In consideration of participating in AKP Sports Foundation’s Sports Academy and related events and activities (the “AKP Sports Academy”), I {1stChild}, {2ndChild}, {3rdChild}, {4thChild} (“Participant”) acknowledge, and agree with the following provisions:
1. I acknowledge that any participation in physical activities at the AKP Sports Academy involves inherent risks. I acknowledge that the risks of temporary or permanent injury and illness (ex: communicable diseases such as MRSA, influenza, and COVID-19) from the activities involved in this program are significant, including the potential for permanent paralysis and death, and while particular rules, equipment, and personal discipline may reduce these risks, the risks of serious injury and illness do exist. I acknowledge that participation in the AKP Sports Academy involves incidental activities, including travel to and from the site of AKP Sports Academy, and the possible reckless conduct of other participants.
2. I acknowledge and agree to comply with the stated, written, and customary terms and conditions for participation. If, however, I observe any unusual, significant hazard during my participation in the AKP Sports Academy, I will remove myself from participating and bring such hazard to the attention of the nearest official immediately.
3. I acknowledge that I am solely responsible for all costs related to any potential medical treatment or transportation for any injuries sustained during my participation in the AKP Sports Academy. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of AKP Sports Foundation, including but not limited to their agents, representatives, partners, and employees, and assume full responsibility for my participation. I am voluntarily participating in the AKP Sports Academy with knowledge of the danger involved and hereby agree to accept all risks related to personal injury, property damage, or any other harm that may arise in connection with my participation in the AKP Sports Academy and related events and activities.
4. I hereby agree for myself and on behalf of my heirs, assigns, personal representatives and next of kin, to release, waive, indemnify, and hold harmless AKP Sports Foundation, their officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“Releasees”), with respect to any and all present and future claims, cause of actions, losses, or liability for injury, damage to property, illness, disability, or death, whether arising from the negligence of the Releasees or otherwise, to the fullest extent permitted by law.
5. I hereby grant AKP Sports Foundation and its affiliated entities a non-exclusive, royalty-free license to use, reproduce, distribute, and publicly display any content, including but not limited to photographs, videos, or other creative expressions produced by AKP Sports Foundation, for promotional, marketing, or any other lawful purposes related to AKP Sports Foundation. I affirm that they own all intellectual property rights in the content and have the legal right to grant this license.
6. I acknowledge that this Waiver and Release of Liability Agreement (“Agreement”) contains the entire agreement between the parties, and supercedes any prior written or oral agreements between them concerning the subject matter of this Agreement.
7. I acknowledge that this waiver is intended to be broad and inclusive as permitted by the laws of the state of California. I agree that if any portion is held invalid, the remainder of the waiver will continue in full force and effect. I agree that the provisions in this Agreement will continue in full force and effect even after the AKP Sports Academy ends on June 27, 2026.
FOR PARTICIPANTS OF MINORITY AGE (UNDER AGE 18 AT THE TIME OF REGISTRATION)
I am the parent or legal guardian of the minor named above. I have the legal right to consent to the minor’s participation in the AKP Sports Academy. By signing below, I release and agree to hold harmless the Releasees from any and all liabilities incident to my minor child’s involvement or participation in the AKP Sports Academy, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent permitted by law. I personally and fully assume all risks and responsibilities as per this agreement on behalf of the minor child named above.
