ASSUMPTION OF RISK, RELEASE OF LIABILITY, INDEMNIFICATION, AND MEDIA RELEASE AGREEMENT
In consideration for being permitted to participate in, attend, volunteer at, coach, officiate, manage, supervise, or otherwise be involved in any Maine Timber Hockey LLC tournament, event, activity, or related function (collectively, the “Event”), the undersigned participant, volunteer, coach, official, team representative, spectator participating in Event activities, and/or parent or legal guardian of a minor participant acknowledges and agrees as follows:
ASSUMPTION OF RISK
The undersigned understands and acknowledges that ice hockey and hockey-related activities involve inherent risks and dangers that may result in serious bodily injury, illness, permanent disability, paralysis, death, property damage, and other losses. These risks include, but are not limited to, collisions with players, officials, spectators, boards, glass, pucks, sticks, equipment, playing surfaces, facility conditions, transportation, acts or omissions of participants or third parties, and exposure to communicable illnesses, viruses, bacteria, and other infectious diseases.
The undersigned knowingly and voluntarily accepts and assumes all such risks, whether known or unknown, foreseeable or unforeseeable, arising from participation in or attendance at the Event.
RELEASE OF LIABILITY
The undersigned, on behalf of himself or herself, and on behalf of any minor participant for whom he or she is signing, as well as their respective heirs, executors, administrators, personal representatives, and assigns, hereby releases, waives, discharges, and covenants not to sue Maine Timber Hockey LLC, tournament organizers, facility owners and operators, host organizations, sponsors, vendors, participating teams, coaches, officials, volunteers, directors, officers, employees, agents, contractors, and representatives (collectively, the “Released Parties”) from any and all claims, demands, causes of action, liabilities, damages, costs, expenses, or losses arising out of or related to injury, illness, death, property damage, or other harm sustained in connection with participation in or attendance at the Event.
To the fullest extent permitted by law, this release includes claims arising from the ordinary negligence of any Released Party.
PARENT/GUARDIAN CONSENT AND RELEASE
If the participant is under the age of eighteen (18), the undersigned parent or legal guardian acknowledges that he or she has read and understands this Agreement, consents to the minor’s participation in the Event, and agrees individually and on behalf of the minor participant to all terms contained herein, including the assumption of risk, release of liability, indemnification, medical authorization, and media release provisions.
INDEMNIFICATION
The undersigned agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, actions, liabilities, damages, judgments, costs, and expenses, including reasonable attorneys’ fees, arising from the conduct of the undersigned or any minor participant for whom the undersigned is responsible, or arising from any breach of this Agreement.
MEDIA RELEASE
The undersigned grants Maine Timber Hockey LLC and its designees the unrestricted right to photograph, record, livestream, film, reproduce, publish, distribute, and otherwise use the participant’s name, image, likeness, voice, and appearance in any medium now known or later developed for promotional, marketing, educational, archival, or other lawful purposes without compensation or further consent.
SEVERABILITY
If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.
GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the State of Maine. Any dispute arising out of or relating to this Agreement or the Event shall be brought exclusively in a court of competent jurisdiction located within the State of Maine.
ACKNOWLEDGMENT
THE UNDERSIGNED ACKNOWLEDGES THAT HE OR SHE HAS CAREFULLY READ THIS AGREEMENT, UNDERSTANDS ITS CONTENTS, UNDERSTANDS THAT CERTAIN LEGAL RIGHTS ARE BEING WAIVED, INCLUDING THE RIGHT TO BRING CERTAIN CLAIMS AGAINST THE RELEASED PARTIES, AND VOLUNTARILY AGREES TO ITS TERMS.
