NW GOLF EXPERIENCE
RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND WAIVER AGREEMENT
PLEASE READ CAREFULLY BEFORE SIGNING.
THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS.
BY SIGNING THIS AGREEMENT, YOU ARE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
In consideration for being allowed to participate in activities provided by NW Golf Experience (“Company”), I acknowledge and agree to the following:
1. ACKNOWLEDGMENT OF RISKS
I understand that participation in golf simulator activities, event entertainment activities, and related activities involves inherent and significant risks, including but not limited to:
Being struck by golf clubs, golf balls, simulator equipment, projectiles, or other objects
Serious personal injury, permanent disability, paralysis, or death
Slipping, tripping, falling, collisions, or loss of balance
Injuries resulting from swinging golf clubs
Injuries caused by other participants, spectators, or event attendees
Equipment malfunction, misuse, improper installation, or equipment failure
Risks involving extension cords, cables, projector stands, launch monitors, hitting mats, turf, screens, netting, barriers, electrical equipment, tables, flooring, inflatable enclosures/canopies, tents, anchors, weights, or temporary event structures
Risks associated with indoor venues, outdoor venues, uneven surfaces, weather, wind, rain, lighting, or temporary event conditions
Risks associated with transportation, setup, operation, supervision, or teardown of equipment
I understand that these risks may result from my own actions, the actions of others, equipment conditions, venue conditions, or the ordinary negligence of NW Golf Experience or others.
I knowingly and voluntarily assume all risks, known and unknown, associated with participation.
2. PARTICIPANT RESPONSIBILITIES
I agree to:
Follow all instructions provided by NW Golf Experience staff/operators
Remain outside designated swing areas unless actively participating
Keep a safe distance from participants actively swinging golf clubs
Use all equipment safely and only as intended
Refrain from horseplay, reckless behavior, or unsafe conduct
Immediately report unsafe conditions or damaged equipment
Supervise any minor children under my care
Refrain from participation if impaired by alcohol, drugs, medication, illness, or any condition affecting safe participation
I understand NW Golf Experience reserves the right to deny or remove participation for unsafe, disruptive, or intoxicated individuals.
3. RELEASE AND WAIVER OF LIABILITY
To the fullest extent permitted by law, I release, waive, discharge, and covenant not to sue NW Golf Experience and its owners, operators, employees, contractors, volunteers, affiliates, sponsors, venues, landlords, property owners, event organizers, partners, agents, successors, and assigns (“Released Parties”) from any and all claims, liabilities, demands, damages, losses, expenses, causes of action, or lawsuits arising out of or related to:
Personal injury
Bodily injury
Illness
Death
Property damage
Property loss
Participation in golf simulator activities
Use of golf clubs, golf balls, simulator equipment, inflatable enclosures/canopies, screens, nets, or related event equipment
Setup, operation, supervision, transportation, or teardown of equipment
The ordinary negligence of the Released Parties
This release does not apply to gross negligence, reckless conduct, or intentional misconduct where prohibited by law.
4. MEDICAL AUTHORIZATION
I authorize NW Golf Experience and event personnel to obtain emergency medical treatment for me if deemed necessary. I understand I am solely responsible for all medical costs and expenses incurred.
5. PROPERTY DAMAGE RESPONSIBILITY
I accept responsibility for damage caused by my intentional misconduct, reckless conduct, misuse of equipment, or failure to follow instructions.
6. PHOTO AND VIDEO RELEASE
I grant NW Golf Experience permission to photograph, record, and use my image, likeness, voice, and participation for marketing, advertising, social media, website, promotional, and business purposes without compensation unless I notify NW Golf Experience in writing before participation.
7. MINORS
Participants under 18 years of age must have this agreement signed by a parent or legal guardian.
I understand that a parent or guardian signing below represents that they have authority to sign on behalf of the minor participant.
8. SEVERABILITY
If any portion of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
9. GOVERNING LAW
This Agreement shall be governed by the laws of the State of Washington.
