I exercise my own free and voluntary choice to participate in the designated activity, including use of equipment provided by Peak Medical Education. I understand and assume all associated risks of the designated activity. These risks include, but are not limited to:
Lifting and/or carrying “patients” in scenarios; Being lifted and/or carried as a “patient” in scenario.
Possibility of staining clothing with moulage “ fake blood” or other makeup substances or from muddy ground.
Trips, slips, or fall.
Psychological stress from scenarios or examples shared in class.
Illness from COVID-19 or other communicable diseases.
Medical Advice
Peak Medical Education does not provide medical advice. Course content is for general informational purposes only. The service and its content are not intended to be a substitute for professional medical advice, diagnosis, or treatment. Reliance on information provided by Peak Medical Education or third parties is solely at your own risk. Never disregard professional medical advice or delay in seeking it because of something you have viewed or heard in these courses. Should you have an emergency, call your physician or dial 911 immediately. Developments in medical research may impact the information in our courses. No assurance can be given that the advice contained in our courses will always include the most recent findings. Healthcare providers should exercise their own judgment in determining whether a particular recommendation is appropriate for their patients.
Errors and Inaccuracies
We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
Feedback
If you provide Peak Medical Education with any feedback or suggestions regarding the site or service or courses (“Feedback”), you hereby assign to Peak Medical Education all rights in such Feedback and agree that Peak Medical Education shall have the right to use and fully exploit such Feedback and related information in any manner it deems appropriate. Peak Medical Education will treat any Feedback you provide to us as non-confidential and non-proprietary.
Indemnity
By use of this site or attendance of a course, you agree to defend, indemnify and hold harmless Peak Medical Education and its subsidiaries, agents, licensors, managers, and other affiliated companies, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from: (a) your use of and access to the service or course, including any data or content transmitted or received by you; (b) your violation of any term of this agreement, including without limitation your breach of any of the representations and warranties above; (c) your violation of any third-party right, including without limitation any right of privacy or Intellectual Property Rights; (d) your violation of any applicable law, rule or regulation; (e) any claim or damages that arise as a result of any of your user submissions or any that is submitted via your account; or (f) any other party’s access and use of the Service with your unique username, password or other appropriate security code.
I agree to assume all risk of personal injury or loss, bodily injury (including death), damage to or loss of, or destruction of any personal property resulting from or arising out of participation in the designated activity. I also release, waive, indemnify, hold harmless, and discharge Peak Medical Education from all claims, damages, and injuries arising out of my activities, including my use of equipment and facilities provided by Peak Medical Education.
Limitation of Liability
Peak Medical Education does not provide health insurance for individuals participating in activities made available or sponsored by Peak Medical Education. As such, you or your personal health insurance will be responsible for payment of medical services and care for any injuries sustained during the designated activity.
To the maximum extent permitted by applicable law, in no event shall Peak Medical Education, its affiliates, agents, directors, employees, suppliers, or licensors be liable for any direct, indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, date, or other intangible losses, that result from the use of, or inability to use, this service or content. To the maximum extent permitted by applicable law, Peak Medical Education assumes no liability or responsibility for any (1) errors, mistakes, or inaccuracies of content; (2) personal injury or property damage, of any nature whatsoever, resulting in your access to or use of our service or courses; (3) any interruption or cessation of transmission to or from the service; or (4) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our service by any third party; (5) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the service. Notwithstanding anything to the contrary contained herein, our liability to you for any damages arising from or related to this agreement or your use of the service or any course (for any cause whatsoever and regardless of the form of the action), will at all times be limited to the greater of the amount you paid to us for the applicable course or fifty ($50) US dollars.
Photographs
Peak Medical Education has my permission to use my photograph publicly to promote the business. Images may be used in print, digitally, or in social media. I understand that no compensation shall become payable to me for such use. To decline photo release, ask your instructor for a paper waiver, and mark out this section.
I hereby certify that I have read and understand the provisions above. For participants under 18 years of age, the parent or guardian accepts the above terms and grants permissions for the student’s participation on behalf of said minor, as permitted by C.R.S. § 13-22-107.
