In agreeing to participate in the creation of artwork throughout Clayton County on behalf of Clayton County Tourism Authority, Clayton County Convention & Visitors Bureau, and Arts Clayton (collectively, the "County"), I,

agree as follows:

I fully understand and acknowledge that: (a) inherent risks, dangers, and hazards and such exist in the use of equipment and participation in creating artwork within the County; (b) my participation in such and/or use of equipment may result in injury or illness, including but not limited to bodily injury, disease, strains, fractures, partial and/or total paralysis, death or other ailments that could cause serious disability; (c) these risks and dangers may be caused by the negligence of the representatives, employees, or volunteers of the County, of private property owners contracting with the County to allow for the creation of artwork on said property, and/or my own agency, amongst others, as well as the negligence of other participants in any contracted projects, the negligence of others unrelated to any contracted projects, accidents, breaches of contract, or other causes; (d) by my participation in these activities and for use of equipment, I hereby voluntarily assume all risks and dangers and all responsibilities for any losses and/or damages whether caused in whole or in part by the negligence or the conduct of the representatives, employees, or volunteers of the County or by any other person.

In consideration of the County granting me permission to create artwork on select private property contracted with the County and/or property of the County itself, I, on behalf of myself, my personal representatives and my heirs or assigns, hereby voluntarily agree to release, waive, discharge, covenant not to sue, defend, indemnify and hold harmless the County, its affiliates, subsidiaries, successors and assigns of each of its respective officials, present or former employees, volunteers, representatives and agents from any and all claims, demands, actions, losses and liabilities of any nature that I or anyone else may assert now or in the future including but not limited to claims for bodily injury, property damage, wrongful death, illness, loss of services or other damage or loss sustained in connection with my use of any equipment or participation in these activities, including claims based on negligence.

I specifically understand that I am releasing, discharging, and waiving any claims or inactions that I may have presently or in the future for the negligent acts or other conduct by the representatives, employees, and volunteers of the County. I also agree to indemnify and hold the County harmless from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorney's fees brought as a result of my involvement in activities in the County related to the creation of artwork through contracted projects. I expressly agree that the foregoing waiver and assumption of risks is intended to be as broad and inclusive as is permitted by the law of the State of Georgia and that if any portion thereof is invalid, it is agreed that the balance shall continue in full legal force and effect.
