Pets with Wings, Inc.

understand that I will be working as a volunteer for Pets with Wings, Inc. (hereinafter "PWW"). I understand that I will have direct physical contact with the animals at the Humane Society of St. Thomas shelter (hereinafter "shelter"), during transport to/from the shelter or in my home as a foster parent for an animal and that such contact carries inherent risks of injury and damage to me personally. I will obey any and all instructions given to me by official staff of PWW and I will carefully read all messages pertaining to each animal with which I have contact.

I acknowledge that my presence at the shelter, during transport to/from the shelter and/or in my home as a foster parent carries the potential for accidental injury, illnesses and/or property loss. The risks include, but are not limited to, those caused by the condition of the facility, injury or illness as the result of general or direct contact with animals, the actions of other people and/or vehicles. I hereby assume all risks of acting as a volunteer for PWW.

I understand that if I am involved in an accident or injury while volunteering for PWW, I may be subject to a drug test.

I acknowledge that this Volunteer Accident Waiver and Release of Liability form will be used by PWW, employees, volunteers, representatives, agents, and others working on behalf of PWW, and that it will govern my actions and responsibilities.

In consideration of my participation as a volunteer, I hereby take full responsibility for my actions, and hereby direct my executors, administrators, heirs, next of kin, successors, and assigns to:

A. Waive, release, and discharge PWW employees, volunteers, representatives, agents, Board of Directors, veterinarians, and others working or acting on behalf of PWW from any and all liability for death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter accrue to me, including my related travel to and from volunteering for PWW activity; and

B. To the fullest extent permitted by law, hold harmless the entities or persons mentioned above from any and all liabilities or claims made by other individuals or entities as a result of or relating to my participation as a volunteer.

I hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during my participation as a volunteer.

I further agree that I will defend, indemnify, and hold harmless PWW officers, directors, members, agents, employees, volunteers, and veterinarians against all claims, demands, and causes of action including court costs and attorney's fees, directly or indirectly arising from any action or other proceeding brought by or prosecuted for my benefit contrary to this release extended to all claims of every kind and nature whatsoever whether known or unknown and expressly waive any benefits.

I hereby certify that I have read this document and understand and agree to its content.

The waiver protects Pets with Wings from claims by requiring volunteers to:

1. Waive, release, and discharge liability: Volunteers agree to release Pets with Wings, its employees, volunteers, representatives, agents, Board of Directors, and veterinarians from any liability for death, disability, personal injury, property damage, theft, or other actions that may occur during their participation as a volunteer, including while traveling to and from the activity.

2. Assume all risks: Volunteers acknowledge the inherent risks of working with animals and at the shelter, or on transport, including potential injuries, illnesses, or property damage, and agree to take full responsibility for these risks.

3. Hold harmless: Volunteers agree to protect Pets with Wings and its affiliates from any liabilities or claims made by other individuals or entities as a result of their participation.

4. Indemnify Pets with Wings: Volunteers agree to defend, indemnify, and hold Pets with Wings harmless against all claims, demands, and legal actions, including court costs and attorney's fees, that may arise from their participation.

By signing the waiver, volunteers legally accept these terms, significantly limiting Pets with Wings liability in case of accidents, injuries, or other claims.
