Liability Waiver

Assumption of Risk

I, the undersigned Parent/Guardian, hereby acknowledge that my child/ward, the Participant, is voluntarily participating in the physical conditioning, strength, speed, agility, physical education courses, sports training programs, sports and activities (such as but not limited to: softball, baseball, wrestling, football, track & field, cross country, volleyball, soccer, flag football, frisbee, disc golf, kickball, tennis, pickleball), lessons, camps, clinics, intensives and competitions offered by The Forge Athletic Development, a trade name of Fastpitch Focus, LLC (collectively, The Forge).

I understand and acknowledge that participation in physical exercise and sports activities involves inherent risks of physical injury, including, but not limited to: muscle strains, pulls, tears, broken bones, joint injuries, heat exhaustion, dehydration, concussions, and, in rare circumstances, catastrophic injury or death. Before undertaking any new physical activity it is recommended you consult with your physician.

I further acknowledge that there are risks associated with the use of equipment, facility maintenance, and the ordinary negligence, actions and omissions of other participants.

I knowingly and freely assume all such risks, both known and unknown, including but not limited to those provided above, even if arising from the ordinary negligence,  actions or omissions  of the Releasees, The Forge, its owners, employees, instructors, volunteers, officials, agents and coaches.

Waiver and Release of Liability

I, for myself, my spouse, my child, and on behalf of my/our heirs, assigns, personal representatives, and next of kin, hereby release and forever discharge The Forge and its directors, officers, officials, agents, employees, coaches, instructors and volunteers (the “Releasees”) from all liability, claims, demands, losses, or damages on account of injury, including death or damage to property, caused or alleged to be caused in whole or in part by the ordinary negligence, actions or omissions of the Releasees.

Indemnification and Hold Harmless Agreement

I agree to indemnify and hold harmless The Forge, from any and all liabilities incident to my child’s involvement or participation in these programs, even if arising from their ordinary negligence,  actions or omissions , to the fullest extent permitted by law.

Governing Law

This Agreement and all disputes, claims, or causes of action arising out of or relating to this Agreement (including, but not limited to, the validity, construction, performance, or termination of this Agreement) shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of laws principles. The parties irrevocably consent and submit to the personal and exclusive jurisdiction of the state and federal courts located in Pinal County, Coolidge, Arizona, for the purpose of resolving any such dispute, claim, or cause of action.

Severability

The provisions of this Agreement are intended to be severable. If any provision of this Agreement, or the application of such provision to any person or circumstance, is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable in any respect, that invalidity, illegality, or unenforceability shall not affect the validity, legality, or enforceability of any other provision or application. In such an event, the invalid or unenforceable provision shall be deemed to have been modified, to the minimum extent necessary, so that the modified provision is valid and enforceable and reflects the parties' intent as closely as possible.

Consent for First Aid and Medical Treatment

Authorization for Treatment

I authorize The Forge staff, its owners, employees, instructors, volunteers, officials, coaches and agents (collectively, “The Forge Staff”) to administer minor first aid, such as but not limited to applying bandages, cold packs, or antiseptic wipes) for non-emergency injuries or illnesses sustained during participation.

In the event of an emergency or severe injury where I, the Parent/Guardian, cannot be reached after reasonable efforts, I authorize The Forge Sstaff to secure and arrange for my child to receive necessary emergency medical treatment, including transportation to the nearest hospital or emergency center.

I understand that The Forge Staff will attempt to notify me at the earliest opportunity.

Financial Responsibility and Release

I understand and agree that I am solely responsible for any and all costs associated with such emergency medical treatment, hospitalization, or transport.

I waive and release any claims against The Forge, its owners, employees, instructors, volunteers, officials, coaches and agents ,for any liability, claims, or demands arising out of any good-faith first aid, treatment, or medical service rendered or secured, or the lack thereof, in connection with my child's participation.

Photo, Video, and Media Release Consent

Grant of Permission

I hereby grant The Forge and its employees the irrevocable right and permission to photograph, film, videotape, record, and/or otherwise capture my child’s image, likeness, or voice (collectively, "Materials") during classes, training sessions, and events.

Usage and Compensation Waiver

I authorize The Forge, to use the Materials, in whole or in part, for any legal promotional or advertising purpose, including, but not limited to, use on their website, social media (e.g., Instagram, Facebook, Tiktok, etc.), print marketing, and informational presentations.

I waive any right to inspect or approve the finished product and waive any right to royalties, fees, or other compensation arising or related to the use of the Materials.

Parent/Family Code of Conduct Agreement

At The Forge we are committed to providing a safe, positive, and developmental environment for all participants. This requires a commitment from every parent and family member to uphold the following standards of conduct:

I. Respect and Professionalism

• Respect for Staff: I agree to treat all The Forge owners, employees, instructors, volunteers, officials coaches and agents with courtesy, respect, and professionalism at all times. Any concerns I have will be addressed privately and constructively with facility management, not during or immediately after a session.
• Respect for Facility: I will respect all The Forge’s rules regarding facility access, equipment usage, and safety protocols, and will ensure all family members and spectators under my care do the same.

II. Sportsmanship and Positive Modeling

• Model Good Behavior: I will model exemplary sportsmanship and behavior for all participants. I understand that my conduct directly influences the young athletes.
• Encouragement Only: I will only offer positive encouragement to my child, other participants, and opposing teams. I will never engage in any negative criticism, yelling, or derogatory comments toward any athlete, coach, official, or spectator.
• Zero Tolerance for Abuse: I understand that The Forge has a zero-tolerance policy for verbal abuse, intimidation, harassment, or physical aggression toward any individual.

III. Enforcement

• I understand that failure to comply with this Code of Conduct by me, my spouse, or other family members/spectators under my care may result in disciplinary action, up to and including the immediate suspension or termination of my child’s participation without a refund.

Acknowledgment of Agreement

By signing below, I acknowledge that I have read, understand, and agree to abide by The Forge’s Parent/Family Code of Conduct, and to ensure all individuals attending events under my supervision are also aware of and abide by these standards.
