I understand that participating in the Japantown Farmer’s Market “Doggie Valet” involves inherent risks, including the risk of injury to people, animals, or property.
In consideration for allowing my pet to participate, I (on behalf of myself, my pet(s), and any minor(s) in my care) agree to waive, release, and hold harmless the following parties:
- Japantown Farmer’s Market
- Japantown Business Association
- Gordon Biersch Brewery
- The City of San José
Their respective owners, officers, employees, volunteers, agents, and representatives
from any and all claims, demands, damages, liabilities, costs, or expenses (including attorneys’ fees) arising out of or related to participation in this event, including any injury, illness, damage, loss, or death caused in whole or in part by my actions, my pet(s), or event volunteers.
Indemnification
I agree to indemnify, defend, and hold harmless the above-listed parties from any claims, liabilities, damages, losses, or expenses arising out of or related to my participation or my pet’s participation.
Responsibility for Pet
I accept full legal and financial responsibility for my pet(s) at all times during the event at Gordon Biersch Brewery. I am solely responsible for any injury or damage caused by my pet(s), including behavior such as biting, jumping, scratching, chasing, or other aggressive or disruptive actions.
Escape or Loss
I understand there is a risk my pet(s) may escape, become lost, or run away, including while under the temporary care of volunteers. I assume all such risks and agree the released parties are not liable for any loss, even if it occurs while my pet is in their care.
Volunteer Role
I understand that Doggie Valet volunteers are not professional animal handlers. Any assistance they provide is voluntary and at my own risk, and they are not responsible for my pet’s control, behavior, or safety.
Dog Interactions
I understand my pet(s) may interact with other animals and I assume all risks associated with those interactions, including injury, illness, or aggressive behavior. I accept full responsibility for any resulting damage or injury.
Health & Safety
I certify that my pet(s) are in good health and current on all vaccinations, including rabies. I understand that unsafe or aggressive behavior may result in removal from the event.
Event Rules
I agree that:
- My pet(s) will remain on leash at all times in the Doggie Valet
- My pet’s restraint is my responsibility, not the volunteers’
- I will clean up after my pet(s)
- I will follow all staff instructions and posted rules
- Failure to comply may result in removal from the event
Media Release
I grant permission to Japantown Farmer’s Market and its partners to use photos or recordings of me and/or my pet(s) for promotional purposes without compensation.
Acknowledgment
I have read and understand this agreement. I understand that I am giving up substantial legal rights, including the right to sue, and I sign this voluntarily.
