    Plain language summary: This document says you understand that firearms training involves real risk. You agree not to do anything stupid — don't shoot yourself, anyone else on the range, or most importantly, your instructor. We're serious about safety and so are you.

  • ASSUMPTION OF RISK

  • I AM AWARE AND UNDERSTAND THAT THE ACTIVITIES ARE DANGEROUS AND INVOLVE THE RISK OF SERIOUS INJURY, DEATH, AND/OR PROPERTY DAMAGE. I ACKNOWLEDGE THAT I AM VOLUNTARILY PARTICIPATING WITH KNOWLEDGE OF THE DANGER INVOLVED AND HEREBY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS OF INJURY, DEATH, OR PROPERTY DAMAGE, WHETHER CAUSED BY THE NEGLIGENCE OF THE MEMBER OR OTHERWISE.

  • RELEASE OF LIABILITY

  • I hereby expressly waive and release any and all claims, now known or hereafter known, against GunJitsu / W2 Training & Firearms, its officers, directors, employees, agents, instructors, volunteers, and assigns (collectively, 'Releasees'), on account of injury, death, or property damage arising out of or attributable to my participation in the Activities, whether arising out of the negligence of the Member or any Releasees or otherwise. I covenant not to make or bring any such claim against the Member or any Releasee, and forever release and discharge the Member and all other Releasees from liability under such claims.

  • INDEMNIFICATION

  • I shall defend, indemnify, and hold harmless the Member and all other Releasees against any and all losses, damages, liabilities, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable attorney fees, arising out of or related to any third-party claim alleging bodily injury, death, or property damage caused by my negligence or willful misconduct in connection with my participation in the Activities.

  • ARBITRATION

  • Any controversy or claim arising out of or relating to this Agreement shall be determined by final and binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The place of arbitration shall be the State of Florida, in the county where the incident occurred. The arbitrator shall have no authority to award punitive or consequential damages.

  • JURY TRIAL WAIVER

  • I IRREVOCABLY AND UNCONDITIONALLY WAIVE, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANY RIGHT I MAY HAVE TO A TRIAL BY JURY IN ANY LEGAL ACTION ARISING OUT OF OR RELATING TO MY PARTICIPATION IN THE ACTIVITIES. I CERTIFY THAT I MAKE THIS WAIVER KNOWINGLY AND VOLUNTARILY.

  • CONDUCT AND SAFETY

  • I acknowledge that I have read, understand, and will abide by all GunJitsu safety rules, range rules, and instructor instructions, whether written, posted, or communicated verbally. If the instructor believes I am or will be unsafe, dangerous, or involved in criminal activity, I may be expelled from the course with no refund. I agree the Releasees shall not be liable for slander or libel as part of any such expulsion.

  • PHOTO & VIDEO

  • Photos and video may be taken during training activities and used for GunJitsu marketing and educational purposes. Extreme close-up facial images will not be published without prior approval.
