavior will occur
The operator must be at least ___ years old and legally allowed to operate a watercraft
All passengers will follow safety rules and instructions

4. ALCOHOL POLICY
Alcohol is permitted at renter’s own risk. The operator of the vessel must NOT be under the influence of alcohol or drugs at any time while operating the boat.

5. DAMAGE & LOSS
Renter is fully responsible for:

Any damage to the pontoon boat
Lost, stolen, or damaged equipment
Any excessive cleaning fees if returned in poor condition

6. ASSUMPTION OF RISK
Renter understands that boating and water activities involve inherent risks including injury, death, drowning, collisions, and environmental hazards. Renter voluntarily assumes all risks associated with the rental and use of the pontoon boat.

7. LIABILITY WAIVER & RELEASE
To the fullest extent permitted by law, Renter agrees to release, waive, and discharge Empire Water Sports, its owners, employees, and affiliates from any and all liability, claims, demands, or causes of action arising out of or related to:

Personal injury
Property damage
Loss or theft of personal items
Accidents or incidents occurring during the rental period
Death or serious injury
This includes any claims resulting from ordinary negligence.

8. INDEMNIFICATION
Renter agrees to indemnify and hold harmless Empire Water Sports from any claims, damages, legal fees, or liabilities arising from renter’s use of the pontoon boat.

By signing below, renter acknowledges that they have read, understood, and agree to all terms of this agreement and voluntarily accept all risks.
