    SECTION 13-21-119 COLORADO REVISED STATUTES.

  • Inherent risks include, but are not limited to, the propensity of horses to behave unpredictably, collisions, surface
    conditions, and actions or omissions of riders. Equine activities, by their nature, present the risk of injury and/or illness
    that may range in severity from minor to long-term, catastrophic or death. Equine activities also present a risk of loss or
    damage to personal property, including horses. It is not possible to eliminate the risk to participants.
    BY SIGNING THIS FORM BELOW, THE UNDERSIGNED ACKNOWLEDGES THAT HE/SHE HAS READ AND
    UNDERSTANDS THIS AGREEMENT AND AGREES WITH THE TERMS AND CONDITIONS SET FORTH
    HEREIN AND HAS SIGNED THIS AGREEMENT AS HIS/HER FREE AND VOLUNTARY ACT AFTER HAVING THE
    OPPORTUNITY TO OBTAIN LEGAL COUNSEL IF DESIRED, AND WITHOUT RELIANCE UPON ANY
    STATEMENT
    OR REPRESENTATION BY PERSONS OR PARTIES RELEASED OR THEIR REPRESENTATIVES EXCEPT AS
    EXPRESSLY
    STATED HEREIN.
  • The undersigned, in consideration of being permitted to ride or handle any horse, to enjoy the facilities, and/or
    to participate in or attend any activity(ies) or function(s) associated with Leslie Wolfe-Davis d.b.a. No Limits
    Equestrians no matter where occurring, on behalf of the undersigned, minor child (if applicable), and the
    undersigned's personal representatives, heirs, agents, assigns and successors agrees as follows: The undersigned
    represents that he/she is legally competent to execute this Agreement and accepts full responsibility therefore and assumes
    any risks associated therewith.
    THE UNDERSIGNED:
  • 1. FOREVER RELEASES, REMISES, WAIVES, ACQUITS, DISCHARGES AND COVENANTS TO NOT
    HOLD LIABLE Nicole Hine d.b.a. 5280 Saddle Up LLC., heirs, successors, and assigns, its
    owners, managers, members, employees, volunteers, instructors, entertainers, contractors, agents, and successors, individually
    hereinafter referred to as "Releasees," from any and all actions, causes of action, claims, demands, losses, damages,
    costs, attorney fees, judgments, liens, indebtedness and liabilities whatsoever in any form or on any basis, known or
    unknown, suspected or unsuspected, arising from or related to, directly or indirectly, the undersigned's participation as
    defined in the paragraph immediately above.
  • 2. AGREES TO INDEMNIFY, DEFEND, SAVE AND HOLD HARMLESS the Releasees against any and all
    claims, damages, liability and awards, including costs, expenses and attorney fees, incurred due to the participation
    by the undersigned, as defined above whether caused by any act or omission of the Releasees or some other cause.
  • 3. ASSUMES FULL RESPONSIBILITY FOR ANY RISK OF BODILY INJURY, ILLNESS, DEATH AND/OR
    PROPERTY DAMAGE, whether caused by the Releasees or some other cause.
  • 4. EXPRESSLY acknowledges and agrees that participation in equine activities may be dangerous and involves the
    risk of serious injury, illness or death and the risk of damage to personal property.
  • 5. EXPRESSLY agrees that this Release & Indemnification Agreement is intended to be as broad and inclusive as is
    permitted by the laws of the State of Colorado, that the laws of the State of Colorado shall govern this Release &
    Indemnification Agreement, and that if any portion hereof is declared invalid or becomes inoperative for any reason, the
    balance shall, notwithstanding, continue in full legal force and effect.
  • 6. EXPRESSLY agrees that any action arising from or relating to the aforementioned activity and/or any actions
    against the Release & Indemnification Agreement shall be brought only in Adams County, Colorado.

  • BARN RULES & SAFETY AGREEMENT

  • Please read carefully and keep this page for reference during your visit.
  • For the safety of all guests, riders, handlers, staff, volunteers, and animals, the following rules apply to all 5280 Saddle Up LLC activities and facility areas. Parents/guardians are responsible for supervising minor children at all times.
  • Arrival & Supervision

    • Check in with 5280 Saddle Up LLC staff before entering any barn, pen, arena, or animal area.
    • Children must remain with a parent/guardian unless directed by staff.
    • Guests may not enter stalls, paddocks, tack areas, feed areas, trailers, or gates without permission.
    • Follow all instructions from staff, handlers, instructors, or volunteers immediately.
  • Around Horses & Ponies

    • Walk only. No running, yelling, roughhousing, chasing animals, or sudden movements near horses.
    • Approach horses only when staff says it is safe. Approach calmly from the front/side where the horse can see you.
    • Do not feed, pet, lead, tie, untie, or handle any horse or pony without staff permission.
    • Keep fingers, hands, clothing, balloons, toys, and loose items away from mouths, gates, fences, ropes, and tack.
  • Riding Rules

    • Closed-toe shoes are required for anyone riding or entering animal areas. Jeans or leggings are recommended.
    • Helmets or other safety equipment will be required. 5280 Saddle Up LLC will provide helmets.
    • One rider at a time unless staff specifically approves otherwise. Riders must stay seated and hold on as directed.
    • Riders may not mount, dismount, adjust tack, or walk behind a horse unless assisted by staff.
  • Facility & Party Rules

    • Food, drinks, cake, and party items must remain in designated areas and away from horses unless approved.
    • Dogs or other pets are not allowed unless approved in advance by 5280 Saddle Up LLC.
    • Smoking, vaping, alcohol, firearms, fireworks, and open flames are not permitted.
    • Guests are responsible for their personal belongings. 5280 Saddle Up LLC is not responsible for lost, stolen, or damaged items.
  • Health, Weather & Emergencies

    • Report any injury, illness, fall, bite, kick, equipment concern, or unsafe condition to staff immediately.
    • Activities may be paused, changed, or canceled due to weather, animal behavior, safety concerns, or facility conditions.
    • Guests with allergies, medical concerns, or special needs should notify staff before activities begin
    • In an emergency, follow staff directions and move calmly to the designated safe area.
  • Respect for Animals & Property

    • Treat all animals kindly and respectfully. Do not hit, tease, scare, pull, poke, or throw objects near animals.
    • Do not climb on gates, fences, equipment, hay, trailers, or furniture.
    • Use designated trash/recycling areas and help keep the barn and party area clean.
    • Anyone who does not follow these rules may be asked to stop participating or leave the premises.

  • By signing below, I acknowledge that I have received, read, and agree to follow the 5280 Saddle Up LLC Barn Rules. I understand that failure to follow these rules may result in removal from the activity or premises.
