Insurance & Liability - The Provider maintains comprehensive general liability insurance for all operations. The Provider assumes no liability for accidents, injuries, or property damage occurring outside the scope of normal gelato truck operations. The Client is responsible for any damages caused to the truck, equipment, or serving supplies due to negligence, misuse, or intentional acts by event attendees.
Allergen & Dietary Disclosure - Gelato and toppings served by The WAVE Gelato Truck may contain or come into contact with common allergens including, but not limited to: milk, eggs, soy, wheat, tree nuts, and peanuts. The Provider makes every reasonable effort to accommodate dietary restrictions when notified in advance, but cannot guarantee a completely allergen-free environment. It is the Client’s responsibility to inform guests of potential allergen risks. The Provider shall not be held liable for any allergic reactions or adverse health effects resulting from the consumption of products served at the event.
Food Safety - All gelato is stored, transported, and served in compliance with applicable Connecticut food safety regulations. The Provider maintains proper cold chain protocols and ServSafe-compliant handling procedures throughout the event. Indemnification The Client agrees to indemnify, defend, and hold harmless the Provider, Sound Life Connections Inc., and its employees, volunteers, and agents from and against any and all claims, damages, losses, or expenses (including reasonable attorney’s fees) arising from or related to the Client’s event, except to the extent caused by the Provider’s gross negligence or willful misconduct.
Force Majeure - Neither party shall be held liable for failure to perform its obligations under this Agreement due to circumstances beyond its reasonable control, including but not limited to severe weather, natural disasters, government orders, pandemics, or equipment failure. In such cases, the parties will work together in good faith to reschedule or modify the event.
Cancellation Policy - More than 14 days before the event: Full refund minus deposit. 7–14 days before the event: 50% refund of total cost. Less than 7 days before the event: No refunds. Events canceled due to severe weather may be rescheduled at no additional charge, subject to availability.
Client Responsibilities - Provide a level parking space with at least 30 feet of clearance for the gelato truck. • Ensure legal parking and obtain any necessary permits if required. Provide access to electricity if needed or inform the Provider in advance. Designate a point of contact who will be available on the day of the event.
