FUN FACTORY WAIVER & RELEASE OF LIABILITY
PLEASE READ CAREFULLY BEFORE SIGNING
By entering and participating in activities at Fun Factory, I acknowledge and agree to the following terms and conditions:
Fun Factory is a parent/guardian-supervised facility. Parents and guardians are strongly encouraged to keep children within their sight at all times and to closely monitor their activities while on the premises.
All guests, including children and parents/guardians, are expected to follow all posted rules, safety instructions, and staff directions related to the facility and its activities. Guests are also expected to behave respectfully toward others to help maintain a safe and enjoyable environment. Fun Factory reserves the right to ask any individual who fails to follow the rules or behaves in an unsafe or disruptive manner to leave the premises without refund.
I understand and acknowledge that activities at Fun Factory are physically active and may involve risks, including but not limited to slips, falls, collisions, equipment failure, improper use of equipment, or contact with other participants. These risks may result in injuries including, but not limited to, sprains, fractures, dislocations, concussions, paralysis, heart attack, emotional distress, or even death.
I acknowledge that participation in any activity at Fun Factory is voluntary and undertaken entirely at my own risk. I understand that it is my responsibility to assess my own physical condition and the physical condition of any minor(s) under my care before participating in any activities.
Fun Factory (and/or any entity acting as or on behalf of Fun Factory), including its owners, operators, employees, contractors, affiliates, and representatives, shall not be held liable for any injury, illness, death, loss, damage, or expense arising from participation in activities at the facility, including those caused by negligence, breach of duty, or failure to warn.
The facility is monitored by video surveillance for safety and security purposes. Surveillance footage may only be accessed or shared with law enforcement authorities or as otherwise required by law.
I acknowledge and consent that photographs and video recordings may be taken within Fun Factory for promotional, marketing, and social media purposes. By entering the facility, I grant Fun Factory permission to use any such images or recordings that may include members of my group or me without compensation or further notice.
Fun Factory is a socks-only facility. For the safety, cleanliness, and hygiene of all guests, all children and adults are required to wear socks at all times while inside the facility and activity areas.
Guests are welcome to take photographs or videos of their own families and participating guests while at the facility. Guests are asked to make reasonable efforts to avoid capturing individuals outside their group without consent.
By signing this Waiver and Release of Liability, I acknowledge that I fully understand and voluntarily accept all risks associated with participation at Fun Factory. I agree, on behalf of myself, my child(ren), heirs, executors, administrators, and assigns, to release, waive, discharge, and hold harmless Fun Factory and its owners, employees, contractors, affiliates, and representatives from any and all claims, demands, actions, damages, liabilities, costs, or expenses arising out of or related to participation in activities at Fun Factory, including claims arising from negligence, breach of contract, breach of statutory duty, or breach of the Occupiers’ Liability Act, R.S.O. 1990, c. O.2.
By signing below, I confirm that I have read, understood, and agree to the terms of this Waiver and Release of Liability.
