RELEASE, WAIVER AND INDEMNITY OF LIABILITY

The parent/legal guardian/adult participant (hereinafter referred to as "I", "My", or "Me") on behalf of the child/ward (hereinafter referred to as "Athlete"), both named below, desires for Athlete to participate in cheer gym activities offered by Envy Elite, LLC, a Florida Limited Liability Corporation located at 1511 SW Century Glen, Lake City, FL 32025 (hereinafter referred to as "Envy Elite"). The cheer gym activities offered by Envy Elite, including subsidiary and ancillary events and or activities are hereinafter referred to as the "Activities".
1. I hereby expressly acknowledge that I am fully aware and understand that the Activities to be provided by Envy Elite are inherently dangerous and involve the risk of physical injury, disability, death, paralysis, emotional distress, psychological injury, economic loss, and/or property damage to me, Athlete, and/or third parties. Such risks may be caused by uneven floor surfaces, the condition of facilities, temperature, weather, lack of hydration, physical and mental condition of other participants, equipment, vehicular traffic, and actions of others including but not limited to participants, volunteers, spectators, coaches, event officials, event monitors, and/or producers of any event in which Envy Elite may be a participant. In consideration of the inherent risk(s) involved in participating in the Activities and in further consideration of being permitted to participate in the Activities offered by Envy Elite, I, on behalf of Athlete, our heirs, assigns, personal representatives, and estate, do hereby agree to release, waive, discharge, and hold harmless Envy Elite, as set forth in this instrument (hereinafter referred to as "Release and Waiver").
2. I hereby expressly, waive, release, discharge, and relinquish any and all causes of action and/or claims, whatsoever, for physical injury, disability, death, paralysis, emotional distress, psychological injury, economic loss, and/or property damage occurring to me and/or Athlete, arising out of or as a result of being on Envy Elite property, using Envy Elite facilities located at 1511 SW Century Glen, Lake City, FL 32025, being at any off-site location utilized by Envy Elite for the Activities, and/or engaging in or receiving instructions incidental thereto. I further agree that under no circumstances will I and/or Athlete, our heirs, executors, administrators and assigns, prosecute or present any action, cause of action or claim, whatsoever, for physical injury, disability, death, paralysis, emotional distress, psychological injury, economic loss, and/or property damage against Envy Elite or any of its officers, directors, managers, employees, agents, successors, servants, representatives, or employees (hereinafter collectively referred to as "Releasees"), regardless of whether arising out of the active or passive negligence of Envy Elite and/or their Releasees.
3. I hereby expressly, waive, release, discharge, and relinquish any and all claims against Envy Elite, and its Releasees on account of physical injury, disability, death, paralysis, emotional distress, psychological injury, economic loss, and/or property damage arising out of or attributable to My and/or Athlete's participation in the Activities, including but not limited to traveling to and from any event or gathering related to the Activities, regardless of whether arising out of the active or passive negligence of Envy Elite and/or their Releasees. I further covenant not to make or bring any such claim, whatsoever, against Envy Elite and/or their Releasees and forever release and discharge Envy Elite and their Releasees from any liability, whatsoever, under such claims.
4. In consideration of Me and/or Athlete being permitted by Envy Elite to participate in Activities and to use its equipment and facilities located at 1511 SW Century Glen, Lake City, FL 32025 or at any off-site facility or location utilized by Envy Elite, I shall defend, indemnify, and hold harmless Envy Elite and their Releasees against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable attorney fees, fees, the costs of enforcing any right to indemnification under this Release and Waiver, and the cost of pursing any insurance providers arising out of or resulting from any claim of a third party related to My and/or Athlete's participation in the Activities, including any claim(s) related to my own negligence and/or the active or passive negligence of Envy Elite.
5. I hereby expressly consent for Me and/or Athlete to receive medical treatment deemed necessary if I and/or Athlete are injured or require medical attention during My and/or Athlete's participation in the Activities provided by Envy Elite. I understand and agree that I am solely responsible for all costs related to such medical treatment and any related medical transportation and/or evacuation for Me and/or Athlete. I hereby release, forever discharge, and hold harmless Envy Elite from any claim, whatsoever, based on such treatment or medical services rendered in relation thereto, either directly or indirectly.
6. I hereby expressly consent and promise to accept and assume all risks, both known and unknown, connected with Envy Elite. I and/or Athlete elect to participate in the Activities willingly and voluntarily despite all risks. No one has forced or coerced Me and/or Athlete to participate in any Activities offered by Envy Elite.
7. I hereby expressly allow Envy Elite and its Releasees to photograph and to record Athlete via audio and visual means for publicity and advertising purposes only. All photos, audio, and visual recordings are property of Envy Elite and I hereby expressly waive all right to any monetary and/or intellectual rights in any such photographic, audio, and/or visual recordings.
8. By signing this Release and Waiver it is my intention to expressly and unequivocally assume all risk of any physical injury, disability, death, paralysis, emotional distress, psychological injury, economic loss, and/or property damage upon me and/or Athlete, to the exclusion of Envy Elite and its Releasees, and to exempt and relieve Envy Elite and its Releasees of any liability for any physical injury, disability, death, paralysis, emotional distress, psychological injury, economic loss, and/or property damage even if such injury, damage or death was caused, in whole or in part, by the active or passive negligence of Envy Elite and/or its Releasees. I expressly acknowledge and intend that if any injury occurs, either physically or psychologically, or if property is damaged or destroyed during My and/or Athlete's participation in the Activities, I and/or Athlete will be found by a court of law to have waived any right to maintain a lawsuit against Envy Elite and its Releasees on the basis of any such claim(s) by signing this Release and Waiver.
