I acknowledge, understand and agree to the following terms should my request for extra-duty officers for police-related work be granted:

1. The number of officers (and supervisor if necessary) will be determined by the Department based on the type of event and expected attendance. I agree to pay upon invoice the hourly rate set by the Department for each officer or supervisor assigned pursuant to this request and agreement; and

2. The Department will determine whether officers assigned pursuant to this request will be in Department uniform. Officers assigned pursuant to this request will confine their power of arrest to the enforcement of ordinances and statutes. Policies and regulations of Permitee/employer which are not a violation of law will be attended to by the officer, when consistent with Department policies and procedures, but no arrest shall be made for this type of violation. Any law offenders will be prosecuted, and Permitee/employer agrees to provide any necessary assistance; and

3. Officers assigned to extra-duty employment may be required to leave the assignment if enforcement action under this agreement requires a custodial arrest or when the Town's health, safety and welfare require an extra-duty officer to perform the officer's primary function in another area of the Town.

4. Waiver and Indemnification: Permitee/Employer, in consideration of the Department assigning extra-duty officers, I hereby waive, release and discharge the Town of Mead, its officers, employees, agents and assigns, individually and collectively (the "Town") from any and all liability, claims, demands, and causes of action for costs, charges, obligations, expenses, legal fees, judgments, injuries, losses or damages associated with, arising out of, or in any way related to, the extra-duty assignment requested, whether or not caused by an act, omission, negligence, or other fault of the Town, its officers, employees, program associates, agents or volunteers. I further agree to defend, indemnify and hold harmless the Town, its officers, employees, agents and assigns, individually and collectively, from and against all liability, claims, demands and causes of action for costs, charges, obligations, expenses, legal fees, judgments, injuries, losses or damages associated with, arising out of, or in any way related to, or caused by Permitee/Employer's online application for or receipt of an event permit, use of extra-duty police officers pursuant to an event permit, and/or access to public property in Mead, Colorado pursuant to an event permit.

5. The Town of Mead will be reimbursed for the officer(s) that work at the current special event pay rate for the Mead Police Department. The rate charged for each officer will $99.00 per hour and supervisors will be $115.50 per hour.
